Count 7: CONSPIRACY TO COMMIT INTENTIONAL CHILD ABUSE - BODILY HARM The above-named defendant on or between February .21, 2010 through November 29, 2010, in the Village of Black Earth and/or Mazomanie, Dane County, Vilisconsin, conspired to intentionally cause bodily harm to a child, DBC, 12/21/2009, the son of Matthew and Alina Caminiti, DOB 12/21/2009, contrary to sec. 948.03(2)(b), 939.50(3)(h), 939.31 Wis. 8tats., a Class H Felony, and upon conviction may be fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than six (6) years, or both.

FACTS:

Background: Aleitheia Bible Church (ABC)

In November 2010, the Dane CountySheriff's Department (DC80) commenced an investigation of possible child abuse occurring within a religious group in the Mazomanie and Black Earth area known as the Aleitheia Bible Church (hereinafter ABC). Numerous DC80 Detectives and deputies investigated and learned that the ABC was formed in 2006 as a result of a break within another church; the Curtis Street Bible Fellowship (C8BF) in Mazomanie, WI. Between December 2010 and February 2011, the DCSO submitted approximately 450 pages of reports to the District Attorney's Office for review.

Det. Mary Butler interviewed Mark Cymbalak on 11/18/2010 who is the present fulltime·pastor at the CSBF. Pastor Cymbalak advised that before the break-in 2006, the board of directors at the C8BF consisted of 11 elders including himself, Phil Caminiti, John

Caminiti, Todd Barsness, Darwin Parman and Bob Wick. Pastor Cymbalak explained that the board was supposed to work together to share decision-making; however Phil Caminiti wanted to be in charge and asserted that he had better qualifications than the others. Pastor Cymbalak recalled that Phil Caminiti wrote two papers describing why he should be the church's leader. In March 2006, Phil Caminiti left the eSBF along with Todd Barsness, Darwin Parman and Bob Wick and their families. Phil Caminiti then formed the ABC. Pastor Cymbalak stated that Phil teaches "shunning" and that members of the ABC actively shun members of the CSBF by ignoring them and refusing to interact with them or their children in any meaningful way.

Phillip Caminiti ,

Phil Caminiti resides at 835 Blue Mounds St., in Black Earth with his wife Denise (Parman) Caminiti and their chiidren:.Andrew Caminiti, DOB: 03/20/1985, Carissa Caminiti, DOB: 06/18/1987, Lydia Caminiti, DOB: 03/26/1990, Elisa, DOB: 12/28/1992, MOe, a male, DOB: 05/09/1995, AJC, a male, DOB: 09/01/1997, and CJC, a male, DOB: 12/07/2000. The youngest, CJC is horneschooled, while EMC, MOe and AJC attend Wisconsin Heights School. Neither Andrew norCarissa is employed and Lydia, who is 21 years of age, is the only household member who works outside the home. Phil Caminiti's eldest, Maria (Caminiti) Stephenson, DOB: 10/27/1981, is married to Timothy Stephenson and they have two sons (ASP, DOB: 09/09/2007 and TMS, DOB: 02/07/2009) and belong to the ABC. Phil Caminiti's second eldest, Matthew B. Caminiti, is an ABC elder who is married to Alina (Harrison) Caminiti. Matt and Alina have two young children (ANC, OOB: 06/18/2008 and DBC, OOB: 12/21/2009) and are members of ABC.

Oet. Dawn Johnson interviewed Phil Caminiti (hereinafter "Phil") on 11/30/2010 'and Phil provided personal information regarding his background; including that he graduated high school in Michigan where he was raised evangelical protestant. After high school, Phil advised that he went to Grand Rapids School of the Bible and Music, which he attended for 5 years, which later merged with Cornerstone University. After finishing school in Grand Rapids, Phil became a pastor at Fennville Bible Church in Fennville, Michigan, serving there between 1980 and 1984. Phil said that he left that church because he felt that the leaders needed to have a more "pure character and lifestyle." Phil stated that he saw people praying to and saying they loved Jesus, but their actions did not match their words. Phil rhetorically asked "if Jesus died for my sins, so I could be forgiven, does that mean I can sit back and sin?" adding "if we have this great salvation, we will sin, but we shouldn't have that as our reputation." Phil stated some leaders in Fennville had unacceptable habits, which prevented progress and that he needed to move on and

therefore left. .

, Phil married Denise Parman while in MI and they moved to Black Earth, WI in 1986 where he served as pastor of the Black Earth Congregational Church. In 2004, the congregation built a new church in Mazomanie, named the CSBF Church. Phil advised that he was a pastor at the CSBF between 2004 and 2006. In 2006, Phil stated that he started confronting "hypocrisy" with church members at CSBF church, saying "we need to live a life without excuses; a more becoming life." Phil stated that he wrote a paper called "leaders among leaders" and ultimately proposed a split or separation from the CSBF. He, along with a number of other families, then formed the Aleitheia Bible Church where he is the full time head pastor/elder. Regarding the ABC split, Phil denied that he wanted more power but acknowledged that his expectations were high and that members of the CSBF felt that Phil was "going beyond scripture."

The ABC does not have an independent place of worship but holds church and church meetings at the homes of Phil & Denise Caminiti in Black Earth, and Bob & Lori Wick in Mazomanie. Phil is the church leader, while Matt Caminiti and Todd Barsness are elders at ABC. The Wick family provided the original funding, placing between $500,000 and $600,000 into an account for the ABC. Phil stated that he receives a salary of $43,000.00 per year plus health insurance benefits and his son Matt receives a salary of about $30,000.00 per year. Todd Barsness receives a salary of approximately $41 ,000.00 per year. These yearly salaries, approximately $114,000, are paid by the Bob and Lori Wick for the 15 families who make up the ABC. The ABC families are also encouraged to give money. According to Phil: "If people have been blessed by God, then they need to be generous."

