WHEREAS, pursuant to Federal Rules of Civil Procedure 4, 6, and 12, the current deadline for defendant the U.S. Office of Personnel Management (“OPM”) to respond to plaintiff’s First Amended Complaint is March 24, 2010; WHEREAS, pursuant to Federal Rules of Civil Procedure 4, 6, and 12, the current deadline for defendant John Berry, Director of OPM, in his official capacity, to respond to plaintiff’s First Amended Complaint is May 10, 2010;

WHEREAS, the parties have agreed that defendants may respond jointly to the First Amended Complaint on May 10, 2010; and WHEREAS, this stipulation and plaintiff’s agreement thereto does not constitute a delay of these proceedings, IT IS STIPULATED by the parties that the deadline of defendant OPM to answer or otherwise respond to plaintiff’s Complaint is extended to May 10, 2010, pursuant to Civil L.R. 61(a).
