So too the work of a prosecutor must go on. To truly answer tic call to service to keep our communities safe and to be a strong voice for crime victims, the prosecutor's advocacy must continue at every step the laudable goal of justice might be threatened. Here, that threat comes from the deliberate subversion of constitutional and statutory obligations by the Pardon and Parole Board. One need look no further than the headlines of the daily news to see the consequences of the Board’s failure to adhere to legal mandates. By now, everyone is familiar with Lawrence Anderson, an inmate whose sentence was commuted by the Governor after favorable recommendation by the Pardon and Parole Board. Yet within mete weeks of his release from prison, Anderson comunitted a shockingly gruesome triple murder — all to which he has confessed. Anderson admitted he killed his neighbor and cut out her heart before cooking it to serve to his aunt and uncle with whom ho was living. Anderson then killed his uncle, stabbed his aunt in both of her eyes, and killed the couple’s four year old granddaughter. At the time of Anderson’s arrest, Grady County District Attorney Jason Hicks voiced frustration with the methodology by which the Pardon and Parole Board gaye notice to prosecutors that Anderson was being considered for commutation, Ex. 1, News Report, The Board’s failure to follow the law with regard to Anderson’s commutation has now led the Governor to cal! for an investigation into the matter by the Oklahoma State Bureau of Investigation. Ex. 2, Newspaper Article. Unfortunately, Anderson’s case does not appear to be an isolated instance of procedural irregularity by the Pardon and Parole Board. Despite statutory requirements that the Pardon and Parole Board provide to the District Attorney a copy of an application for commutation within ten business days of its receipt, the Board has failed to provide to Plaintiff any such applications. Nor-has the Board provided to the District Attorney adequate and appropriate notice of applications for commutation at the time the same are first considered for relief by the Board. Such blatant disregard for statutory mandates reflects not only a deliberate course of action by Defendant Board, but also impedes the 2 District Attorney from carrying out his duty to serve as a victim’s advocate and to see that Justice is carried out, Unequivocally, the Pardon and Parole Board’s failure to comply with their obligation to give notice to affected persons has proven to have deadly consequences. But even more shocking than the danger caused by the Board’s actions are the nefarious ‘motivations behind the decisions they make — the personal finaacial gain to be received by two Board members themselves. Kelly Doyle was appointed to the Pardon and Parole Board by Governor Stitt on February 26, 2019. That same day, the Governor appointed Adam Luck to be a member as well. Ms, Doyle is the Deputy Executive Director at the Center for Employment Opportunities, an organization thal provides transitional employment opportunities and other services to persons being released from prison. Similarly, Mr, Luck is the Chief Executive Officer of City Care, a non-profit organization which, according to its website “inspires those willing to look social injustice and extreme poverty in the face and empowers them to do whatever it takes to create change.” Ex, 3, Website. City Care not aly solicits “activists” to perform volunteer work but also provides services to “judicially involved” persons, Shortly after their appointment, a change in law resulted in the Pardon and Parole Board considering what one news outlet referred to as a “historic” number of sentence commetations that ultimately resulted in neatly 500 inmates being released from prison in November 2019, Ex. 4, News Report. A week before the Pardon and Parole Board was even scheduled to begin hearing the commutation requests on November 1, » 2019, Mr. Luck 3 Publicly proclaimed, “Next Friday Oldahoma will conduct the largest single-day commutation in US history. We'll be releasing over 400 individuals from, Oklahoma prisons who are there for crimes that no longer catry prison sentences after the passage of state question 780.” Ex, 5, Twitter Post 10/24/19. In what smacks of self-dealing and Open Meeting Act violations, he continued, “The legislature made the law retroactive with HB 1269. The pardon and parole board worked with suate agencies, nonprofits, and service