Phil further expressed his belief that the Bible dictates the use of a rod over a hand

. to punish children stating that children only a few months old are "worthy" of the rod and that by "one and a half months," a child is old enough to be spanked. Phil explained that when a baby is "selfish cry[ing]" you would first squeeze their leg or shoulder and say "no" and if that doesn't work, then a rod could be used. When asked about distinguishing between types of cries, Phil stated that parents can tell very early on what type of cry the infant is exhibiting and if the young child is exhibiting fussin.ess for no reason, then they should be punished .. Phil admitted to instructing parents [within the ABC] to hit their children on the bare butt with the rod because "there is a lot of flesh there." Phil stated that he "likes the immediacy 0/ spanking" and "pain is a good way to teach children," adding that "the scripture is never wrong."

Phil stated: "If you spank early and it is done right, then kids will be happy and obedient;" explaining that the Bible says that you should use a rod. Det. Johnson asked if bruising resulted from the rod spankings, whether this would be a sign that the spanking was too hard or too much. Phil responded by stating, "I don't think bruises are telltale signs of something bad:" He stated "The pain is used to tell them 'this is serious and I need you to obey.'" Phil stated that scripture does not proscribe the exact way to spank, but this is the way he has instructed his followers (members of the ABC).

Phil expressed his belief in shunning when people do not repent. He stated that scripture says to shun those who have chosen not to follow or obey scripture; and cited certain biblical references.' In discussing the role and responsibility of women in the church, Phil stated that women are supposed to teach the younger women to be good "home workers" and that moms are responsible for and need to "tend home fires." He stated that that is why many of the women in the church do not work outside the home, as they need to devote their time and energy to the home. Phil also admitted that as the church leaders, they do counsel people whose wives are overweight. He stated that the Bible talks about gluttony, and when people become overweight, it is a sin.

Detective Mary Butler continued corresponding with Phil Caminiti during the course of the investigation, sharing with him the legal definitions of child abuse and reasonable discipline. Subsequent to this exchange, Phil expressed his belief in the discipline he practices and promotes; and indicated his desire to continue teaching these methods. In

one e-mail, Phil explained that while he wanted to comply with the laws of Wisconsin, he was concerned with the standard that the members of his church not cause physical pain, since that was the point of spanking with the rod. In one of his final communications, he stated that if they needed to, "some of [them] would seek residence in a state that has laws more in keeping with [their] religious beliefs."

John Caminiti

Phil Caminiti's brother, John Caminiti, (hereinafter "John"), resides at 1437 Mills St., Black Earth, in Dane County, WI along with his wife, Carolyn Caminiti and their six children: CMC, a male, DOB: 12/16/1993, JCC, a male, DOB: 09/13/1995"LKC, a male, DOB: 06/18/1998, RJC, a female, DOB: 11/30/2000, KOC, 'a male, DOB: 12/07/2005, and TRC, a female, OOB: 11/20/2007. All six children are presently home-schooled. Approximately five years ago, John moved his family to Black Earth from Michigan, where all of his school-aged children had attended public schools. John and his family joined the Curtis Street Bible Fellowship (CSBF) in Mazomanie, WI where John's brother Phil was a "figurehead."

On 11/29/2010, Det. Bill Hendrickson interviewed John Caminiti. John stated that they separated from the CSBF and now belong to ABC where -they are living in accordance with God's word. John stated that his brother Phil was the "driving force" in the separation and that Phil is the shepherd and lead teacher of the ABC. When asked about the teaching at the ABC church, John stated that he was learning "who is Christ, why he is coming." John stated that Christ is more important to him than his own family and felt that it should be for every<?ne, and that he has no higher allegiance to anyone but God.

When Oet. Hendrickson asked, about physical punishment in his household, John' stated "you mean spare the rod, spoil the child." John said that he began using the rod or dowel while he was at the ABC church. John stated that the scriptures made it clear that this was allowed; and the practice was advocated by pastors within the church, including Phil Caminiti. John stated that he had never used a stick, rod or dowel on his children prior to joining ABC. John stated that the church (ABC) teaches them to use a rod or stick against bare skin described as the buttocks or top of hamstrings. John stated that he now used a dowel on his younger children (KDC and TRC) and was just following the teachings of the Bible, again stating that the Bible allowed it.

When asked why he only started using the rod after joining the ABC, if the scripture clearly condoned it, John had no response. He said that it was really not something he was directed to do until coming to ABC church when taught lessons by his brother, Phil, and as a result he continued with them and utilized the dowel in spanking as his main source of issuing discipline for disobedience.

John stated that he utilizes the rod or dowel on his two youngest children, KDC, OOB: 12/07/2005, and TRC, DOB: 11/20/2007 whenever they are disobedient. John stated that he began using a dowel against KDC and TRC when they were roughly three months old and that it was primarily done on bare buttocks utilizing a spoon. ,As KOC and TRC grew, he eventually began using a smaller dowel and now uses the larger dowel which he described as being 12" to 18" long and the diameter the size of a quarter. When asked about leaving marks, John stated that he would typically see a red mark, about the size of a fifty-cent piece, which would last for a day or two. When asked if the dowel

spankings resulted in any discoloration or bruising, John stated that this two-day healing period included the disappearance of any redness to the skin and the fading of discoloration or bruises.

John stated that the last time he utilized the dowel on KRC was approximately four days ago and that the last time he used a dowel on TRC was "within the week." He specifically recalled that he struck each child three times with-the dowel, that they cried and there was redness. When asked what either child did to deserve a spanking with a dowel, John couldn't recall and stated that almost all of the incidents are in response to simple disobedience or not following directions within the household, John stated that bruising would "almost always" accompany the reddening of the skin and that the bruising again was discolored skin in a circular shape roughly the diameter of a fifty-cent piece.

