Rudrakumaran emerges
as Diaspora leader
The US-based Rudrakumaran
Viswanathan aka ‘Rudra’ has now
emerged as the leader of the Tamil dias-
pora with a section of the NGOs backing
his call for a referendum in Sri Lanka on
the lines of the recent UN led referendum
in Sudan. Following the arrest in Malaysia
and deportation to Colombo of LTTE
leader Velupillai Prabhakaran’s successor,
S. Pathmanathan aka ‘KP’ in early August
2009, various diaspora operatives had
been trying to take over the leadership of
the Tigers. ‘Rudra’ succeeded in overcom-
ing all opposition.
Authoritative sources told The Sunday Is-
land that ‘Rudra’ had bolstered his position
primarily through the setting up of
Transnational Government of Tamil Eelam
(TGTE), which won the recognition by
South Sudan, the newest country in the
UN system.
They said that some of the NGOs, which
had been supportive of the LTTE’s war,
had raised the possibility of the UN step-
ping in to force Sri Lanka to agree for a
Sudan type referendum to divide the coun-
try on ethnic lines.
Ambassador John Gooneratne, formerly of
the Sri Lanka Government Peace Secre-
tariat, said that ‘Rudra’ had referred to
Sudan even during negotiations the LTTE
had with the then Premier Ranil Wick-
remesinghe’s government in 2003.
Responding to several questions by The
Sunday Island, the retired career diplomat,
who had been involved in Wick-
remesinghe’s peace process said that su-
perficially one could see similarities with
Sudan in the pre-May 2009 Sri Lanka situ-
ation where the LTTE had control over
some parts of the North and Eastern
provinces.
"Then a minority national group in conflict
with the majority group, waging a war to
gain separate statehood. But, beyond that
ehd; nghpJ vd;W epidf;fhky; ehL nghpJ vd;W epid
the comparison does not stand because
the histories of the two conflicts are so dif-
ferent. But the LTTE always had their eyes
fixed on what they wanted in the GOSL-
LTTE negotiations that took place in 2002-
2003," he said.
"At the Hakone, Japan, meeting (2003)
one of the points discussed was a federal
constitutional structure for Sri Lanka. In
fact, the GOSL side gave a very "learned"
paper titled "Exploring a federal solution
based on internal self determination within
a united Sri Lanka," which outlined the
basic elements of a federal structure as
well as 16 principles which provided an
overarching framework for discussion.
Gooneratne also said: "Anton Balasing-
ham’s (read LTTE) response was that he
was not in a position to endorse an outline
of a federal structure at that juncture. He
stated that such an issue had to be dis-
cussed with the Political Affairs Committee

Intelligence sources said that ‘Rudra’ could
be planning long term strategy to exploit
the division of Sudan to force UN interven-
tion in Sri Lanka. The Sri Lankan govern-
ment is banking on ‘KP’ to woo the Tamil
Diaspora as part of an overall strategy to
undermine ‘Rudra’ , while seeking an un-
derstanding with the Tamil National Al-
liance (TNA), which could help President
Mahinda Rajapaksa to consolidate peace
won through military means.
They said that the government had as-
sured KP’s North-East Rehabilitation and
Development Organization (NERDO) its
fullest support to implement welfare pro
grammes in war devastated areas.
Those living abroad could now throw their
weight behind post-war recovery in North-
ern and Eastern Sri Lanka by getting in
touch with the NERDO without being de-
ceived by three or four diaspora groups
still promoted Prabhakaran’s macabre
Eelam project in spite of having lost their
military muscle, they said.
It is no secret that ‘KP’ had been deeply in-
volved in a desperate attempt with ‘Rudra’
to force Sri Lanka to halt the offensive on
the Vanni east front. While ‘KP’ had coop-
erated with the government following his
extradition to Colombo from Malaysia in
Aug. 2009, "Rudra’ had taken the upper
hand in the battle for control of the dias-
pora, it was pointed out.
The self-appointed Prime Minister of the
Transnational Government of Tamil Eelam
(TGTE), ‘Rudra’ had assured the diaspora
that his project would pave the way for
Eelam in spite of the LTTE losing its con-
ventional military power in May 2009.
‘Rudra’ had asserted that the TGTE could
create conditions necessary for foreign in-
tervention similar to that of UN managed
referendum in Sudan to pave the way for a
new country in Southern Sudan, the

