Procedures for the conduct of and participation in ACRS meetings were published in the Federal Register on September 29, 2005 (70 FR 56936). In accordance with those procedures, oral or written views may be presented by members of the public, including representatives of the nuclear industry. Electronic recordings will be permitted only during the open portions of the meeting. Persons desiring to make oral statements should notify the Cognizant ACRS staff named below five days before the meeting, if possible, so that appropriate arrangements can be made to allow necessary time during the meeting for such statements. Use of still, motion picture, and television cameras during the meeting may be limited to selected portions of the meeting as determined by the Chairman. Information regarding the time to be set aside for this purpose may be obtained by contacting the Cognizant ACRS staff prior to the meeting. In view of the possibility that the schedule for ACRS meetings may be adjusted by the Chairman as necessary to facilitate the conduct of the meeting, persons planning to attend should check with the Cognizant ACRS staff if such rescheduling would result in major inconvenience. In accordance with Subsection 10(d), Pub. L. 92–463, I have determined that it will be necessary to close a portion of this meeting noted above to discuss and protect information classified as National Security information as well as safeguards information pursuant to 5 U.S.C. 552b(c)(1) and (3). I. Introduction The Nuclear Regulatory Commission (NRC) continues to prepare and issue Interim Staff Guidance (ISG) documents for fuel cycle facilities. These ISG documents provide clarifying guidance to the NRC staff when reviewing licensee integrated safety analysis, license applications or amendment requests or other related licensing activities for fuel cycle facilities under 10 CFR part 70. FCSS–ISG–10 has been issued and is provided for information. II. Summary The purpose of this notice is to provide notice to the public of the issuance of FCSS–ISG–10, Revision 0, which provides guidance to NRC staff to address justification for minimum margin of subcriticality for safety relative to license application or amendment request under 10 CFR part 70, subpart H. FCSS–ISG–10, Revision 0, has been approved and issued after a general revision based on NRC staff and public comments on the initial draft. III. FCSS Interim Staff Guidance—10, Revision 0; Justification for Minimum Margin of Subcriticality for Safety Prepared by Division of Fuel Cycle Safety and Safeguards Office of Nuclear Material Safety and Safeguards Issue Technical justification for the selection of the minimum margin of subcriticality for safety for fuel cycle facilities, as required by 10 CFR 70.61(d) Introduction 10 CFR 70.61(d) requires, in part, that licensees or applicants (henceforth to be referred to as ‘‘licensees’’) demonstrate that ‘‘under normal and credible abnormal conditions, all nuclear processes are subcritical, including use of an approved margin of subcriticality for safety.’’ There are a variety of methods that may be used to demonstrate subcriticality, including use of industry standards, handbooks, hand calculations, and computer methods. Subcriticality is assured, in part, by providing margin between actual conditions and expected critical conditions. This interim staff guidance (ISG), however, applies only to margin used in those methods that rely on