When asked to average out the amount of spankings he would give KDC and TRC, John advised that he typically would give them two to three spankings a week and that this has been going on since he first learned about it. John stated that the dowel spankings would occur at home or at church, which took place at either Phil Caminiti's home or Bob Wick's home.

John described that he believed in a hierarchy within his home, placing himself at the top. Oet. Hendrickson asked John if his wife Carolyn had ever caused problems for him in the same way that his children might, what type of discipline he would impose 'on her. John explained that there was no physical conflict but admitted to having imposed some sanctions, for lack of a better term, when she was having difficulty keeping up with the order which needed to be maintained within the home. When asked, John agreed that this would be comparable to "shunning."

John stated that typically when he and his wife have problems, they begin by talking however, on two occasions, the conversations led to shunning Carolyn. John believed that these instances occurred within the past 18 months and typically this shunning or confinement would take place for approximately two days. John advised that when the' shunning process is going on, Carolyn stays within their bedroom, has no contact with their children whatsoever and her meals are taken to her (in the bedroom). John stated that Carolyn was given clear instructions (by him) that she was to stay in there until she was able to either talk with him or correct her disobedience.

Oet. Hendrickson inquired as to whether John utilized shunning with his children, which John did acknowledge. John advised that in January 2010, his 16-year old son, CMC, DOB: ,12/16/1993, was shunned and confined to his room for a period of three weeks as a result of repeated disobedience and just "not going along with the program within the home." John stated that CMC was only allowed out of his room for homeschooling, but after his sessions, he was required to go back to his room. John stated that again the door to the room was not locked and CMC was not confined there by force, but did have clear instructions that he was not to leave. CMC was fed while on this shunning was ongoing however meals were taken to his room. He was not allowed to eat with any family member(s).

John explained that this shunning was done to maintain the integrity of his family

ABC. John stated that these other beliefs can be a negative influence on his family and as a result he does not allow communication of any type with people outside his religious belief (ABC). John explained that Phil Caminiti was the driving force With respect to shunning.

Carolyn Caminiti

On 11/29/2010, Det. Janet Boehnen interviewed John Caminiti's wife, Carolyn Caminiti (hereinafter "Carolyn"). Carolyn indicated that Phil Caminiti teaches that spanking with a rod .or stick is successful with children who are disobeying, including infants. She then explained that Phil had used a wooden spoon on himself in church, in order to demonstrate how hard to hit the children. When asked how she felt about this Carolyn said it was new to her, and that she does not always agree with thedeclslons, Carolyn advised that their older boys, CMC and JCC, were never spanked with a dowel. Carolyn stated that they were taught to discipline their younger children by using a dowel and that she was counseled by John and Phil, and made to understand things.

Carolyn explained that her two youngest children were at Phil Caminiti's residence for a period of time and that his 21-year old daughter Carissa Caminiti was caring for them

. there. Det. Boehnen asked Carolyn if she had seen KDC or TRC since they went to' Phil's, she said "no." When asked if she could go to Phil's and see her children if she wanted to, Carolyn stated, probably not, because the plan was to leave them there for the week. At this point, Carolyn's expression changed; she had tears in her eyes and her lips began to quiver. When' Det. Boehnen asked Carolyn if it was her idea for these arrangements, Carolyn said "no," and that it was Phil and Carissa's idea. Carolyn stated that she wished her children didn't have to be away from her for the week, but blamed herself for not being successful with obedience and homeschooling, which resulted in this situation.

Det. Boehnen asked to see the dowel-like instruments they use for spanking and asked if she could have them. Carolyn was not sure and wanted to ask John first, however did take Det. Boehnen into the bedroom and showed her the two wooden sticks they use on the children. Carolyn advised that she didn't realize they were doinq anything wrong or illegal and that they were just following what was taught to them through the church and scripture.

Carolyn stated that she had been shunned or separated for her lack of blamelessness, which entailed keeping her separated from her family and not being' able to gather at church. She stated during one period of separation, which lasted for about one month, she remained mostly in her bedroom where she had to eat most of her meals. She stated at times she did eat at the table with her family, but none of the family members could talk with her nor could she talk with them. She informed Det. Boehnen that she '. could leave the house to go for a walk or go shopping alone, but could not engage in any

Carolyn stated that the ABC 'believes that people can be blameless describing it to mean that God wants them to be imitators of Him and to be "sin haters." Carolyn said that she was trying to "get perfection," but had not, because she does not understand. When asked who was telling her this, Carolyn indicated that Phil, her husband, John, and Carissa were telling her this. She stated she needs to get further direction from the individuals "over her" because it's not always clear to her. It then becomes the elders' responsibility to help her understand. When asked to describe what she meant, Carolyn described it as respecting authority and to fear them, meaning the elders of the church.

When Det. Boehnen asked Carolyn whether she had ever thought about separating from the church or whether anyone had ever threatened he!" if she did leave the ABC, Carolyn sat in silence for a moment before answering in a careful and measured fashion. Carolyn advised there was talk of repercussion in that if she did leave the church, she would not see her children, because she would have to be separated from all of the members. Oet. Boehnen advised Carolyn that she could not legally be separated from her children for leaving the church, however Carolyn indicated that she was not sure if she believed this or not. Carolyn stated that she loves and respects her husband and respects ABC's elders more than herself. She reiterated that she is working very hard to "understand" and gain success as a mom and a teacher. Det. Boehnen clarified what Carolyn meant when she used the word "understand," and Carolyn stated that her husband and the elders help her understand how to be blameless. -

When asked what she did to warrant such a lengthy separation, Carolyn indicated things like disagreeing and having no success with the home schooling of her children, and their lack of obedience.

John and Carolyn Caminiti's Children

On 11/29/2010, DCSO Detectives interviewed John and Carolyn Caminiti's children.