providers from across the state to ensure these individuals have the resources they need as they transition back into our communities.” Bx. 5, Twitter Post 10/24/19. By no mere coincidence those nonprofit and service organizations included the Center for Employment Opportunities, Ex. 4, News Report. District Attomoys across the State have sought recusal of Ms. Doyle and Mr. Lick based upon the conflict of interest created by their employment that directly beselits from their actions as members of the Pardon and Parole Board. Even more recently, Mr. Luck hhas_been requested to recuse for personally promoting the work of other high profile activists seeking a sentence commutation in a case currently under review by the Pardon and Parole Board, Bx. 6,Rocusal Request, Yet, despite the efforts of prosecutors to ensure the Pardon and Parole Board conducts its affairs impartially as mandated by the Oklahoma ‘Constitution, the Board has turned a blind eye to all concepts of fairness and. justice, ‘ Ttswould not be th first timo the Pardon and Parole Board skirted its obligations fo give appropriate public notice of its actions tothe desriment of crime victims and those who advocate for them. See Oklahoma Parole Board Members Charged with" Misdemeanors, (March 13, 2013, 5:39pm), _ttps:/www newson6 cometary {Sede ]$9e00960774635284P/lethoma-parole-boand-members-charged-with-misdemeanors 4 To protect the sanctity of the criminal process and to guarantee appropriate due process snd fundamental fairness to the victims and those who advocate for them, the District Attorney now seeks injunctive relief barring Defendant Pardon and Parole Board from considering any request for commutation until such time as. statutory notice mandates are followed, barring Defendant Pardon and Parole Board members from ‘voting on any roquest for parole and/or commutation for which they have-a conflict of interest or the appearance:of bias, and further barting Defendant Stitt from granting any recommendation for parole and/or commutation that has been tainted by these improprieties of the Pardon and Parole Board and its members, JURISDICTION L This Court has jurisdiction to consider and grant Plaintifi’s request for declaratory end injunctive relief pursuant to Title 12, Section 138 et seg. and Section 1651 et seq. PARTIES AND VENUE ~ 2. Plaintiff David W. Prater is the duly elected and acting District Attorney for the Seventh Prosecutorial District of Oklahoma County. Plaintiff's principle place of business is in Oklahoma County. 3 Defendant Oklahoma Pardon and Parole Board is a body created by Article VI, Section, 10 of the Oklahoma Constitution and charged with the duty “to make an impartial investigation and study of applicants for commutations, pardons or paroles...” Okla, Const. art. VI, § 10. Defendant's principle place of business is Oklahoma. County. 4. Defendant Kevin Stitt is the duly elected and acting Governor of the State of Oklahoma and is named in ais official capacity, Upon a favorable recommendation by Defendant Board, Defendant Stitt is empowered by Article VI, Section 10 of the Oklahoma Constitution to commute the sentence of any offender. Okla, Const, art. VIL § 10, Defendant's principle place of business is in Oklahoma County. STATEMENT OF THE FACTS 5, . Defendant Pardon and Parole Board is made of ‘up five members, Kelly Doyle was appointed to serve as a member of the Board by Defendant Stitt on or about February 26, 2019. Adan Luck was appointed to serve as a member of the Board by Defendant Stitt on or about February 26, 2019, 6 Board member Kelly Doyle is the Deputy Executive Director at the Center for Employment Opportunities, an organization that provides services to persons released" from incarceration. By virtue of her employment, Ms, Doyle has a direct, material financial interest in cases of parole and commutation under her consideration as a Board member. 2. Board member Adam Luck is-the Chief Executive Officer of City Care, a nob-profit organization that provides services to persons released from incarceration, By virtue of his employment, Mr. Luck has a direct, material financial interest in cases of parole and commutation under his consideration as a Board member. 8. Defendant Pardon and Parole Board may only consider an inmate for commutation of sentence upon receipt of an application requesting commutation. 57 O.S.Supp. 2019, § 332.2. 9. Defendant Pardon and Parole Boerd considers requests for commutation ia a two-stage process. Olda.Admin.Code § 515:15-11-1. 