Title and Definition

1. This Law shall be called the Myanmar Special 1/ þOya'udk jrefrmtxl;pD;yGm;a&;ZkefOya' [k ac:wGif
Economic Zone Law. ap&rnf/
2. The following expressions contained in this Law shall 2/ þOya'wG i f yg&S d a om atmuf y gpum;&yf r sm;onf
have the meanings given hereunder: azmfjyygtwdkif;t"dyÜm,foufa&mufap&rnf-
(a) Special Economic Zone means the zone (u) txl ; pD ; yG m ;a&;Zk e f qd k o nf r S m tpd k ; &tzG J U u
notified and established by the Government EdkifiHawmf\ pD;yGm;a&;udk t&Sdeft[kefjzifh ydkrdkzGHUNzdK;
under this Law as the Special Economic Zone wdk;wufapa&;twGuf oifhavsmfaom ae&mwGif

(e) Investor means the local or foreign person or

(g) “Service” means a service carried out for (q) 0ef a qmif r I v k y f i ef ; qd k o nf r S m tcaMu;aiG ?

expression includes trading business, ay;jcif;udkqdkonf/ ,if;pum;&yfwGif ukefoG,frI
entertainment business, hotel, guest house and vkyfief;? azsmfajzrIvkyfief;? [dkw,f? wnf;cdkcef;ESifh
restaurant business, tourism business and pm;aomufqkdifvkyfief;? c&D;oGm;vma&;vkyfief;
businesses determined by the Government, ESifhtpdk;&tzGJUu 0efaqmifrIvkyfief;jzpfonf[k

(h) Government means the Government of the

(i) Central body means the Central Body relating EdkifiHawmf jynfaxmifpktpdk;&tzGJUudkqdkonf/
to the Myanmar Special Economic Zone (ps) A[d k t zG J U qdkonfrSm tpdk;&tzGJUu þOya't&
formed by the Government under this Law; zG J U pnf ; aom jref r mtxl ; pD ; yG m ;a&;Zk e f q d k i f & m
(j) Responsible Ministry means the Union A[dktzGJUudkqdkonf/

body formed under this Law by the Central qdkif&m vkyfief;rsm;udk taumiftxnfazmf&mwGif
Body for enabling to support the Central Body A[dt k zGUJ udk vkyif ef;tvdu k f taxmuftuljyKEikd af &;
according to the work, in implementing the twGuf A[dktzGJUu þOya't& zGJUpnf;aom
works relating to the Special Economic Zone; vkyfief;tzGJUudkqdkonf/

(l) Management Committee means the Special ( X ) pD r H c ef U cG J r I a umf r wD qd k o nf r S m ouf q k d i f & m
Economic Zone Management Committee txl;pD;yGm;a&;ZkefwGif pDrHcefYcGJa&;ESifh BuD;Muyfa&;
formed by the Central Body under this Law to vkyfief;rsm;udkaqmif&Guf&ef A[dktzGJUu þOya'
carry out the administration and supervision t& zGJUpnf;aom txl;pD;yGm;a&;Zkef pDrHcefYcGJrI
works in the relevant Special Economic Zone. aumfrwDudk qdkonf/

3. The Objectives of this Law are as follows:

5. The Special Economic Zone includes high tech Edkifonf/
industrial zones, information and telecommunications 5/ txl;pD;yGm;a&;ZkefwGif tqifhjrifhenf;ynmpufrIZkefrsm;?
technology zones, export processing zones, port area zones, owif;tcsuftvufESifhqufoG,fa&; enf;ynmZkefrsm;? ydkYukef
ypön;f xkwv f yk rf ZI ek rf sm;? qdyu
f rf;e,fajrZkerf sm;? axmufyahH &;ESihf
logistics and transportation zones, scientific and technological
o,f,lydkYaqmifa&;Zkefrsm;? odyÜHESifhenf;ynm okawoeESifhzGHUNzdK;
research and development zones, service business zones, sub-

transportation, storage, hotel and tourism, uk e f o d k a vS m if a &;? [d k w ,f E S i f h c &D ; oG m ;vma&;?
education and health, residential quarters, ynma&;? usef;rma&;? vlae&yfuGufrsm;? tajccH
infrastructure supply and support centers, green taqmufttHk jznfhqnf;axmufyHha&;Xmersm;?
areas which conserves and protects the natural obm0ywf0ef;usif xde;f odr;f umuG,o f nfh pdr;f vef;
environment, recreation and resort centres; e,fajrrsm;? tem;,ltyef;ajzpcef;rsm; ponfh
(c) infrastructure construction businesses such as 0efaqmifrIvkyfief;rsm;?
road, bridge, airport, port, electricity, ( * ) vrf;? wHwm;? avqdyf? blwm½Hk? qdyfurf;? vQyfppf?
communication and water supply environment qufoG,fa&;? a&&&Sda&;? ywf0ef;usifxdef;odrf;a&;
conservation and protection, and wastes ESifh pGefYypfypönf;rsm; xdef;odrf;a&;ponfh tajccH

7. The Special Economic Zone established under section 7/ yk'fr 4 t& wnfaxmifonfh txl;pD;yGm;a&;Zkefonf -
4 shall be:
(u) EdkifiHawmfucsrSwfxm;onfhpD;yGm;a&;rl0g'rsm;ESifh
(a) a zone implemented under this Law in

accordance with the economic policies adopted

by the State;

(b) a zone managed according to the nature of the
work of Special Economic Zone in accordance
obm0tvdkuf pDrHcefUcGJonfhZkefjzpf&rnf/
with this Law; ( * ) tpdk;&tzGJU\ oabmwlnDcsufjzifh A[dktzGJUu
(c) a zone invested and used in the currency owfrSwfonfh aiGaMu;jzifh &if;ESD;jr§KyfESHjcif;ESifh
determined by the Central Body with the oHk;pGJjcif;rsm;jyKonfhZkefjzpf&rnf/
approval of the Government; (C) yk'fr 3 yg &nf&G,fcsufrsm; jzpfxGef;vmapa&;
(d) a zone which conforms to the international twGuf ukefypönf;xkwfvkyfa&;ESifh wifydkYa&;wdkUudk
commercial market based on goods processing

8. The State shall encourage the investors in the Special 8/ EdkifiHawmfonf txl;pD;yGm;a&;ZkefwGif &if;ESD;jr§KyfESHol

(b) businesses which will further promote the (u) tqifhjrifh enf;ynmjzifh xkwfvkyfrIvkyfief;rsm;?
economic development of the State; ( c ) EdkifiHawmf\ pD;yGm;a&;zGHUNzdK;wdk;wufrIudk ydkrdkjzpfxGef;
aprnfhvkyfief;rsm;?
(c) businesses which will further promote trade and
( * ) uk e f o G , f a &;ES i f h 0ef a qmif r I y d k r d k w d k ; jrif h a prnf h
service;

(d) businesses which will further promote the

a suitable person as Chairman and suitable