CMC, a male, 008: 12/16/1993, recalled that his mother didn't always agree with his dad and his Uncle Phil; and that a couple of times, his mother had her bags packed to leave, but his dad stopped her and has called Phil to come over and talk with her. CMC explained that while nobody ever physically restrained his mom, his dad would tell her that she was making bad choices and that she could not leave." CMC recalled that the last - time this happened was August 14th 2010. The "plan" was that his mom had to speak with Phil's daughter, Carissa, before 10:00 a.m. the next morning or she would be told to leave

- and not come back. CMC recalled that at first his mom refused to talk with Carissa but finally gave in and did what she was told.

RJC, a female, 008: 11/30/2000 recalled that her mom had been shunned the time that she went to her room. RJC 'said that her Uncle Phil came over to help her dad with what to say to her mom when she needed to go to her room. When asked if she felt safe in her house, RJC said she did, then stated that last year she was on a time-out in her room for almost a month until Uncle Phil came and "made me more happy."

LKC, a male, 008: 06/18/1998 said that his mom wasn't "doing well with her thinking," so his dad had sent her to her room to think about it. His dad would call from work during breaks to check and see that everyone was in their room. Back in September 2010, LKC recalled that his mom came to their room and asked if she left, would any of the boys go with her. His dad called Phil about the situation, and Phil came over to talk with his mom about it. Regarding their house, LKC stated that he-likes it but mentioned that at one point they'd thought about buying a different house, but Phil said they should wait until they are "doing better with their feelings."

Stephenson (hereinafter "Maria") .in her home. Oep. Holmes asked Maria about the type of discipline utilized within her family. Maria began by describing the concept behind the discipline as including "catch everything we don't like about what kids do," which involves "seeing everything," and then "stopping unwanted behavior." Maria stated that she disciplines her sons by having them sit in a "selfishness" room where they think about what they did (wrong), and also the physical act of spanking them.

According to Maria, her father, Phil Caminiti, who is an elder at the ABC, instructs other church members on how to utilize rods/wooden dowels for spankings and counsels members of the church as to how to correctly spank with the dowel. Oep. Holmes inquired about what b-ehaviors would result in spanking with the dowel. Maria said that if her sons made a "decision" to disobey; did not listen, or willfully disobeyed, they would be spanked. Maria also stated that the behavior could include being emotional or crying habitually after being told to stop. Maria used the term "grumpy," explaining that this was the equivalent of a bad attitude, and said that she could tell if her child was just being defiant. Maria said at her sons' current ages, (three years old and 22 months old) they

, know better than to say "no" out loud. She explained that her sons will substitute verbal defiance with body language and facial expressions, which Maria described as "qrumplness." Maria indicated that she deals with this "grumpiness" by spankings.

Maria recalled that she started spanking TMS when he was approximately three months of age, and APS at around six months of age. Maria explained that when her boys yvere this young, she and Tim used a wooden spoon or a very skinny dowel, not the same dowel that they would use now. When asked by the Deputy how she knew the . difference between a baby simply crying and something that would indicate "willful or deliberate" defiance, Maria stated, "You Just have to know your children." Maria provided an example that her 22-month old son, TMS, expresses anger by crying and has a facial expression that she is familiar with, which indicates he is being willful or deliberate as opposed to needing something. Maria said that prior to any spanking at that age, she would always make sure that her child had a clean diaper and had been fed and that there weren't any other causes behind the crying. If the crying did not stop after being told "no" then the child would be spanked.

Maria said that she usually hits her sons approximately three times with the dowel, and always on the bare buttocks. Afterwards, Maria said that she sits the child on her lap and talks, saying that now things are perfect and they can move on with the rest of their day. Mariasays that in a "very small way, she's trying to be Christ-like to her kids."

Maria indicated that a few weeks ago during a spanking situation, APS moved and she inadvertently hit him on his right hip, which may have left a mark or a bruise. Maria stated that sometimes APS will try to block the spankings with his hands, but she tells him "no" and he then stops trying. Marla described the. most recent spanking of APS as occurring "a few weeks ago." Maria stated that the spanking may have occurred during her attempts to potty train APS when he was refusing to sit on the toilet. Maria explained that APS was spanked for this defiance.

Phil Caminiti spoke with Oet. Johnson about Tim and Maria Stephenson stating that Tim has taken his children to another room to give them a spanking while he visited their house, at times when the children would misbehave. He recalled the last incident as occurring about two months ago and stated lie visits there about twice a month. Phil also

acknowledged that he has spoken with Tim about the use of spanking and the rod. Phil recalled that TMS being spanked for not obeying or not putting his toys away and "needed to be corrected." Phil recalled an incident approximately three months ago where APS awoke from a nap' and was "grumpy." Maria took him into another ,home at Phil's house and used Phil's rod, which he keeps in his bedroom closet, to hit APS twice. Phil stated that all of his kids were taught to spank using a rod on the child's bare butt. He states that scripture does not give the exact way to spank, but that is the way Phil has instructed.

Matt & Alina Caminiti

Matt and Alina Caminiti reside with their two children, ANC, a 2% year old female, DOB: 06/18/2008 and DBC, an f t-month old male, DOB: 12/21/2009, at 809 Center St. in Black Earth, Wisconsin. Phil Caminiti is Matt Caminiti's father. Deputy Josalyn Longley and Detective Steve Wenger interviewed Alina Caminiti (hereinafter Alina) and Matthew Caminiti (hereinafter Matt) in theirhorne on 11/30/2010. Matt and Alina joined the ABC in the fall of 2006 and Matt is a co-elder at ABC.

Alina admitted that she and Matt spanked their daughter, ANC, with a wooden spoon and a dowel; and also spank their son DBC with a wooden spoon, from the time the children were two - three months of age. Alina saw bruising on both of her children as a result of these spanking incidents and last spanked them about three weeks ago.