10, During the first stage of the review process, referred to as “Initial Review” Defendant Board reviews only the inmate's application for commutation. If'a majotity of Defendant Board members vote to give further consideration to the application, the matter is passed to “Stage Two.” Olkla. Admin.Code § 515:15-L1-1. 11.1 During “Stage Two,” Defendant Board considers the application, an investigation conducted by Board employees, and allows personal appearances by the inmate, the inmate’s delegates, the victim or their representative, and “trial officials” to include the'District Attorney. Okla:Admin.Code § 545:15-11-3 — 15-11-5. 12. Ifa majority of Defendant Board vote to recommend an inmate be granted a commutation, the application is forwarded fo Defendant Stitt for consideration, Okla. Const. art. VI, § 10; Okla.Admin.Code § 515:15-11-1. 13, |. By electronic. mail dated February 22, 2021, Defendant Board notified Plaintiff of a number of commutation requesis to be considered for “Initial Review’ beginning March 8, 2021. Ex. 7, Hmail. Attached to the electronic mail is a spreadsheet listing 474 inmates to be considered for commutation. Ex. 8, Spreadsheet. ‘The spreadsheet alone does not provide adequate notice of an inmate's application for comnuutation as is required by Section 332.2 of Title $7 and deprives Plaintiff of « meaningful opportunity to make a decision on whether to make objection to an inmate’s commutation application, 14. The electronic mail dated February 22, 2021, does not comply with the requirement of Section 332.2 of Title 57 that Defendant Board send to Plaintiff any 7 application for commutation and be given “twenty (20) business days to provide a written recommendation or protest prior to consideration of the application.” 57 0.8.Supp.2019, § 332.2 (C). 15, Among the commutation roquests to be considered by Defendant Board during the March 2021 Commutation Docket are inmates convicted of egregious and/or violent crimes including: Murder in the First Degree, Robbery, Kidnapping, Rape, Child ‘Abuse, and Trafficking in Iegal Drugs. Ex. 8, Spreadsheet, 16. Prior to the electronic mail notification received on February 22, 2021, Plaintiff did not receive from Defendant Board copies of the applications for commutation withia ten (10) business days of Defendant Board’s receipt thercof as required by Section 332.208) of Title $7. (7. On February 12,2021, applications for commutation to be considered by Defendant Board for “Initial Review” beginning March 8, 2021, were included in the otlline database, Ex. 9, Directory. 18... The applications for commutation to be considered by Defendant Board for Jnitial Review during March 2021, are not segregated by county and appear only-in alphabetical order by inmate name. Ex. 10, Subditectory List. 19. , Bach application for commutation is a minimum of eight (8) pages in length and is made‘on a form created by Defendant Board. Okla.Admin.Code § $15:15-11-1, The form application includes information that is otherwise unavailable to Plaintiff from other sources including an inmate's account of their offense and the grounds they believe warrant sentence commutation. Often inmates include evidence of their accomplishments while 8 incarcerated as well. Tn addition, the form requires an inmate to attest to the accuracy of ‘the statements made in the epplication under adverse penalty. Ex. 11, Form Application for Commutation, 20. A total of 474 applications for commutation were set for “Tnitial Review” for March 2021, Of the 474 applications for inmates set for “Initial Review” for March 2021, 114 are applications of inmates convicted in Oklahoma County, which total over 1,500 pages. 21, By undated letter postmarked February 12, 2021, Defendant Pardon and Parole Board notified Plaintiff of a number of commutation requests that had been reviewed as part of “Initial Review” by the Board during the January 2021 Commutation Docket. ‘The letter purports to comply with the notice requirements imposed upon Defendant Board by Section 332,2(C) of Title 57. Attached to the letter is a spreadsheet of cases considered and Defendant Board’s determinations as part of the “Initial Review” as to each inmate for the January 2021 Commutation Docket. Ex. 12, Letter 2/12/21. 