Pursuant to Fed. R. Bankr. P. 7036 and Fed. R. Civ. P. 36 as incorporated therein, C(the “Debtor”) hereby requests that Multibank 2009-1 RES-ADC Venture, LLC ("Multibank") shall admit or deny, under oath, the truth of each of the statements contained herein in a writing served on plaintiff’s counsel within thirty days after the date of service of this request, in accordance with the instructions and definitions set out below. INSTRUCTIONS AND DEFINITIONS 1. In accordance with Rule 7036, each matter of which an admission

is requested is admitted unless, within thirty (30) days after service of this

request, Multibank serves upon Debtor either (1) a written statement signed under the penalties of perjury specifically (a) denying the matter or (b) setting forth in detail why Multibank cannot truthfully admit or deny the matter; or (2) a written objection addressed to the matter, signed by Multibank. If an objection is made, the reasons therefore shall be stated. A denial shall fairly meet the substance of the requested admission, and when good faith requires that Multibank qualify its answer to deny only a part of the matter of which an admission is requested, it shall specify so much of it as is true and qualify or deny the remainder. Multibank may not give lack of information or knowledge as a reason for failure to admit or deny unless it states that it has made reasonable inquiry and that the information known or readily obtainable by Multibank is insufficient to enable Multibank to admit or deny. 2. Each request is to be deemed a continuing one. If, after serving

an answer, you obtain or become aware of any further information pertaining to any of these requests, you are requested to serve a supplemental answer setting forth such information. REQUESTS FOR ADMISSION Admit or deny the following: 1. No endorsement appears on the copy of the Promissory Note

which is attached to the Amended Proof of Claim filed by Multibank. 2. Multibank does not have an original of the Promissory Note it says

was signed by Debtor. 3. Multibank does not know the location of the original copy of the

Promissory Note it says was signed by Debtor. 4. Multibank does not know who now holds the original copy of the

Promissory Note it says was signed by Debtor. //