Regarding spanking ANC at two - three months of age, Alina stated that they would

, spank only if they could see ANC getting "angry" about something or not listening. As an example, Alina described being at church when ANC was younq and trying to hand her to other members of the church, however, ANC would cry when she went to other people. For this, Alina took ANC to another room and spanked her. She stated that the church service spankings took place in Phil Caminiti's house. Alina said she used a flat wooden stir fry spoon to spank when ANC was younger and explained that the purpose is to inflict pain on the child.

Alina stated that she spanked ANC around once every two weeks when ANC was between two and six months of age and there was probably bruising. When ANC turned six months of age until she was about one year old, (12/18/2008 .; 0611812009), Alina believed she was .spanklnq ANC two to five times a week, while working on her hstenlnq and training. Alina stated that it was very common to see bruising. Alina stated that she and Matt would usually not spank an already-sore areas, but would switch to striking another side of her buttock or thigh. Alina described the injury as usually red or light purple bruising in the locations where they would spank; and believed that around one out of every three spankings would result in a bruise. Alina recalled a time when ANC was about 10 months old and they were using the wooden spoon and ANC was having a tough time sitting. She and Matt felt that it was possibly a result of their spanking.'

According to Alina, most of the members of the ABC spank their children. Phil Caminiti would usually hold small meetings for couples with young children and give them ideas and tips on parenting. Alina knew that Phil showed members of the church how to use the wooden dowel for training. Alina hasseert Phil hit his own leg with a wooden

dowel while showing members how to use it. According to Alina, Phil described these spankings to the members as "inflicting pain so the kids don't do the acts again."

Alina stated that she and Matt started spanking their son, DBC, oOB: 12/21/2009 when he was about two months old, (02/21/2010). 'They would spank DBC on the bare butt with a wooden spoon. Alina recalled seeing bruising on DBC's buttocks area approximately five times adding that her son "bruises easily so he probably bruised every time he was spanked." Alina explained that they graduate from. using a wooden spoon to a wooden dowel when the' child is older and "meatier enough" to handle it.

Matt also acknowledged that he and his wife spank their children, explaining that corporal punishment is the best way to show that disobedience is not allowed and quoting "the rod" as the Biblical reference. Matt explained that the rod is used on a "bare butt" or thigh and that the spanking should hurt and be painful; and the pain needs to remind them that they cannot do the wrong. Matt said that the ABC' explains the Biblical reasoning of spanking to its members, however, encourages more of it to take place at home.

Regarding his own children, two-year old ANC, DOB: 06/18/2008 and t t-rnonth old DBC, OOB: 12/21/2009, Matt said that they started spanking both children when they were around two months old with a flatwooden spoon. Matt acknowledged that on some occasions; the spankings would leave some bruising on their bottoms. When asked, Matt estimated that he has seen bruising around five times in the past on his son DBC, which bruising consisted of a red mark or a purple discoloration on the surface about the size of a flat wooden spoon. He said that the bruise would only last a day or less. Matt said that bruising was more prevalent on his daughter ANC than his son.

When asked about the last time any of the children were spanked, Matt said that DBC was spanked a couple of weeks ago or even longer. Matt said that he spanks anywhere from one to three strikes on their bottom or upper thigh and are "hard enough to inflict. pain." Matt said that the spankings need to hurt and be painful.

Matt explained. to us that when ANC got older and was no longer an infant, they "graduated" to using a wooden dowel as her bottom and thigh were more "meaty." According the Matt, P'hil Caminiti, also encourages the use of a wooden dowel. After the . spankings take place, Matt stated that they hold their children and explain to them what led to the spanking, adding that spankings are never done in anger, and the children are told that they are loved.

When asked if Matt recalled inflicting cuts or drawing blood at any time while spanking, Matt recalled that one time, about six months ago, (between approximately May and June 2010), he was spanking ANC with the wooden rodldowel and the tip of it . accidentally struck the calf area of her leg and this caused a slight bleed.

On 12/01/2010, Detective Wegner returned to Matt and Alina Caminiti's house.

Matt stated that he, his father and Todd Barsness (the elders) met that morning and decided that all of the wooden instruments they had used for spanking should be thrown away. Det. Wegner retrieved the two wooden rods and a wooden spoon which Matt and Alina had used to spank their children from the kitchen garbage.

STATE OF WISCONSIN - VS - Philip B Caminiti ,

Phil Caminiti told Det. Johnson about an incident involving Matthew Caminiti's' young daughter, ANC, when ANC was about 9 months old and was in her high chair. ANC was being fussy and also "being selfish" at which point Matt tried to "correct her" verbally and by squeezing her arm, but "it did not correct it." Phil stated that Mat removed her from the high chair,"laid her "gently" on the kitchen floor, removed her diaper and hit her two times with the dowel on her bare butt. Phil stated that ANC cried, but he described this as a "good cry, like she understood why she was spanked."

Tim & Andrea Wick

On 12/02/2010, DCSO Detectives Gwen Ruppert and Ron Darn went to 315 Anne St., in Mazomanie, WI, where they Timothy and Andrea Wick (hereinafter "Tim" and "Andrea") and their 21-month old daughter, ENW, 008: 03/18/2009. Tim and Andrea are members of the ABC and have been since 2008. Detectives Ruppert and Darn interviewed Andrea while Detectives Katherine Wessel and Todd Benisch interviewed Timothy in another room.

Andrea explained that Phil Caminiti had talked with them and demonstrated how to spank with a dowel at a "young-marrieds" meeting approximately a year ago. Since then, she and Tim have talked with Phil by themselves to make sure they understood. When asked about injury or bruising, Andrea stated that she has seen red marks on ENW, which usually go away in a day. Andrea stated that she has also seen bruising on ENW when they were spanking more frequently and often striking the same area which was already sore. Andrea stated that this occurred when ENW was around nine months old and shortly afterwards - when she was receiving more frequent spankings.

