Purdue University Eootball Game Contract ‘This Football Game Contract (*Contrat") is made as ofthe 25% day of October 2017 by and between Purdue University and Indiana State University In consideration of the following mutual underakings and commitment, the parties agree a follows: 1. GameSehedule. Tickets (8) Brlces, The Host Team will establish ket prices (including any applicable taxes) for the Game. By no later than one week before the Game, the Visiting Team will rum to the Host Team at east 90% of any Game kets then remaining unused, Ifthe Game is not sold out, the isting Team may also return upto 100 Came tickets upon arsival al the Hot Teas location forthe Game. Within 60 days following the Game, the Visiting Team will pay to the Host Team th ticket price forall Game tickets that the Visiting Team received and id not ret pursoant tothe foregoing. Any oter radio station whieh brosdeasts the Game using a fed frm ‘the Visitor's Radio Staton wil be required to pay the Host Team's standard radio rights fee for broadcasting a Men's Football gume. ‘The Visiting Team willbe responsible for ‘ordering and paying for any telephone and broadcast lines needed for such radio broadeas. Fess (2) Game Fee: By no later than February 15 ofthe year following the which the Game is played, the Host Team shall pay the Visiting Team the sum of: Five hundred thousand dollars ($500,000) for participating inthe Game on September’7, 2024, less any amount which the Visiting Team owes and has not paid for ‘Game tickets under Setion 5() above, and Five hundged twenty-five thousand dollars ($525,000) for participating in the Game on September 19,2026, less any stmount which the Visiting Team owes and las not paid for Game iekets under Section 5(b) above. “The Host Team shall retin all other revenue generated in connection with the Game, including but not mite to revenue from ticket and program sale, park 1nd concessions. The Visiting Team stall be responsible for its own expenses. (Disputes, Ail disputes arising under this Contract which the partes cannot resolve amicably through negotiations shal be filed exclusively inthe state ‘or federal courts in Tippecanoe County, Indiana. Sponsorship Agreement. ‘The parties hereby acknowledge that Purdue University has entered into an exclusive Sponsorship Agreement with the Gatorade Company the exclusive ‘manufacturer and distibulor of GATORADE products, pursuant to which Purdue University has agreed to require that GATORADE-denifed cups, coolers, ee chests, squeeze bottles, sideline arts and towels (hereinafter “Gatorade Merchandise") be placed, exclusively, om all Purdue University team benches and sidelines at athletic events, subjest to NCAA legislation, guidelines and regulations including those regarding individual player endorsements), subject to applicable Conference and NCAA. tuidelines with respect to pre-season, post-season and exhibition games, and subject to the legal and contractual rights of third parties. I for any reason Gatorade Merchandise ‘cannot be placed on any Purdue University team benches or sidelines at any athletic ‘contest played pursunnt to this Agreement, then the partes agre that generic (non branded) cups, cookers, ice chess, squeeze bottles, sideline carts aa towels shall be placed, exclsively on said Purdue University team benches or sidelines.