22. ; The undated letter postmarked February 12, 2021, purports to advise Plaintiff of his right to object to the consideration of any inmate for commutation at the April 2021 meeting of Defendant Board and states that, “If a written protest or recommendation is not received by April 64, it will be presumed you have no position on the offender's commutation application,” Ex. 12, Letter 2/12/21. 23. . Among the commutation requests purportedly considered by Defendant Board during the January 2021 Commutation Docket are inmates convicted of egregious and/or violent crimes including: Murder in the First Degree, Robbery, Kidnapping, Rape, Child Abuse, and Trafficking in Megel Drags. Ex, 12, Letter 2/12/21. 24, Prior to the undated letier postmarked Febreary 12, 2021, Plaintiff did not receive from Defendant Board copies of the applications for commutation within ten (10) business days of Defendant Board’s receipt thereof as required by Section 332.2(B) of Title 57. 25. The spreadsheet of cases attached to the undated letter postmarked February 12, 2021, lists a total of 241 inmates and does not identify the county of conviction for each inmate considered by Defendant Board for the January 2021 Commutation Docket; thus, the letter and attached spreadshest provides no adequate notice to Plaintiff of inmates being considered for commutation. Ex. 12, Letter 2/12/21. 26, The undated letter postinarked February 12, 2021, purports to advise that access to an inmate's application for commutation may be accéssed by online database, Ex, 12, Letter 2/12/21. The database, however, does not contain applications considered by Defendant Board for the January 2021 Commutation Docket. Ex. 9, Directory. Thus, the databese does not provide adequate notice to Plaintiff of inmates being considered for commutation and deprives Plaintiff of a meaningful opportunity to make a decision on whether to make objection to an inmate's commutation application, 2 By undated letter postmarked February 26, 2021, Defendant Pardon and Parole Board again notified Plaintiff of a number of commutation requests that had been reviewed by the Board during the January 2021 Commutation Docket, ‘The letter purports to comply with the notice requirements imposed upon Defendant Board by Section 10 332.2(C) of Title 57, Attached to the letter is a spreadsheet of cases considered and Defendant Board’s determinations as part of the “Initial Review” as to each inmate for the January 2021 Commutation Docket, Ex. 13, Letter 2/26/21. 28. ‘The undated letter postmarked February 26, 2021, purports to advise Plaintizt of his right to object to the consideration of any inmate for commutation at the April 2021 meeting of Defendant Board and states that “If a written protest or recommendation is not received by April 6M, it will be presumed you have no position on the offender's commutation application.” Ex, 13, Letter 2/26/21. 29, . Among the commutation requests purportedly considered by Defendant Board during the Jaquary 2021 Commutation Docket are inmates convicted of egregious and/or violent crimes including: Murder in the First Degree, Robbery, Kidnapping, Rape, Child Abuse, end Trafficking in Megal Drugs. Ex. 13, Letter 2/26/21. 30, . The spreadsheet of cases attached to the undated letter postmarked February 12, 2021, lists a total of 241 inmates out of which 64 have been convicted in Oklahoma County. Ex. 13, Letter 2/26/21. The spreadsheet alone does not provide adequate notice of an inmate’s application for commutation as is required by Section 332.2 of Title 57 and deprives Plaintiff of a meaningful opportunity to make a decision on whether to make objection to an inmate’s commutation application. 31. ‘The undated letter postmarked February 26, 2021, purports to advise that access to an inmate's application for commutation may be accessed by online database. Ex. 13, Letter 2/26/21, The database, however, does not contain applications considered by Defendant Board for the January 2021 Commutation Docket. Ex. 9, Directory, Thus, au the database does not provide adequate notice to Plaintiff of inmates being considered for commutation and deprives Plaintiff of a meaningful opportunity to make a decision on whether to make objection to an inmate’s commutation application. 32. Upon information and belief, Defendant Stitt has before him for consideration applications for sentence commutation for which Plaintiff was deprived of adequate notice and a meaningful opportunity to object prior to being recommended for commutation by Defendant Board, 33. Upon information and belief, Defendant Stitt has before him for consideration applications for sentence commutation for which Plaintiff was deprived of a fair and impartial hearing prior to being recommended for parole or commutation by Defendant Board. FIRST CAUSE OF ACTION — VIOLATION OF SECTION 332.2 OF TITLE 57 AND DENIAL OF PROCEDURAL DUE PROCESS. 