Andrea stated that EMW has been spanked at church, between approximately ninemonths of age until recently. Church services are held at Bob andLori Wick's home or at Phil and Denise Caminiti's home (both in Dane County), and the children attend the same service as the adults. Andrea explained that the children are not typically loud during . services as they are trained to sit quietly. Andrea explained that if ENW were told to be quiet and she was not quiet, they would leave and get her attention to make sure that she understood; however if it continued, EMW might be spanked. Andrea said that it had gone on too long because she was not being consistent with this spanking as discipline, and "we needed to get a firmer handle on it."

Andrea stated that she and Tim used a wooden spoon for spanking until EMW was around one-year old; and now use a dowel to spank her. Andrea said that she will spank ENW up to three times in order to get one that is "good enough," stating that she is weak and does not wield the stick forcefully enough. Andrea offered that Tim "can do it once and have it be of the right strength." Andrea explained that the purpose of this was for ENW to have certain respectable behavior and for her to know what behaviors were unacceptable. Andrea said that there has to be a consequence to bad behavior, and that is the point of the spanking and that it "should cause pain or it is pointless."

Andrea confirmed that these spankings are done on bare skin on the child's bottom and demonstrated by swinging her arm in a side arm throw, and then snapping her wrist at the end. Andrea explained that she snapped her wrist at the end because she had a bad shoulder and this way was able to achieve the force desired. Andrea explained that she knew she got the pain response desired because there would be a "physical upset" by the child (crying) and then obedience afterwards. Andrea estimates that ENW is spanked with

the dowel about two times a week. She then retrieved the dowel they used. Oet. Ruppert described the item as round wooden object about 16 to 18 inches long, and half to five':' eighths inches in diameter.

Oet. Benisch spoke with Tim Wick about discipline with his 21-month old daughter, ENW. Tim stated that he uses the rod as a means of discipline and derives his belief in using the rod from the teachings in Proverbs 22:6. Tim stated that three months 'was an appropriate time to start disciplining a child with the rod; stating that he began using the . rod on ENW when she was around five months old. Tim stated that ENW cries when he spanks her with the rod and conceded that the rod leaves marks on ENW. Tim stated that he strikes ENW maybe two or three times during a spanking, which occurs about two times a week, both in and out of church services. Tim described this as a normal practice for all family members who attend the ABC.

Carissa Caminiti

On 11/30/2010, Oep. James Kartman interviewed Carissa Caminiti at her residence in Black Earth, WI. Carissa is a member of the ABC, where her father, Phil Caminiti is an elder. Carissa described children being spanked with wooden spoons or rods and recalled that the last time this happened was approximately four months ago, by Tim and Andrea Wick and their daughter ENW, OOB: 03/18/2009. Carissa stated that this incident occurred at the Caminiti's home at 835 Blue Mounds St., during a church service when ENW was not sitting quietly as she'd been instructed to do. ENW was eventually taken into a back room and although Carissa did not directly observe the spanking, she indicated that she knew that's what happens when children are taken out of the main worship room into one the side rooms.

Carissa stated that she has observed bruises on John and Carolyn Caminiti's two youngest boys, whom she identified as TRC and KOC. Carissa stated the last time she observed bruises on these children was approximately two years ago.

Merry Hahn

On 11/11/2010, Deputy Josalyn Longley, met with Merry Hahn (hereinafter "Merry"), who advised that she and her family (husband Norman, son Kurtis and ,daughter EKH, OOB: 11/09/1994) were members of the CSBF church in 2005 where Phil Caminiti was one of four pastors. Merry describedtenslons developing at the CSBF church, as Phil took the position that the church was not strict enough, and espoused a stronger method of . teaching. Merry recalled that about four years ago, Phil and two other of the pastors broke

. away from the CSBF, taking about twenty adults with them, and leaving about one hundred people at the CSBF. Merry and her family were among those who followed Phil, who wanted a church with stricter rules. They named the church the ABC, which is Greek for "truth." Merry indicated th~t she and her family left the ABC in January 2010.

Merry described the ABC church services occurring within the members' residences every Sunday morning and evening. Merry stated that Phil was very· strict about children being quiet during church. She stated that when a baby would "pipe up" during, a service, the parent was told to hold the baby tight and say "no" very loudly close to the ear. If the baby did not quiet down, the parent removed the child to a bedroom, which was usually close enough to the living room where you could hear the dowel hitting the baby. Merry recallsthe youngest child being spanked by a dowel as approximately·four months old.

Merry recalled an incident when a parent had not been keeping their child quiet during church and Phil showed the parent how to deal with the situation. Phil took a dowel and hit himself on his leg with the dowel to demonstrate how to use it. Phil stated "this is how hard you hit a baby". Merry recalled Phil telling her and her husband that he had hit himself so hard on the leg, it brought tears to his eyes

Merry relayed a conversation she had with Phil regarding the children being beaten with the dowel when. Merry asked Phil what he would do if one of the children had to go to the doctor for bruising. Phil responded "if I have to go to prison for disciplining a child with a rod, so be it." Merry felt that Phil had no remorse for what was taking place in his

church. '

Kurtis Hahn

On 11/17/2010, Oep. Longley interviewed Kurtis Hahn (hereinafter "Kurt") who advised that he dated a woman named Patsy Ubert, (hereinafter "Patty") around 2006 - 2008.' Patty has a son, CJU, OOB: 10/26/2006. When their relationship began, Phil met with Kurt and Patty to talk about their relationship and the importance of living a life of "blamelessness." Phil said that Patsy had to be a believer, or Kurt would be sinning, which they didn't allow in the ABC. Phil and Matt Caminiti would tell Kurt and Patty the "proper" way to do things (which included the message that the male was in power in the relationship). Kurt stated that Phil and Matt would try to "cram all of their beliefs into Patty's head," which eventually contributed to their break-up. Kurt believed that if he continued to date Patty, who was a non-believer, his family would have to shun him. Kurt stated that shunning was very common in the church if you did notfollow what Phil ordered or believed. In reference to dating Patty, Phil made a comment that dating a non-believer was like having sex with a dead body.

