The final rule implementing the International Management Code for the Safe Operation of Ships and for Pollution Prevention (International Safety Management (ISM) Code) was published in the Federal Register of 24 December 1997 (FR, Vol. 62, No. 247). The preamble to the final rule discusses the applicability of the ISM Code to various classes and sizes of vessels. Cmas from the U.S. Coast Guard office in Rotterdam, regarding crew boats and the ISM code. We operate 5 U.S. flag crew boats in Nigeria West Africa. The vessels are all under 100 GRT regulatory tonnage; they vary in length from ? 15 ft to 745 ft and carry approximately 60 offshore workers to offshore installations. There is some concern within the company that the vessels may be included into the first phase of ISM on the I July 98, when as a company we are making long term plans to comply with our supply and support vessels before the second phase in 2002. What I learned was that Tidewater has been very careful to specificalb request no International voyage endorsements for any of our crewboats, with the sole exception of the Major Tide. In the case of the Major Tide, the COI stipulates that while on a’n international voyage, no more than 12 “passengers” may be on board, If my recollection of our conversation yesterday is correct, this should mean that since the vessel avoids SOIAS, it should also avoid the early ISM requirement of Ju!y 98? We would be grateful if you could look o;er the attached COl’s and advise us if you see anything that may put us into the earlier ISM compliance window.