‘Independent Tamil Eelam -
The Final Destination’
This piece by Usha S Sri-Skanda-Rajah
eminently serves as an inspiring message
for Eelam Tamils, one and all committed to
the Tamil cause. To those Tamils dejected
by the events of the last two years viewing
Mullivaykkal as a defeat for the Tamils; his-
torians teach that defeat in a battle(s) is
not a defeat in a war (for the Tamils and
the Tamil cause). Usha’s proven intellect is
bound to correct the defeatist message
that a few parley further damaging the
Tamil cause. Usha’s ‘Response to D B S
Jeyaraj’s pedestrian piece ‘Sri Lankan
Tamil Nationalism: Past, Present and Fu-
ture’ rebuts the hypocrisy of the logic that
D B S uses in his piece. Usha needs to be
applauded for her polite critique that de-
bunks this defeatist protagonist’s propa-
ganda for the Buddhist Sinhala
supremists.
Usha’s anti-dote to the Tamil cause spoil-
ers points to the South Sudan model that
earned the support of the enlightened sec-
tions of the international community to de-
liver a just and fair outcome for the long
oppressed South Sudanese. They suffered
‘a protracted period of deadly conflict’ last-
ing over 38 years (Thabo Mbeki). The op-
pression of the Eelam Tamils is more
gruesome and brutal but strangely except
for Indraji, Eelam Tamils were betrayed by
a section of the international community
led by the Rajiv/Sonia/Karuna Indian lead-

the queer approach of Delhi to the trauma
of the Eelam Tamils facing a brutal geno-
cide. Serious war crimes were committed
during this genocide that led to the enlight-
ened sections of the international commu-

for the massive massacres (over 40 000
civilians killed) and the internment of 320
000 Tamils behind barb wire fenced (Menik
Farm) camps.
The Tamil diaspora is duty bound to put
right much of the damage the relentless
propaganda of the murderous SL regime,
the Delhi South Block apologists and
most cruel of all the contribution of a few
roguish Eelam Tamils (the likes of DBS Je-

The recent landslide vote (97 per cent) for
a free and independent South Sudan
would end the several decades of pain of
the South Sudanese. This contribution of
the international community that redresses
the sufferings of the South Sudan victims
is a very laudable. The international com-
munity has yet to call for a similar referen-
dum in Tamil Eelam, a nation that is
equally or far more oppressed. Both South
Sudan and Tamil Eelam took up arms to
fight genocide oppression. To Usha the
South Sudan model for an independent
Tamil Eelam becomes a realistic redress in
the minds of most Tamils who experienced
the bitterest pain the Buddhist Sinhalas in-
flicted on them. ‘How ever long it takes,
how ever rough the ride, how ever rugged

the path, how ever steep the journey, how
ever distant the goal, how ever forlorn it
may seem, how ever many the sacrifices
already made, no matter the detractors,
no matter the cynics, no matter the pes-
simism - we should get there – we will get
there – like the Southern Sudanese -
Tamil Eelam being the final destination.
That’s how I see it; that’s how many
Tamils see it.’
Usha is at her best on the brutal genocide
that Colombo/Delhi unleashed on the
Eelam Tamils; ‘There is no question; those
who died in Sri Lanka in the long struggle
have made the ultimate sacrifice. The liv-
ing, those that are maimed and ill, those
displaced and rendered homeless, those
who have lost their loved ones, those that
are incarcerated without charge and being
tortured, those who have disappeared
without trace, those who have been sexu-
ally abused and or widowed and those that
are impoverished - have made and are
making untold sacrifices. So much blood
has been shed due to the war with
emerging evidence that the perpetra-
tors showed little regard for human
life’.
‘Was it worth it? That’s a question that is
most troubling for Tamils. A matter they
have debated with each other and in their
conscience and still are. So then should
Tamils give up the freedom struggle?
The resounding answer to that is “NO”, but
the means to get there has changed; not
the goal, neither the commitment nor dedi-
cation.
The guns have been silenced, yes, but the
cry for freedom of Tamil Eelam will
never be silenced. That’s how I see it;
that’s how many Tamils see it.
‘The quest..(for) an ‘Independent Tamil
Eelam” is the answer to secure our rights
in our homeland; to achieve self-determi-
nation for our people; to enjoy equality and
to realize all fundamental freedoms en-
shrined in the UN Declaration of Human
Rights; to attain ..I cannot think of any
other way. That’s how I see it. That’s
how many Tamils see it whether they‘re
passive or active; quiet or vocal. From
now it is clear the Tamils will pursue advo-
cacy and negotiation, invest in democracy
and diplomacy until the mission is accom-
plished. The Transnational Government of
Tamil Eelam (TGTE), the Global Tamil
Forum (GTF), Tamil Nationalist Groups
worldwide including Tamils individually
and collectively are quietly pursuing
this line; trying to create a political
space outside of Sri Lanka for dialogue
and diplomacy. An ‘Independent Tamil
Eelam’ seems the only option when fear