Kurt stated that he, Patty and her son, CJU, attended the ABC church for nine to . twelve months, (until August 2008). Kurt recalled that CJU was just over one year old when he started spanking CJU with a wooden spoon at the ABC services. After one service, Phil asked Kurt if he knew how to discipline CJU with a rod, and asked if he had questions. Kurt knew that if CJU made noise during a service, Phil wanted him to spank CJU with a wooden dowel. Kurt stated that it was always assumed at ABC that if your child was loud, they'd get spanked. Kurt described Phil as havlnq a "creepy overwhelming character" and stated, "I feared him.'" Kurt stated that the ABC members did what Phil said cir risk disobeying him. Kurt stated that he would simply end conversations, acting as if he accepted what Phil said.

Kurt stated that Phil told him to start (spanking CJU) with the wooden spoon and later graduate to the rod. Kurt then kept a wooden spoon in the diaper bag so he would have it at church. Kurt estimated that during the time he brought CJU to these services he spanked CJU about 25 to 50 times on his bare bottom (because Phil said that this was how to do it). Kurt described laying CJU across his lap, pulling down the diaper and spanking him two to three times with the spoon. Kurt stated that he tried to do this softly as neither he nor Patty liked the practice, but he went along with it.

Dep. Longley notedthat during the interview with Kurt, he was "really bothered" over what he'd done but was also afraid to go against Phil's word, knowing that Phil would take it out on him and his parents. Kurt informed Dep. Longley that he did not like doing the spanking and that it really bothered him. Kurt stated that he wished he would have stood up to Phil sooner.

Patsy' Ubert

On 12/23/2010 Deputy Richard Bennett spoke with Patsy Ubert, (hereinafter "Patty") who has a son, CJU, DOB: 10/26/2006. Patty indicated that she dated Kurtis Hahn for a period of time prior to August 2008 and attended his family's church (the ABC) during the summer of 2008. Dep. Bennett asked Patty about child discipline during church services and Patty indicated that she often witnessed children be taken away from the church service into another room to be disciplined. Patty stated that a child would be disciplined with some type of a wooden stick and that this was common knowledge within the church. Patty said that she could hear the discipline and that it was disturbing: "I heard a stick crack from another room" and then heard the cry of a child following the crack of a stick. Patty stated that this happened in Phil Caminiti's house during church services, Patty specifically recalled John Caminiti disciplining his younger daughter (TRC, DOB: 11/20/2007) in this way on two occasions that summer when she heard the crack from the stick at Phil's house. Patty said that on these occasions, John Caminiti came out of the room looking very angry. She described John being "red in the face" and his body seeming to be very tense with an angry facial expression. Patty stated that when she attended ABC services on Sundays and Wednesdays, it seemed as though there was at least one child getting disciplined at each service.

Leland and Kim Gander

On 11/22/2010, Deputy S. Dura-Jacobs met with Leland (Lee) and Kim Gander at their Mazomanie residence. The Ganders attended the ABC from March 2006 until September 2008, where everyone considered Phil Caminiti to be the "lead eider." They explained that the elders are the teachers and are responsible for the spiritual growth of the congregation. The services. were held at the members' homes on Sunday mornings and evenings; while on Wednesdays, the conqreqation broke into smaller, informal groups known as "mini churches."

Kim and Lee Gander explained that in August of 2008, the ABC sent letters to the members, saying that the church had neglected them and the elders wanted meet with the families to assure they were maturing in their spiritual growth. Lee said he met with Phil Caminiti and Todd Barsness, but that Phil "did all of the talking." Lee said that the meetings "did not go well" and that Phil made "assumptions" and was comparing families spiritually against one another. Lee said Phil was "combing through lives" to determine where there was "sin." Lee said that Phil accused Lee's family of "not being up to standards." Lee also stated that Phil's approach was "unloving" and Phil told Lee that if he was not going to agree then Lee could leave the ABC. Lee felt that Phil did not want anyone to question the strength of hls authority and felt like spiritual actions were being. "forced a·hd dictated." Lee said that he· and his family made the decision to leave the ABC.

Lee and Kim have a daughter, SG. Lee said that once P~iI showed Lee how they should be spanking SG by showing hima wooden dowel, approximately 3/4" in diameter

'and one foot long. Lee said Phil hit his own leg as hard as he could and said, "Oh, that really. hurts." Lee said SG was over a year old at this time and he did not agree with Phil on this issue. When Lee asked Phil if he could use a different size dowel, Phil said that he should really use the size that Phil showed him. Lee again said he did not agree with Phil, but kept his thoughts to himself and .decided to "ignore" Phil's advice. Lee said if he'd hit SG as hard as Phil showed him, Lee would have considered it abuse and she definitely would have had bruising.

Lee and Kim stated that they thought' Phil's expectations of small children were "too high" and that the .discipline taught there was a main reason they left the ABC. Kim explained that children as small as two years old are expected to sit still and look straight ahead during church services.

Valerie Flegel

On 11/22/2010 Dep. Timothy Blanke interviewed Valerie Flogel who had belonged to the ABC but left in the fall of 2008. Dep. Blanke asked about corporal punishment, exercised in the church, and Ms. Floqel stated that Phil Caminiti preached that a child three months old could and should be spanked. She stated that Phil was a believer in the rod, specifically a wooden dowel, as a form of punishment for children and that he cited several verses of the Bible, as his authority. Ms. Flogel stated that when a child misbehaved at an ABC service, the child would be taken into a back room and struck with the rod. Valerie stated that she never saw the striking but did hear sounds consistent with someone being struck with an object. Ms. Flogel explained that she found many of Phil's beliefs and practices inconsistent with what she considers Christian values, explaining that Phil is very controlling of members and the practice of shunning has led to problems with the children.

