PETITION
Petitioners and unto this Office, most respectfully avers:

1. That petitioners ROY A. CABAÑERO, married to Diane


Christine B. Cabañero, JENNY C. ABELLA, married to
Ronald Alan Abella, MICHAEL A. CABAÑERO, married to
Rowena Joy N. Cabañero and BINGSON T. CABAÑERO,
single, all of legal ages, Filipinos, residents of Davao
City, Philippines, where they may be served with summons
and other processes of the Honorable Office;
2. That petitioners are the registered owners of that parcel of
land covered by Transfer Certificate of Title No. T-449863
containing an area of FIVE HUNDRED AND FIFTY ONE
(551) square meters, more or less, situated in Davao City
and registered with the Land Registration Authority,
Registry of Deeds for Davao City, described as follows:
A Parcel of Land (Lot 1, Blk 7 of the Subd. Plan
(LRC) Psd-2867 being a portion of Lot 1, described
on plan. Psd-26047 LRC (GLRO) Cad. Record No.
317) Situated in the Davao City. Bounded on the NE.,
points 1 to 2 by Lot 2, Block 7 of the subd. Plan; on
the SE., points 2 to 3 by Road Lot 1 of the subd.
Plan; on the SW., points 3 to 4 by road lot 1 of the
subd. Plan.; and points 4 to 5 by property of
Santiago Dacudao (Lot 508-A, Psd-17769, proposed
road); and on the NW., points 5 to 1 by Lot 3 Block 7
of the subd. Plan. Beginning at point marked 1 on
plan, being N. 26 deg. 35 W., 1453.59 m. from Mon.
4, Davao Townsite. Thence….
3. That Petitioners have engaged the professional services of
LOVE A. PANAGUITON duly licensed Geodetic Engineer to
subdivide that Lot 1, Block 7, (LRC) Psd-2867 approved and
certified as subdivision plan duly approved by the
Department of Environment and Natural Resources, Land
Management Services, Region XI, Davao City on June 28,
2017 which portions may be identified and described as:
Lot 1-A Area: 138 sq. m. (LU-300)
Lot 1-B Area: 138 sq. m (LU-300)
Lot 1-C Area: 138 sq. m. (LU-300)
Lot 1-D Area: 138 sq. m. (LU-300)
4. That Petitioners agreed that the above-said portions to be
divided between them in the following manner:
Lot 1-A Area: 138 sq. m. (LU-300) for ROY A. CABAÑERO
Lot 1-B Area: 138 sq. m (LU-300) for BINGSON T. CABAÑERO
Lot 1-C Area: 138 sq. m. (LU-300) for MICHAEL A. CABAÑERO
Lot 1-D Area: 138 sq. m. (LU-300) for JENNY C. ABELLA

5. That petitioners now submits the racing cloth of the Plan and
two blue print copies of the same two copies each of the
approved technical descriptions, the owner’s copy of the
Transfer Certificate of Title No. T-449863.

WHEREFORE, premises considered, it is most respectfully


prayed of this Honorable Office that Transfer Certificate of title No.
T-449863 be TOTALLY CANCELLED and in lieu thereof issue new
separate titles in our names as above-indicated.
Other reliefs just and equitable are likewise prayed in the
premises.