and intimidation, marginalization and
persecution, vandalism and violence
against Tamils and Muslims still prevail
in Sri Lanka and the demography and
even the electoral system in Sri Lanka
is being manipulated in favour of the
Sinhalese. A scathing report by the Mi-
nority Rights Group International (MRG)
19th January titled ‘No war, no peace: the
denial of minority rights and justice in Sri
Lanka’, highlighting the situation of Tamils
and Muslims in Sri Lanka two years after
war and of “rising Sinhala nationalism”,
should open the eyes of the interna-
tional community and those skeptics
who see independence as not an op-
tion. The report states “…minorities face
daily repression and marginalization..par-
ticularly in the country’s north and east,”
…The MRG in its website quotes Mark
Lattimer, its executive director: “Despite
the end of the war, many Tamil and
Muslim minorities in Sri Lanka continue
to live in fear,’. Usha highlights Bishop
Rayappu’s ‘…presentation to the Lessons
Learnt and Reconciliation Commission
(LLRC) drawing attention to the 146,679
people unaccounted for in Vanni,’

tablishing truth (about them; this can
be expected only from independent
genocide crimes tribunals) is a must to
achieve genuine reconciliation and a
political solution that reflects the reality
of the Tamil identity.
Usha ‘It’s encouraging that Southern
Sudan has shown its desire to recognize
and work with the TGTE, one of the vehi-
cle through which Tamils could take their
initiatives for independence forward. It is
heartening the Sudan Peoples' Liberation
Movement (SPLM) has invited the TGTE
to partake in the celebration.’ "The invita-
tion received by us is considered recogni-
tion not only of the TGTE but also of the
Eelam struggle. TGTE is calling on Eelam
Tamils to celebrate the freedom of South-
ern Sudanese people."It is hoped that
more and more countries including India
would be persuaded to work with the
TGTE and also the GTF and other Tamil
organizations towards an ‘Independent
Tamil Eelam’. (TamilCanadian: Jan 24,
2011).
The SPLA like the Eelam resistance
(LTTE) took to armed resistance in 1983 to
further their cause but were equally vilified
as terrorists/guerillas. Yet the international
community including the US from 1996
covertly supported the South Sudanese
armed struggle though by the way com-
plained about the resistance own human
rights abuses and factional killings. The
community acted vigorously enough

against the human rights abuses of the
Khartoum regime; reports of the US gov-
ernment and International Eminent Per-
sons (the Eminents also lent their voice for
the Tamil trauma) both in 2002 roundly
condemned the Khartoum regime's human
rights abuses as genocide; Colin Powell in
September 2004 also described the Darfur
(equivalent of SL’s Mullivaykkal) a geno-
cide in the UN; (the worst humanitarian cri-
sis of the 21st century); the cumulative
effect of these led Khartoum to agree to
limited autonomy for South Sudan in 2005
(not the toothless Provincial Councils
under Rajiv’s 1987 Indo-SL Accord) with
constitutional provisions for a referendum
on independence in 2011. International ini-
tiatives also produced UN’s warrant of ar-
rest on Omar al-Bashir in 2008 for the
Khartoum regime’s genocide. Neighbours
Uganda and Eritrea supported SPLA. US’s
MV Faina in 2008 with its cargo of T-72
tanks, antiaircraft guns and other heavy
equipment supposedly for Kenya actually
was destined for the SPLA.
To the envy of the Eelam Tamils, Delhi,
Tamil Eelam’s beloved neighbor did the
very opposite of all these not only in the
war front but also diplomatically to dis-
credit and bring about the defeat of the
Tamil armed resistance. South Sudan’s
road to freedom is god blessed; Delhi
was not its neighbor. ‘Delhi more

vaykkal massacres and Sri Lanka (SL) war

tively explain the queer policies of Delhi
causing more trauma to the Eelam Tamils
fighting a brutal Sinhala genocide. The UN
genocide crimes initiatives have not pro-
gressed much despite the efforts of the in-
ternational community. Undeterred SL
continues its genocide with a vengeance
when Delhi partnered SL in that genocide.
Delhi planted a South Block sectarian
(Nambiar) in the Ban’s office to carry its
anti-Tamil crusade in the UN. UN as part
of a US’s humanitarian initiative dis-
patched Nambiar to SL in the crucial week
of May 2009 to avert the massacres of the
entire militant leadership. US planned an
orderly evacuation of the militant leader-
ship entrapped into the narrow
Narayanan/Gothabhaya ‘fire free’ zone.
The cold blooded murder of the white flag
waving surrendering militants was directed
by the ‘in the loop’ UN-Nambiar/Delhi-
Narayanan/Colombo Gothabhaya Ra-
japakse committing a war crime.

