RWA Federation Ghaziabad participates in State Level meeting on UP Apartment Act in Lucknow

Model Sale Deed should be made to counter monopoly of the Builder
5 Jul 2011, Awas bandhu, Jan Path, Hazrat Ganj, Lucknow : A meeting of the select RWAs from all over Uttar Pradesh, UP Architects Association, Builders and Vice Chairmen of the Development Authorities or their representatives took place today in the conference room of the Secretary Awas and Executive Director Shri Alok Kumar, IAS. A delegation of the RWA Federation Ghaziabad under the leadership of its Chairman Col Tejandra Pal Tyagi and comprising its Gen Secy Shri Sanjay Singh, Vice Chairman(City Zone) Shri R K Garg, Gen Secy Eden Park Shri Mohit Saxena and Co-ordinator Indrapuram Zone Smt Monalisa Sinha, participated in the meeting on UP Apartment Rules 2011 framed on the UP Apartment Act 2010. In a huge meeting of the representatives of the Builders, RWAs and the Officers of the Development Authorities from all over Uttar Pradesh, the RWAs of Ghaziabad, Agra and Lucknow were prominent in putting across meaningful suggestions. Some of the points raised by the RWA Federation Ghaziabad are as under :1. Sale Deed : Generally the sale deed prepared by the Builder is one sided. It should cater to the interests of the Occupant too. Therefore, a model sale deed should be prepared and made effective uniformly for the entire state. The point was noted for compliance. 2. Minimum Term : A minimum term for the Flat Owners Associations was proposed to be raised from the envisaged one year to two years. Point was conceded. 3. Roof Rights : Roof rights should not be sold to either the Builder or the Apartment Owner or to any other Society. It should be treated as a common facility. Point was noted for consideration. 4. Compounding and FAR : Form of declaration (Form A) needs fine tuning. The plans are prepared after taking in to consideration the bearing capacity of the soil, the vibrations effecting the Geo-Physical movements, entire mass of the structure, the extent of the Open Areas for common facilities etc. Therefore modifications in the designed plan should not be made in the name of enhancement of the Floor

Area Ratio or the Compounding. Compounding should be done in the rarest of the rare cases. It should be an economical exception and not a rule. Model By Laws : Exactly same type of Laws for the operation of the Flat Owners Association may not serve the purpose. Hence, they should be amendable by a majority vote instead of two third vote.
