Intelligence (MI), Inter Services Intelligence (ISI) and the Directorate of Intelligence Bureau (IB) with a view to overcoming law and order because they are also answerable to the provincial government as well as courts under the Constitution, Chief Justice Iftikhar Mohammad Chaudhry said in an order.
A two-judge bench comprising the chief justice and Justice Ghulam Rabbani has taken up the petition filed by Balochistan High Court Bar Association President Hadi Shakeel seeking protection of people s life and property. The petition has cited incidents of brutal murder of lawyers.
Tuesday s hearing was conducted by two judges because the third member of the bench, Justice Mohammad Sair Ali, is reported to have developed a cardiac problem.
Balochistan s Chief Secretary Ahmad Bakhsh Lehri, who submitted a comprehensive report on the situation, informed the court that the provincial government was taking steps to hold much-awaited local government elections as early as possible, saying elected representatives at the grassroot levels always helped in improving the situation.
The unfortunate aspect of the matter, the chief justice observed, was that criminals responsible for offences like target killings, kidnapping for ransom, abductions and suicide attacks had by and large never been arrested. Same is the situation in tracing people who have gone missing.
The chief justice said the situation in Balochistan had reached an alarming proportion with professors, doctors and teachers leaving the province, where children could not go to schools and even the national anthem was not being sung by them.
Balochistan s Advocate General Salahuddin Mengal informed the court that the provincial government had approached former prime minister Mir Zafarullah Jamali and a grand tribal jirga and an all-parties conference would be held this month to identify genuine grievances of people and suggest remedies.
The chief justice repeatedly asked the provincial government to strictly adhere to the Constitution which, he said, provided answers and solutions to all the malaise facing the province. But, he deplored, the federal government perhaps did not have any idea about the gravity of the situation in Balochistan.
the court said that although long-term measures had been suggested. The court said that efforts should be accelerated to recover kidnapped advocates Zahid and Syed Zahid Jussain. The chief secretary said that kidnapped judges District and Sessions Judge Sibi Jan Mohammad Gohar and Senior Civil Judge Mohammad Ali Kakar had been recovered. Three suicide attacks have been reported. The report suggested that commitments made by Prime Minister Yousuf Raza Gilani while announcing the Balochistan package should be implemented in letter and spirit to improve the situation in the province. . no short-term steps had been taken to ensure immediate improvement of the law and order situation. As pointed out repeatedly it is one of the fundamental rights of all subjects of the state that they should be protected against all sorts of hazards. Fifty-nine people were kidnapped in 2010. another 41 in 2009 and 47 in 2008. Bodies of 123 people dumped in different places in very precarious conditions have been found.Prima facie. Agha The chief secretary conceded in his report that 56 of the 123 disappeared people in Balochistan were still missing. Over 170 tankers were damaged. 74 people have been recovered as a result of raids by law-enforcement agencies while 48 got their freedom after paying ransom. According to the report. Saleem Tahir. Thirty-six people were killed in attacks on 72 Nato containers. the court order said and added that was the reason protection was not being provided to the life and property of citizens under Article 9 (security of person) of the Constitution. it said. the facts and figures presented in the report depict that the situation of law and order in the province is bad. Referring to the Balochistan government s report which was also made part of the order. including one on a convoy of the Balochistan chief minister. Twenty-two people have been offloaded by their abductors because of constant pressure of raids.
The report said that entire Balochistan was being fed by a single power supply line form the main grid. Senator Bazenjo said dead bodies of 180 people had been found from various parts of the province during the last four months. stable and thriving Balochistan is in stark contrast with the harsh realities of the ground in the Province. what is going to prove to be the last straw is anybody's guess. or has the last straw already been placed in form of this apathy? Kayani s rhetoric about a strong. neglect and excesses. human rights violations and excesses by intelligence and security agencies. 15 had been fully implemented . The callous and heartless approach of the Federal Government and the continued atrocities by the law enforcement agencies are all adding up as the proverbial straw on the camel's back. Balochistan is rich in mineral wealth. Speaking on points of order in the Senate. Balochiss ISLAMABAD .Further. Senator Ismail Buledi. it remains unlikely that the suppurating wounds inflicted and constantly renewed in Balochistan will heal. observing that a lot of work had been done on paper and nothing on the ground. . out of 61 proposals in the package. Kalsoom Perveen and Mohabbat Khan Marri expressed their concern over the killing of innocent people and asked the government to do the needful for the betterment in Balochistan. The NASC was. but remains poor because of Islamabad's relentless exploitation. however. and that violence will approach an end in the foreseeable future. president of the Baloch Unity Organisation. thus observed. Mutilated bodies of young people are being found from various parts of the province on a daily basis. He said neither the PM nor the government were concerned about the situation in the province. Lashkari Raisani. The alienation keeps on increasing and the youth keeps joining the ranks of fighters.Senators from Balochistan on Friday put their voice together to draw the government s attention towards the very alarming law and order situation in the province. Rehana Yahya Baloch. and reconcile poorly with Islamabad s overwhelming reliance on relentless military suppression.
saying Baloch students were being made the target. While condemning the two attacks. Leader of the House Nayyar Hussain Bukhari also condemned the incidents and expressed grief over the loss of precious lives. Speaking on a point of order.Senator Buledi said finding mutilated bodies had become a permanent feature of Balochistan. Nawab Lashkari Raisani and Mohabbat Khan Marri also invited the attention of the prime minister towards what they called an alarming law and order situation in the province. Later. the House passed a resolution condemning attacks on Fazlur Rehman and expressed grief and sorrow over the loss of innocent lives in the two incident. Senator Haroon Akhtar said 200 industrialists had moved to Bangladesh during the last six months with an investment worth Rs 70 billion and there were reports that more were in the process of investing in other countries .The senators also condemned attempts on the life of JUI-F leader Fazlur Rehman and urged the government to take appropriate measures for security of the people. Senate Chairman Farooq Naek asked the leader of the House to conduct an inquiry into the attacks and submit a report in the House within a week. adding that even the Balochistan chief minister and governor were not safe in the province. He observed that the chairman was not courteous enough to give them time to speak their concerns in the House. Senator Zahid Khan said his party members were on a silent protest against the attitude of the Senate chairman. Rehana Yahya Baloch also expressed concern over the Balochistan law and order situation. Senator Kalsoom Perveen asked the government to convene a roundtable conference on the Balochistan issue. Professor Ibrahim Khan staged a token walkout from the House as a mark of protest against the increase in POL prices.