VILIFYING GENUINE REFUGEES
The arrival of 492 Sri Lankan Tamil
refugees has triggered a predictable wave
of xenophobia, not the least of which has
come from our own Canadian politicians
and some Sri Lankans.
Certain federal politicians and government
officials have decided to exploit this phobia
of common people to gain votes and
cheap popularity with their sensational
quotes such as: “We won’t allow Canada
to become a place of refuge for violent
criminals”; “We will not support those who
want to create a two-tier immigration
system: one tier for law-abiding
immigrants who wait patiently in the
queue, and a second, for criminals and
terrorists who jump the queue.”
Let me address their first concern with
rhetorical questions. Isn’t this a preemptive
criminalization of 492 men, women and
children prior to their trials without giving
them any benefit of doubt?
Do you
really believe
that all are
violent criminals,
including the
children? Why not
allow the
immigration officials
to determine who are
genuine refugees,
instead of branding
them all as
criminals?
OUT OF THE LINE OF FIRE
As the federal government looks to toughen rules
on human smuggling and illegal migration, a family
who fled from Sri Lanka to Canada on a ship called
the MV Sun Sea puts a face on those behind the
figures. Their names have been changed to protect
their identities.
Thivia’s mother-in-law was killed while
steeping a cup of tea. She had climbed out
of their underground bunker when the sky
was quiet, sneaking into the kitchen above
to make a strong Sri Lankan brew.
There wasn’t much the family below could
do when they heard planes rumbling
above.
The bomb crashed through the roof. Thivia
found her mother-in-law lying in blood, not
yet dead, a hole in her side.
Stoic, unflinching, the young mother
shrugs.
Her mother-in-law was buried near the
paddy fields they farmed under the co-
conut trees that shaded her home and vil-
lage in the Vanni. There was no time to
cremate her according to Hindu traditions.
During the last five months of their 30-year
civil war, Sri Lankan government and se-
curity forces encouraged hundreds of
thousands of civilians to move into ever
smaller government-declared No Fire
Zones in the country’s north, then sub-
jected them to repeated and increasingly
intense artillery, mortar barrages and other
fire.
And it isn’t just the government who is ac-
cused of violating international humanitar-
ian law, says the International Crisis
Group.

The second concern shows a lack of
knowledge of our immigration and refugee
laws. Already, Canada has a two-pronged
system; check the Immigration and
Refugee Protection Act (IRPA) that
legislates the entrance of both immigrants
and refugees.
There is a clear distinction and
corresponding legal process for entering
Canada as an immigrant or as a refugee.
The queue for immigrants starts in their
home countries, but not for refugees. In
other words, there is absolutely no queue
jumping by these boat people.
Should we punish them for illegal entry
(entering without proper documents, such
as entry visas) in to our country?
The resolution put forward during the 1951
Refugee Convention, whose signatories
include Canada, clearly stipulates that
asylum seekers cannot be penalized for
north of the island country, were responsi-
ble for killing, wounding or endangering
civilians, by shooting them and preventing
them from leaving the conflict zone even
when injured and dying.
The International Crisis Group believes
that tens of thousands of non-combatant
Tamil men, women, children and the eld-
erly were killed in the final five months of
the war – from January to May 2009.
The United Nations is more conservative
with their estimates and figures the conflict
had killed between 80,000-100,000 people
since it erupted into a full-scale civil war in
1983 – including unofficial and unverified
tallies showing 7,000 civilian deaths since
January 2009.

How on earth can you expect a
prospective refugee, who is fleeing from
his or her country to save his or her life
and family’s, to apply for a visa in his or
her country of persecution?
According to United Nations report‚
Asylum Levels & Trends in Industrialized
Countries for 2009, here are the top six
populations of origin of asylum applicants
to Canada: Mexico, 7,561; Hungary, 2,518;
Columbia, 2,292; Czech. Rep, 2,016;
China, 1,484; Haiti, 1,134.
Sri Lanka did not come in the top six
countries. Total of asylum seekers of Sri
Lankan origin for 2009 to Canada is 825.
This number includes those who came by
the boat.
Are we picking on these Sri Lankan Tamils
just because they traveled to Canada by a
decrepit cargo ship and took three months

family did not feel safe. As a Tamil, he ad-
mits, he was protected when the Tigers

