FIRST AMENDMENT TO EMPLOYMENT AGREEMENT BETWEEN NICK McDEVITT AND MIDDLE TENNESSEE STATE UNIVERSITY This FIRST AMENDMENT to the Employment Agreement, effective March 23, 2018, between MIDDLE TENNESSEE STATE UNIVERSITY ("University") and NICK McDEVITT ("Head Coach’), is entered into effective June 30, 2019. WITNESSETH: WHEREAS, the University desires to extend Head Coach's contract for the Period set forth below; and WHEREAS, Head Coach wishes to accept such continued employment for such period hereinafter contained. NOW, THEREFORE, in consideration of the mutual promises and agreements set forth below and other good and valuable consideration, the sufficiency of which is acknowledged by the parties, University and Head Coach agree as follows: 1. Paragraph 2 ("Term of Agreement’) of the Agreement is amended by deleting the June 30, 2023 termination date in Paragraph 2.1 and replacing it with June 30, 2024. 2. Paragraph 10 ("Duties and Responsibilities of Head Coach’) of the Agreement is. amended by adding the following as new Paragraph 10.4 and renumbering the subsequent paragraphs accordingly: 10.4 Coach shall comply with any University requirements currently in effect, or which may be subsequently adopted, related to conduct expectations of Coaches and other athletic staf as it pertains to their treatment of student athletes. 3. Paragraph 17 (‘Suspension or Termination for Cause") of the Agreement is amended by adding the following as new Paragraph 17.1.8 and renumbering the subsequent paragraphs accordingly: 17.1.8 Coach willfully or knowingly fails to comply with any University requirements currently in effect, or which may be subsequently adopted, related to conduct expectations of coaches and other athletic staff as it pertains to their treatment of student athletes. 4, Paragraph 20.1 in Paragraph 20 (“Termination without Cause; Reassignment’) of the Agreement is amended by (i) deleting “March 23, 2021" and replacing it with March 23, 2022,” (ii) deleting “March 24, 2021” and replacing it with “March 24, 2022,” and (iii) deleting the June 30, 2023 termination date and replacing it with June 30, 2024, 5. Paragraph 22.1 in Paragraph 22 ("Termination by Coach) of the Agreement is amended by (i) deleting “March 23, 2021” and replacing it with March 23, 2022,” (ii) deleting “March 24, 2021” and replacing it with “March 24, 2022,” and (iii) deleting the June 30, 2023 termination date and replacing it with June 30, 2024. This FIRST AMENDMENT to the Employment Agreement shalll not be binding on the Parties until it is approved and/or signed by the University’s President or designee, Where appropriate. Unless expressly and specifically amended hereunder, all other terms and provisions of the Employment Agreement shall remain in full force and effect. IN WITNESS WHEREOF, Head Coach and the duly authorized representatives of the University have caused this Amendment to be executed on the dates indicated.
