1 Samsung hereby moves to remove the following from ECF:

2 1. Exhibit 5 to the Declaration of Dana K. Powers In Support Of Samsung’s Motion in
3 Limine to Exclude Privileged Documents Produced Pursuant to the Court’s Implied Waiver
4 Order, submitted electronically on September 2, 2008 as Docket No. 1074-6 in Case No. C 05-
5 02298 and Docket No. 2125-6 in Case No. C 05-00334; and
6 2. Samsung’s Trial Brief, submitted electronically on September 8, 2008 as Docket No.
7 1091 in Case No. C 05-02298 and Docket No. 2152 in Case No. C 05-00334.
8 These documents were incorrectly filed and lodged with the court. Exhibit 5 is an August
9 16, 2008 letter that includes, in error, an attachment containing Samsung's privileged and
10 confidential information. The trial brief listed above contains information designated as Outside
11 Counsel Only that should have been redacted. The ECF helpdesk has already been contacted and
12 they have promptly locked the documents in question and are awaiting the Court’s order to
13 remove them from the record.
14 Samsung plans to re-submit these documents today and lodge copies with the clerk’s
15 office.
16 For the foregoing reasons, Samsung respectfully requests that the Court grant Samsung’s
17 Motion To Remove Incorrectly Filed Documents.