Thivia and their two children arrived in
Bangkok in October 2009 carrying all the
gold jewelry she owned - her wedding ring,
family heirlooms, keepsakes from child-
hood. She never told her mother she was
leaving.
Kapilan joined her a 18 days later, after
bribing officials at the airport in Columbo
who pulled him aside before he could
board the plane with his family.
In Thailand, where they spent six months
on a tourist visa, the family sold their gold
for passage on MV Sun Sea – four places
for $15,000, a sum collected thanks to the
high price of gold.
“I wanted to be safe,” he says, through a
translator.
“I wanted freedom.”
The rusty 59-metre 767 ton cargo ship
took three months to reach Victoria.
The Sun Sea was well-stocked, captained
by a man the passengers had nominated
to guide the ship. The man had worked as
a second-mate on an Eritrean cargo ship,

to arrive, with a loss of one human life and
not by a luxury cruise ship from Mexico in
seven days?
Please compare and contrast Mexico and
Sri Lanka with respect to human rights
violations before you vilify Tamil refugees
from Sri Lanka. Did you folks ever wonder
why there are no boatloads of Tamils from
India or Singapore?
India has a much larger population of
Tamils who live with no fear of
persecution. I am still not convinced that
Sri Lanka’s president himself ordered the
army to commit human genocide, ethnic
cleansing, and murders of Tamils, who
surrendered holding white flags.
Last year, I had an opportunity to interview
some of the Tamil refugees who came on
Ocean Lady. I asked them‚ “Why did you
choose Canada as your destination? What
made you to undertake such a tedious,
torturous and risky travel by boat to
Canada?”
The answer given by a father was, “I want
to live in a country where my sons won’t to
be torched alive and my daughters won’t
be gang raped only because they belong
to a minority race.”
Can you name any country better than
Canada that can pride itself on being a
land of immigrants, refugees and
committed to humanitarian values?
Let us come together as fellow human
beings to help this unfortunate group of
fleeing people in their endeavor to find a
country where basic human rights are
respected.

Kapilan calls him “a hero.”
Their daily ration on the ship included a
litre of drinking water, dried fish and rice
for lunch and porridge for dinner.
When the sea was calm, Thivia and the
children would stroll the decks. Everyone
would move below deck when the skies
turned grey and waves whipped around
them. Passengers were often sea-sick.
Below deck, Thivia kept track of the days.
She figured the ship must be close to
Canada when rations began to run low.
On Aug. 12, the MV Sun Sea was inter-
cepted by the Canadian Navy.
Thivia says everyone ran to the deck and
cheered when they saw the Maple Leaf.
The ship was escorted into CFB Esquimalt
the next morning, a total of 492 people on
board.
All have claimed refugee status.
To date, 307 of the MV Sun Sea passen-
gers have been released, including Thivia
and Kapilan, who each spent time in
provincial prisons while the Canadian Bor-
der Services Agency tried to determine
their identities and whether they were
human smugglers or former Tamil Tiger
rebels.

Of 136 who remain detained, 124 are men
who are housed in Fraser Regional Correc-
tional Centre and 12 are women who are
being held inside the Alouette Correctional
Centre for Women, two prisons in Maple
Ridge.
“The CBSA continues to exercise due dili-
gence in the screening of all irregular mi-
grants for both security and criminal threats,”
said spokesperson Shakila Manzoor.
“The CBSA is committed to working with its
partners to maintain the integrity of Canada’s
immigration system and will exercise due
diligence in processing these individuals ac-
cording to Canadian law. The safety and se-
curity of Canadians remains the CBSA’s
priority.”
Thus far, 15 of the men have been referred
to the Immigration and Refugee Board for
admissibility hearings
Melissa Anderson, a spokesperson for the
refugee board, said 14 of the 15 men are ac-
cused of being a member of a terrorist or-
ganization.
The border agency also alleges two of the
14 took part in human smuggling, while an-
other is being accused of war crimes.

The arrival of the MV Sun Sea and an earlier
ship in 2009 that also carried Tamils trig-
gered a sharp response from the federal
government, which promised to crack down
on human smuggling and illegal migration.
As a result, last fall the Conservative govern-
ment introduced Bill C-49 to toughen rules.

Those include mandatory jail terms for those
involved in human smuggling, detention for
up to year while their status is being deter-
mined and making those who arrive by a
smuggling operation wait five years before
they can apply for permanent residency in
Canada.
Rick Dykstra, who spoke in Maple Ridge
earlier this month, the government has sev-
eral reasons for the bill: to provide fairness
to people waiting in camps around the world
who’ve already been declared refugees; and
to prevent more boats from arriving in
Canada.
“We felt it was challenging the integrity of our
immigration process, so we had to respond
to that,” added Dykstra, parliamentary secre-
tary to Citizenship Minister Jason Kenney.
“We need to take a look at the whole immi-
gration system and perhaps put a morato-
rium on some of the groups that are using
the system.”
The Conservatives need 143 votes to pass
the bill, which has only had first reading.
Opposition parties are not eager to give it
support.
The Liberals maintain that the mandatory de-
tention provisions violate Sections 9 and 10
of the Charter of Rights and Freedoms and
Article 31 of the Convention Relating to the
Status of Refugees. They also say a five-
year refugee probationary period, denial of
family reunification and of travel documents
also likely violate both the Geneva Conven-
tion and the International Covenant on Civil
and Political Rights.

