FOOTBALL GAME CONTRACT
This game contract (“Agreement”) is made and entered into this 26th day of March, 2015, by and between
the Fl
ida Atlantic University Board of Trustees and the University of South Florida. The parties
stipulate and agree as follows:

Varsity football teams representing the two parties agree to meet for an intercollegiate game as

The Host Institution shall have the right to determine the ticket prices and starting time for each
game. The game shall be governed in all respects, including player eligibility, by the rules of the
NCAA, the rules of the conferences to which each party belongs, and the applicable institutional
rules of each party.
The Visiting Team warrants and represents that it meets the NCAA criteria set forth in Bylaw
20.9.7.2.1 to permit the contest to satisfy the football-scheduling requirement specified in Bylaw
20.9,7.2,
Radio broadcasts of the games shall be under the control of the Host Institution; provided,
however, that the Visiting Team shall have a right of free outlet for the live radio broadcast of each
game by one radio station or network situation in its home area, such station to be designated by
the Visiting Team. Any receipts from the sale of such live radio broadcast shall be vested in the
respective team holding the rights to the live broadcast.
Income from live or delayed telecasts by commercial networks shall be retained by each institution
based on its individual conference or rights holder agreement(s) with the television commercial
networks. The Host Institution shall determine the award of commercial networks rights. If the
game is not selected by a commercial network, it will be offered to a national cable system and
each institution or its rights holder will be responsible for developing agreements with the selected
national cable system. The Host Institution shall determine the award to a cable system. If the
game is not televised or cablecast under the above guidelines, the Host Institution shall grant the
Visiting Team permission to telecast/cablecast to its home market for a rights fee of $0.
Both parties shall have the right to use excerpts from the game for highlights or coaches’ television
shows.
Page 1 of 2The Host Institution shall make available to the Visiting Team 500 complimentary tickets
Cheerleaders and mascots shall be admitted without charge when in uniform and shall not be
included in the complimentary ticket allotment. The Visiting Team shall be allotted an additional
4,000 tickets for sale on consignment, said tickets to be in a location as assigned by the Host
Institution. Any unused tickets (except those included as complimentary) should be returned to
the Host Institution four weeks prior to the game. The Host Institution will invoice the vi
team for any consignment tickets not returned four weeks prior to the game.
7. Ifeither party unilaterally cancels the Agreement or otherwise fails to appear for the game as set
forth herein, other than due to a force majeure event as set forth in paragraph 9 below or an
uncured breach of this Agreement, the canceling or failing party agrees to pay the other party the
sum of $500,000 as liquidated damages and not as a penalty within sixty (60) days of the
cancellation or failure.
8. The parties agree that if by reason of an act of God, national crisis, or prohibition by any governing
authority that would make it impossible, illegal or impractical to play the game agreed to, the game
shall be canceled or rescheduled if reasonably practical. Written notice of any such events shall be
given as soon as possible.
9. This Agreement and the rights and obligations set forth herein are not assignable or transferable, in
whole or in part, by either party.
