STIPULATION OF AGREEMENT, Itis agreed by and between the Town of Hyde Park (hereinafter “Town”) and the Town. of Hyde Park Police Benevolent Association, Inc. (hereinafter “PBA") (collectively referred to as “the Parties”) as follow: 1. A unit member's personnel file shall be made available by the Town for inspection by a unit member within 3 business days (“Business days” are defined as Monday through Friday) of receipt of a written request, (a request may be submitted via e- mail) to the Chief of Police, or other official designated by the Town. 2. Upon request to the Chief of Police or other official designated by the Town, a unit member shall be provided, within 3 business days of a request being made, with copies of any documents maintained in the unit member's personnel file A unit member shall be made aware of any document that is to be placed in his/her personnel file and be afforded the opportunity to submit a rebuttal, provided that it is submitted within thirty (30) calendar days from receipt of the document. A copy of the rebuttal will be attached to the document being placed in the personnel file, and the unit member shall be provided with a copy of the document. 4, No pending investigations, complaints or disciplinary charges shall be considered or made part of a unit member's personnel or disciplinary file/records until and unless the unit member is adjudicated guilty pursuant to the collective bargaining agreement (CBA) or law, or a disciplinary settlement is reached. Nothing herein shall prevent the Town from including letters of counseling in a unit member's personnel file. 5. No exonerated or unfounded complaints shall be considered or made part of a unit member's personnel or disciplinary file. 6. When a FOIL request is received for a unit member's personnel/disciplinary records, a copy of the request will be provided to the Union President and unit member(s) if explicitly named in the FOIL request; within 3 business days of receipt. Delivery shall be by electronic mail or in-hand. 7. Copies of responses acknowledging receipt, providing a timeline for a response, and denying or granting a FOIL request shall be provided by electronic mail or in- hand delivery to the Union President; and unit member(s) if explicitly named in the FOIL request; at the same time the FOIL response is sent. 8. Ifthe Town has determined that records are going to be provided in response to the FOIL request, once the records are compiled, the Union President and unit member(s) named will be notified in writing, by electronic mail or in-hand delivery, and provided access to review (and copies, if requested) at least 14 calendar days prior to the planned release of the records. For purposes of this Paragraph, “records” Page | of 2 10. W 12. 13. 14, includes body camera footage. The Town's proposed redactions, if any, to the records to be provided shall be included. The Union President and unit member(s) named will be given the opportunity to submit written objections to the release of the records, redactions proposed, and/or redactions not included to a designated official The Town shall provide the Union President and the subject unit member(s) with a copy of its response with documents provided pursuant to the FOIL request at the time that itis sent to the recipient. The accompanying documents need not be sent if they have already been provided. Upon request, the Town will make the records which were provided to the FOIL recipient available to the Union President and subject unit member for inspection, Alleged procedural violations of this agreement will be subject to the grievance procedure in the CBA. However, what records get disclosed or do not get disclosed is not subject to the grievance procedure. All other provisions in the collective bargaining agreement regarding discipline and disciplinary records shall remain in full force and effect. The terms of this Agreement shall be attached to the parties’ current CBA and incorporated into the parties’ successor CBA. This Agreement is subject to Town Board approval.