The Sri Lankan government says peace now
prevails across the country and cites the re-
turn of refugees from India to Sri Lanka, as
well as the return of many who were housed
in displacement camps as evidence of a war
that has ended.
As of July, the United Nations High Commis-
sioner for Refugees no longer considers
Tamils as “presumptively eligible” for refugee
protection.
“We do not accept that there is validity in
their claims,” says Chitranganee Wagiswara,
the Ottawa-based high commissioner for Sri
Lanka.
“The Tamil Tigers were defeated in May
2009. Since then, there is total peace in the
country. There hasn’t been a single bomb
going off or shooting.”
While there may be no bombs dropping or
artillery barrages, Tamils claim that system-
atic discrimination, intimidation and disap-
pearances are still a reality in the north.
The Sri Lankan government, dominated by
the country’s Sinhalese majority, has dis-
missed such claims and points to the cre-
ation of a “Commission on Lessons Learned
and Reconciliation” as a tool that’s sparking
healing.
Wagiswara stresses that “systematic disap-
pearances” don’t happen in Sri Lanka.
“Some of these facts are exaggerated,” she
says.
Last year, the United Nations appointed a
panel to investigate abuses on both sides
of the conflict in Sri Lanka, but it has
been prevented from entering the coun-

Wagiswara explains the panel is free to
make presentations to the government-ap-
pointed commission, but it will not be al-
lowed to interview civilians, combatants or
investigate allegations of war crimes.
“We do not want them to visit Sri Lanka be-
cause we thinks it’s unnecessary,” says
Wagiswara.
“It has been hearing witnesses for near a
year now. It’s a domestic issue. We would
consider [a United Nations investigation] as
interference in a sovereign country.”
The Sri Lankan government points out an in-
crease in tourists from the south visiting the
north as a sign that ethic tensions are mend-
ing.
“The government is helping them,” Wag-
iswara added. “It’s starting with people to
people contact.”
For Sam Nalliah, who left his home more
than 30 years ago and has never returned,
the government’s efforts ring shallow.
Although he left to study in England and
Canada well before the civil war started, his
work with the Canadian Tamil Congress has
brought him in contact with women with tales
of rapes and men scarred by torture.
“Nothing will change until the government re-
alizes we are all equal,” Nalliah says.
“Winning a war and enslaving a race is easy,
but winning the trust and hearts of enslaved
will be challenging. I hope the current presi-
dent of Sri Lanka will build a genuine bridge
with Tamils and restore a lasting peace and
tranquility to the war-torn country.”

SRI LANKA: THE ROAD TO PEACE
REQUIRES WESTERN COURAGE

Buried deep and largely unnoticed in the
trove of diplomatic cables released by
WikiLeaks last December was an
extraordinary note detailing the Sri Lankan
government's alleged support of
paramilitary groups involved in killing,
abducting and raping Tamil civilians and in
forcibly conscripting child soldiers.
The message sent home by then-U.S.
Ambassador Robert O. Blake Jr. -- who is
now Assistant Secretary of State for South
and Central Asian Affairs -- was all the
more stunning for the revelation it included
at the end: the political officer of the
embassy, Blake wrote, had listened to a
recording in which Defense Secretary
Gothabaya Rajapaksa, the brother of
President Mahinda Rajapaksa, "was
effusive in his praise" for the most ruthless
paramilitary group and the "benefits" it
provided the government.
The cable helps explain why today, almost
two years after the brutal end of Sri
Lanka's 26 year war, so little progress has
been made toward reconciliation.
Culpability strikes too close to home, and
the government clearly doesn't want a
thorough, independent investigation that
will hold people accountable -- an
essential step for a durable peace. As
TAMILS’ LANDS IN HSZ IN JAFFNA BEING SOLD
TO SINHALA BUSINESSMEN
As part of deep rooted conspiracy to es-
tablish a Sinhala colonization and to mar
the Tamil demography, a big chunk of
lands inside the so-called High Security
Zones and other places in Jaffna penin-
sula have been sold to Sinhala business-
men.
General Tamil people who have been
driven away from their own lands in HSZ
are not being permitted to return to their
homes for resettling citing the reason of
landmines, but through a clandestine
process these lands have been sold to
these businessmen apparently to establish
an industrial zone there.
Sources said recently about 100 acres of
land near Ezhuthumadduvaal railway sta-
tion along the A9 Highway has been sold
to a prominent Sinhala businessman while
another Sinhalese making efforts to buy a
big land, measuring 80 acres, located be-
tween Kilaali and Puloappazhai.
The Sinhala businessman is saying that
he will establish an industrial estate on the
100 acres of land but everybody knows in
the peninsula that it is an eye-wash. Ulti-
mately Sinhala families will be settled.