34, ‘The allegations contained in parageaphs 1-33 are adopted and restated herein, 35. ‘ Article IL, Section 7 of the Oklahoma Constitution guarantees the right to due process of law. Okla. Const. art. IL, § 7. This encompasses the right to procedural due process aimed to protect against arbitrary government action. Taylor v. City of Bixby, 415 P.3d 537 (Okla Civ.App. 2018). 36. Recognizing the crucial role prosecutors play in ensuring community safely and protecting victims’ rights, the Legislature requires Defendant Board to provide to the District Attorney adequate notice and an opportunity to respond fo a request for commutation being considered by Defendant Board. 12 37. Section 332.2 of Tide 57 provides: “Any consideration for commutation shall be made only afer application is made to the Pardon and Parole Board pursuant to the procedures set forth in this section. ‘The Pardon and Parole Board shall provide a copy of the application to the district attomey, the victim or representative of the victim and the Office of the Attorney General within ten (10) business days of receipt of such application.” $7 0.$,.Supp.2019, § 332.2(B). 38. Section 332.2 of Title 57 provides: “An application for commutation ... muust be sent to the trial officials, who shall have oventy (20) business days to provide a ‘written recommendation or protest prior to consideration of the application, Trial officials shall include, ..the current elected distriet attorney of the jurisdiction where the conviction was had.” 57 O.S.Supp.2019, § 332.2(C). 39. Defendant Board has violated the plain and unequivocal mandates of Section 332.2 of Title 57 by failing to provide to Plaintiff timely copies of applications for commutation upon their receipt and by further failing to provide copies of applications for commutation at least twenty (20) business days prior to their consideration by Defendant Board. 40. Defendant Board's failure t0 provide timely and adequate notice of the applications for commutation to be considered hes deprived Plaintiff of a meaningful opportunity to have notice and an opportunity to respond to commutation requests as is guaranteed to him by statute and the Oklahoma Constitution. 41, Defendant Board’s violation of Plaintiff's statutory and constitutional right to adequate notice and an opportunity to be heard impacts not only those applications under 13 Initial Review and Stage Two review by Defeadant Board, but all affected applications currently under review by Defendant Stitt, SECOND CAUSE OF ACTION — VIOLATION OF STATUTES, ETHICS RULES AND DENTAL OF AN IMPARTIAL TRIBUNAL, 42, The allegations contained in paragraphs 1-4 are adopted and restated herein, 43, Article VI, Section 10 of the Oklahoma Constitution directs that, “It shall be the duty of the Board to make an impartial investigation and study of applicants for commnmtations, pardons or paroles...” OklaConst. art. VI, § 10. 44, Section 332.2 of Title 57 provides: “Applications for commntation shall be given impartial review as required by Section 10 of Article VI of the Oklahoma Constitution.” 57 O.8,Supp.2019, § 332.2(H). 45, Oklahome Bthies Rule 4.4 provides in relevant part: “Except as permitted by law or these Rules, a state officer ar employee shall not use his or her State office (1) for his or her own private gain, (2) for the endorsement of any product, service or enterprise, @) for the private gain of a family member or persons with whom the state officer or employee is afftiated in a nongovernmental capacity, including nonprofit organizations af which the state officer or employee is an officer or member, ot (4) for the private gain of persons with whom the state officer or employee seeks employment or business relations.” Rule 4.4, Misuse of Office, Title 74, Ch. 62, Appx. I, (2021). 