SUbject: Restrictions on Accepting Assistance

Jim - I'm not sure who is in your working group but an issue came to my attention this morning that needs to be cranked in.
libya is apparently interested in making a cash donation. Like other terrorism list states, however, there are limitations on
financial transactions with the libyan government involving donations. I believe OFAC may need to issue a license and
have so advised NEA.
/
I don't know if we have looked at the larger question of legal restrictions on assistance that might arise through sanctions
programs. There also may be import restrictions or customs provisions, as well as limits on foreign vessels and aircraft. :
If the Secretary generally wants to be receptive to foreign offers, l may need to track this down.

OFAC says a license would be necessary, but can be done quickly and easily and doesn't require Congressional
Notification. We'll see if the Libyans want to proceed -- we've told them the best way to do it is via a donation to the
American Red Cross (which is what we're recommending to all countries).

Sent: Sunday. september 25. 2005 8:58 PM
To: Harris, MichelleF; McCarthy, Deborah A
Subject: NEA: Status of Follow-up actions on Hurricane Katrina

I sent the message below to NEA desks on Friday at noon. Here is the status of respoa~.a~gt__ ~
COB Friday. Apologies for missing the 1:00 deadline; I was out all afternoon at a large retirement
ceremony for our office. Note that there is a request for guidance as regards Jordan. Will follow up
'-
on Monday to try to get more complete responses.

Thanks.

These comments are relatively unedited cut-and-paste responses from desk officers.

The MRN for the thank you cable to Israel for the offer of assistance is STATE 174118

The matrix for Israel is totally screwed up. I tried to correct this once, but was told the Task Force
would not remove anything from the matrix. The GO! offers of assistance are repeated multiple times
, with slight variations, all garbles of a couple of main offers (problem partly caused by GOI calling every
agency in town to reiterate their assistance offers). In the matrix, line 240 is accurate, line 243 is
accurate, lines 245 and244 are the same thing, line 246 is accurate, line 247 and 249 deal with the same
offer, Jine 250 is accurate. AU other lines in the matrix concerning Israel are either inaccurate or garbled
repeats of the offers mentioned in the lines I just mentioned and should be deleted. AU GOI offers were
eventually declined except for the relief flight mentioned in the second document.

Jordan

We conveyed to the GOJ a FEMA/DHS request for first aid kits without pharmaceuticals. The
Jordanians were studying the request and attempting to ascertain if they could fulfill it. If these items are
no longer needed, please let me know so we cab officially tell the Jordanians.

I don't think a thank-you cable is needed for Jordan blc Secretary Rumsfeld already sent a thank-you
letter to King Abdullah, and the King received numerous thank-yous in person during his recent visit to
the U.S. Please advise.

Lebanon

No offer of help.

Libya hasn't made a specific offer of help. They would require an OFAC waiver to provide assistance;
we told them that.

Morocco

Morocco has a thank you cable in process with SIBS waiting to go out - apparently, they still have a

number to work through.

Palestinian Authority

The Palestinian Authority made a $10,000 donation to the American red Cross. The Matrix reflects this,
but the second document you sent [the "Cables Matrix" attachment in Michelle's e-mail of 10: 12 a.m.
FridayJ does not, and should be changed to reflect the PA contribution. The thank you cable for the PA
was STATE 172112.

Tunisia

The stuff arrived, the acceptance cable went out, and the thank you note is still with S staff.

Colleagues --

The chain below is a little hard to follow, but here is what is needed on a reasonably quick basis (the
urgency is principally to close out Katrina-related business before we are inundated with Rita over the
weekend).
,.
1. Look at the following chart of needed follow-up actions to fill in the blanks and close the thank-you
loops on gifts received from NEA countries. There actions for most, though not all, NEA desk
officers.

NEA Follow-up
actions09 23 05...

This table is cross-referenced to the master matrix, in step 2 below (which is SBU/close hold).

2. Check in this master matrix for any items for your countries that I may have missed.

Working -
International Offer...

3. Send me an e-mail via the reply function (don't fill in boxes in the matrix) with responses to the
"actions needed" items or other things you have spotted in the matrix. I'll assemble everything and
send one response to the WG.

4. If you need to draft a thank-you reply cable, the models to use are below. Generally, I don't think
they need a front office clearance (beyond a cc to the staff aides). Send them directly to Michelle
Harris for approval, cc to me, and push them out.

5. Drop dead date is allegedly 1:00 today, but under the circumstances, mid-afternoon will be more
than acceptable. I'll be out 3-5 and will send then.

Thanks.