Intelligence sources said that Rudraku-
maran had earned the wrath of some of
his former colleagues for seeking to exploit
his links with those in control of Southern
Sudan (Sudanese Peoples Liberation
Movement) for his advantage. They ac-
knowledged that ‘Rudra’s’contribution to
the LTTE could be second only to ‘KP’,
though various others were now trying to
re-assert themselves.
‘Rudra’ had represented the LTTE at
Thimpu way back in 1985. The LTTE high

Butenis wrote in a January 2010 cable:
"There are no examples of a sitting regime
undertaking wholesale investigations of its
own troops or senior officials for war
crimes. In Sri Lanka this is further
complicated by the fact that responsibility
for many of the alleged crimes rests with
the country's senior civilian and military
leadership, including President Rajapaksa
and his brothers."
Ignoring this unambiguous indictment, the
United States and other countries continue
deluding themselves with the claim that
the "Lessons Learnt and Reconciliation
Commission" Rajapaksa empanelled to
investigate the war needs more time to
finish its work -- despite nine previous
commissions in Sri Lanka that never held
anyone accountable. This diplomatic
cowardice is providing the cover and the
time for a massive government program to
build new military bases and colonize the
Tamil homeland in the north and east of
the island with Sinhalese -- a phenomenon
graphically chronicled in a recent New
Yorker magazine article. The longer this
campaign continues, the more difficult it
will be to ever reconcile the island's deeply
divided population.
Meanwhile, Rajapaksa is rapidly creating
an imperial presidency, appointing family
to resettle in the northern part of Ezhtuhu-
madduvaal after declaring the area land-
mine-free. But again they were driven
away from there claiming that still land-
mines exist there and a promise was
made to them that they would be allowed
to resettle within a month.
But during one-month time, the process,
initiated by Sri Lanka Army, of selling 100
acres of land owned by a Tamil to the Sin-
hala businessman was completed.
After the purchase of the land, the Sri
Lankan military now declares that land-
mines have been removed from the 100
acres of land.
The Sinhala businessman has announced
that he would start a mega industrial es-
tate there. But all expect a Sinhala coloni-
sation.
Sri Lanka military is playing the main role
behind this conspiracy. They are forcing
Tamils to sell their lands to Sinhala busi-
nessmen, local people alleged, adding,
many SL military officials are also inter-
ested in buying lands in the areas men-
tioned above.

Sources said that ‘Rudra’ credentials
seemed impressive with leading role in for-
mulating the Interim Self Governing Au-
thority (ISGA) in 2003. His father had been
a one-time Mayor of Jaffna representing
the TULF.
‘KP’ and ‘Rudra’ were fighting for su-
premacy with Norway-based Nediyavan’s
Tamil Eelam Peoples’ Assembly making a
strong bid to enhance its position. A recent
statement attributed to Norwegian Minister
Erik Solheim that Oslo could be Sri
Lanka’s dialogue partner with the diaspora

members to key posts (one newspaper on
the island tallied almost 100 government
departments controlled by the Rajapaksa
brothers), stifling a free press, jailing his
main political opponent and abolishing
term limits. The push to consolidate power
is occurring alongside a willful inattention
to the underlying causes of the war -- the
marginalization of Tamils by the ruling
Sinhalese.
In the aftermath of the war, this problem is
clearly illustrated by the government's
refusal to engage in power sharing with
Tamils, grant greater local governance to
Tamil communities, include Tamils in
redevelopment plans or provide Tamils
with equal access to government aid and
services. The Tamil areas being
repopulated with Sinhalese are
experiencing a development boom --
particularly hotel construction along the
island's pristine beachfronts that is ruining
the livelihoods of local fishermen. But
many other Tamil communities that were
destroyed and displaced by decades of
warfare desperately need new schools,
houses, hospitals, churches and temples,
ports and roads.
The problems in Sri Lanka have been
festering for years. What's needed is the
courage and conviction to solve them.
Western and democratic powers should

alternative route to Jaffna and in condi-
tions of peacetime with a gradualreturn to
normality, the issue of the High Security
Zones and a bloated military presence in
the Peninsula and northern Vanni should
be reviewed. The map below is from my
files and is probably dated and overblown.