Daniel Urban

On 11/22/2010, Det. Bill Hendrickson lntervlewed Daniel Urban' who explained that he and his wife followed from the CSBF church to the ABC because three out of the four pastors were leaving to form the ABC. Mr. Urban stated that after this split of the congregations, things began to change significantly. Mr. Urban advised that Phil Caminiti and his brother John headed up the split and that Phil wanted to do things "his own way" and did not want any accountability to the elder system within the previous church. Mr. Urban stated that things started to get kind of "weird" as members were expected to follow . Phil's rules, down to what they thought, believed, behaved, ate or drank. Mr. Urban stated that anyone that disagreed with Phil was essentially shunned by others within the organization: "If Phil disagreed with you, you're in trouble."

Mr. Urban stated-that Phil wanted people within the ABC to be "just like him" and

that this was' a significant change from the 'first church, which promoted diversity. Mr. '

STATE OF WISCONSIN - VS - Philip B Caminiti

Urban specifically recalled one of Phil's sermons in which Phil referred to himself as a prophet and this proclamation resulted in their family's decision to leave the ABC.

Mr. Urban advised that he witnessed other troubling things including one occasion

in which John Caminiti held up his crying three or four month-old child, and said "no" very loudly and harshly directly in the baby's face (as if it was going to make the three to four month old child stop crying). Urban advised that he witnessed John attempt to control his toddler's 'movements during services by standing on the child's hands or feet in an attempt to keep them from crawling around. Mr. Urban recalled. being troubled when he saw this behavior. Mr. Urban also recalled Phil actually commending John in front of the group for doing a good job in disciplining his children. Mr. Urban stated that he thought this behavior was very odd, as though John was following Phil's direction.

BACKGROUND INVESTIGATION Timothy J. Detwiler

On 01-05-11, Det. Bill Hendrickson interviewed Timothy J. Detwiler, who is an associate provost at Cornerstone University in Grand Rapids, MI and has held that position since 1979. Mr. Detwiler advised that the Grand Rapids School of Music and the Bible (GRSBAM) closed in the 1990's and about the same time the Cornerstone Baptist College became Cornerstone University, which absorbed both institutions.

Det. Hendrickson inquired about any Bible school possibly advocating the use of corporal punishment with a dowel or rod against young children as a means of discipline. Mr. Detwiler stated that the Biblical reference to "spare the rod, spoil the child," encourages firm guidance and discipline within the home, however, does not encourage striking or injuring children. Mr. Detwiler stated that their institution does not teach this as" any part of their curriculum and was unaware of any institution in the area advocating this type of practice. Mr. Detwiler stated that the use of a rod or dowel is not something that was taught in accordance with Scriptures.

William T. Brew

On 01/5/2011, Detective Dawn Johnson interviewed William T. Brew who is presently retired. Mr. Brew taught at Cornerstone University for approximately 13 years and prior to that, worked at the GRSBM for 20 years. The GRSBAM is a three-year college. Mr. Brew was also the academic dean for about five years prior to retiring.

Det. Johnson specifically asked about the Bible's reference to the "rod" and what that meant. Mr. Brew advised that the word "rod" is used in the "figurative sense" and means discipline. Mr. Brew explained that the passage "spare the rod and spoil the child" does not refer to taking a rod and hitting a child but refers instead to disciplining children to put them on the right path.

Det. Johnson advised Mr. Brew regarding the investigation surrounding Phillip Caminiti, the ABC and its disciplinary practices including information that Phil was teaching , that children as young as 6 weeks old can be spanked with a wooden instrument on the bare buttocks. Mr. Brew stated that he found this alarming .and stated that neither their church nor university teaches this.

STATE OF WISCONSIN - VS - Pbilip B Caminiti Andy Smith

On 01/6/2011, Detective Mary Butler interviewed Andy Smith who is currently a professor at Cornerstone University and has been so for about 26 years. Mr. Smith has a bachelor's degree in religion alonq with a master's in humanities and seminary/pastoral; and is presently the pastor at the Grandville Bible Church. Mr. Smith was asked about the Biblical reference to "spare the rod, spoil the child and responded that he believes. this is a metaphor for discipline and in no way believes the reference means a person should hit a child with a rod. Regarding the practice of "shunning,'" Mr. Brew stated that this is never taught in his church and is not what is meant by the Bible.

Les Lofquist

On 01/11'/2011, Det. Bill Hendrickson interviewed Les Lofquist who works for IFCA International in Grandville, MI. Mr. Lofquist stated that, as part of his employment, he supervises roughly 1,000 pastors in about 1,200 churches, including the pastor(s) at the CSBF church in Black Earth, WI. Mr. Lofquist stated that P.hil Caminiti is no longer someone he monitors or supervises as part of his employment, as the ABC is not a member church.

Mr. Lofquist stated that he first met Phil Caminiti through their involvement in a university referred to as the GRSBAM. Mr .. Lofquist stated that there was no curriculum at the school which included corporal punishment or teaching the use of a rod or dowel to spank children as a form of discipline. Mr. Lofquist explained that the GRSBAM dissolved due to financial issues and become Cornerstone College. Mr. Lofquist told Det. Hendrickson that of "all the certain things in the

world," the use of any type of rod or dowel to discipline children was completely "out in left field" in light of the teachings and practices at the GRSBAM.

Mr. Lofquist further stated that the shunning practices of Phil 'Caminiti and the ABC are completely "incompatible" with the beliefs and practices of their many churches and it was not something that was taught at the GRSBAM. Mr. Lofquist stated that Phil's behavior and teachings are completely contrary to everything that he has been taught.