46. Oklahoma Ethies Rule 4.7 provides in relevant part: “In the event a state officer or employee ... knows that a particular matter involving specific parties is Ukely to have a direct and predictable effect on the material financial interests of the state 14 officer or employee or of his or her family member or... deterraines circumstances would cause a reasonable person with knowledge of all the relevant facts to question his or her impartiality in the matter, the state officer or employee shall not participate in the matter unless he or she is required to do so by lav or permitted to do so by these Rules.” Rule 4.7 further defines a “material financial interest” to include, inter alie, “any source of income derived fiom employment, other than compensation pertaining to the office for which the state officer or employee or his or her family member holds, in the amount of Twenty ‘Thousand Dollars ($20,000.00) oF moze by the state officer or employee or his or her family member.” Rule 4.7, State Officer Impartiality, Ville 74, Ch. 62, Appx, 12021) 47. One or more members of Defendant Board have a material Financial interest Jn the eases under their consideration for parole and/or conimutation which require them to reftain from participating in the matters before them, 48, Circumstances cause a reasonable person to question the impartiality of one of moze members of Defendant Board in the eases wader theit consideration for parole and/or commutation which require theta to refrain from participating in the matters before them, 49, Defendant Board has filed to develop appropriate proceduses to heat and determine challenges to a member's impartiality, 50, . Defendant Board has failed to consider and determine one or more challenges toa member's ability to hear and determine issues related to parole and/or commutation, 15 51. Despite an awareness of existing conflicts of interest and appearances of impropriety, Defendant Board has allowed one or more members to continue. hearing cases for parole and/or commutation. 52, As a result of impeumissible conflicts of interest and appearances of bias by one or more of its members, Plaintiff has been denied his right to an impartial investigation and consideration of applications for commutation by Defendant Board. RELIEF REQUESTED 53, Declare that Defendant Pardon and Parole Board has violated statute by, failing to provide Plaintiff with adequate notice and a meaningfil opportunity to be heard on applications for commutation, 54, Direct that Defendant Pardon and Parole Board henceforth provide to Plaintiff « copy of each and every application for commutation within tea (10) business days from receipt. 55. - Enjoin Defendant Pardon and Parole Board from giving consideration to any application for commutation which has aot been preceded by proper statutory notice to Plaintiff to include a copy of the application for commutation and a minimum of twenty (20) business days to respond thereto. 56. Direct that Defendant Pardon and Parole Board adopt appropriate procedures to consider and adjudicate a challenge to a member's ability to hear a maiter in a fair and impartial manner. Declare that Defendant Pardon and Parole Board member Kelly Doyle has a 57. material financial interest in the cases of parole and commutation before her for consideration. Declare that Defendant Pardon and Parole Board ember Adam Luck has a material financial interest in the cases of parole and commutation befors him for 58. consideration. 59.» Declare that a reasonable person-knowledgeable of all of the facts and circumstances would believe that one or more members of Defendant Pardon and Parole Board appear to be biased in determining the cases of parole and/or commutation that come before thei. 60, Declare any recommendation for parole or commutation in which members Doyle and/or Luck have participated. to be-invalid and in. violation of the Oklahoma Constitution, statutes, and rules of ethics. 61. 5 Enjoin Defendant Stitt from giving consideration to any application for commutation recommended by Defendant Board which has not been preceded by proper statutory notice to Plaintiff to include a copy of the application for commutation and a minimum of twenty (20) business days to respond thereto, 62. , Enjoin Defendant Stitt from giving consideration to any request for parole or commutation recommended by Defendant Board for which Defendant Board failed to act upon a challenge to a member's ability to hear the matter in a fair and impartial manner, 63. According to court documents, Anderson stabbed Andrea Blankenship and cut her heart out. He allegedly then took the heart to his uncle, Leon Pye's home where he cooked it and tried to feed it to his family. Then, Leon Pye and Kaeos Yates were both stabbed to death, Delsie Pye was also stabbed ia both eyes but survived.