ing battle among various LTTE factions,
the sources explained.
Other contenders for LTTE leadership in-
clude the Global Tamil Front based in UK
under Father S.J.Emmunuel living in
Rosendhal, Germany. Emmanuel, 77, had
been a former Vicar General of the Jaffna
Catholic Diocese.
Rudra’s technique, at the time he was the
International Legal Advisor and in charge
of International & Diplomatic affairs of the
LTTE prior to the TGTE, was to equate
Kosovo and East Timor situations to Sri
Lanka. This was a healthy tonic to a de-

back the confidence of the Sri Lanka
people with serious redevelopment aid
that can give well-meaning foreigners
leverage over the government.
International NGOs need to find their
critical voices and stop hiding behind the
fear that they'll be kicked out for speaking
the truth. Businesses need to "know their
client" and insist that their investments
benefit all of the island's people equally,
and do not empower a discriminatory
regime. And the international press needs
to recognize the hazards that their Sri
Lankan colleagues live and work under,
and travel to the island to report about
what's happening there.
Everybody can be part of the solution in
Sri Lanka. But first, while there's still time
to heal the wounds, everybody needs to
stop finding excuses for doing nothing. As
recent events in the Middle East show,
that's a poor substitute for a real policy.

show his intimacy at encounters with Tamil
intellectuals.

Rights advocates decry detention of
refugee claimants from MV Sun Sea
The Canadian Council for Refugees,
Amnesty International Canada, the Cana-
dian Tamil Congress and the International
Civil Liberties Monitoring Group ex-
pressed their dismay today at the govern-
ment’s aggressive efforts to keep the
passengers of the MV Sun Sea in deten-
tion. As a result, men, women and chil-
dren seeking Canada’s protection have
spent months deprived of their freedom, at
significant cost to the taxpayer.
“Liberty is a fundamental right,” said Glo-
ria Nafziger of Amnesty International. “It
can only be restricted only when ab-
solutely necessary and for as short a pe-
riod of time as possible. Any such
restrictions should be in keeping with clear
legal standards. And everything possible
should be done to avoid locking up chil-
dren. The government's approach to the
detention of the Sun Sea passengers runs
counter to these fundamental human
rights principles.”

Sri Lanka: Over 1.2 million affected as rains return to battered East
Heavy rains have lashed the North Central
and Eastern provinces of Sri Lanka for a
second time in two weeks, affecting over

on arrival in Canada, and those that are
detained are usually released within a
matter of days or weeks. In the case of
the MV Sun Sea passengers, however,
the government has been demanding
more proofs of identity than usual, invest-
ing significant energy and resources in a
search for adverse information about the
passengers, advancing weak arguments
for inadmissibility based on tenuous al-
leged connections with the LTTE, vigor-
ously opposing release by the Immigration
and Refugee Board, and contesting or-
ders of release in the Federal Court, even
in cases involving children.
“We need to be fair in how we treat people
fleeing persecution,” said Wanda Ya-
mamoto, CCR President. “Whether they
arrive by land, air or sea, they should be
treated the same – singling out these
claimants for special harsh treatment
looks like discrimination.”

noted that the government was holding the
issue of identity to a higher standard than
usual: normally, the government would
consent to release once the National Iden-

children affected: “Five young children are
currently being detained and incarcerated
with their mothers. They have already
gone through a gruelling journey, which
could leave them with severe emotional

Supplementary estimates[1] tabled in Par-
liament Tuesday reveal the huge cost of
the government’s chosen response to the
MV Sun Sea arrivals. The Canada Border
Services Agency expenses for the MV
Sun Sea, which include the direct deten-
tion costs, come to over $22 million. The
costs for the Immigration and Refugee
Board, largely for the detention reviews,
come to $900,000.
These costs would be dramatically lower if
the MV Sun Sea passengers had been
treated by the government the same as
other refugee claimants, and released as
soon as their identity was reasonably es-
tablished.
As high as the current costs are, they
would be even higher under the govern-
ment’s anti-smuggling bill, Bill C-49, since
it imposes mandatory one-year detention
for designated arrivals.

* A journalist who worked in the LTTE
controlled part of Sri Lanka was ordered
released by the Immigration and Refugee
Board. The UNHCR identifies journalists
as a group at risk of persecution in Sri
Lanka.[2] Although the journalist said he
is not a member of the LTTE, that his
paper is not an LTTE paper and spoke
against the LTTE, the government is argu-
ing that he is an LTTE member. The Immi-

crimes tribunals will be able to find truthful
answers.

administration is bound to tarnish the good
intentioned President Obama’s approach

tion program reveals that costs have
been rising, there is a lack of consis-
tency and there is inadequate consid-
eration of alternatives to detention.[2]

theless, the government contested the
Board’s order of release to the Federal
Court. The Immigration and Refugee
Board had ordered the journalist released
on November 1, 2010. The Federal Court
confirmed heard the release order on 26
January 2011, rejecting all of the govern-
ment’s arguments. Because of the gov-
ernment’s aggressive efforts to prevent his
release, the journalist spent three extra
months in detention, after he had been
granted his liberty.[3]

ship. Only an authentic Indraji progeny
emerging will be good for Tamil Eelam,
