FINAL DRAFT-CONSTITUTION AND BY-LAWS OF THE AGUSAN NATIONAL HIGH SCHOOL FACULTY, EMPLOYEES AND RETIREES ASSOCIATION (ANHSFERA)

ARTICLE I-NAME Section 1The name of the organization shall be the Agusan National High School Faculty, Employees and Retirees Association.

ARTICLE II-OBJECTIVES Section 2The objectives of the association shall be: a. To work for the intellectual, cultural, social, moral, economic welfare of the members. b. To establish mutual understanding among members themselves in particular and with students, parents, officials and the people in the community in general. c. To work for the recognition of teaching as a worthy profession by rending quality services. d. To protect the rights and dignity of all members. e. To inculcate a greater sense of dedication to duty and service among members.

ARTICLE III-MEMBERSHIP Section 1All Agusan National High School teachers in active duty and members of the support staff of permanent status are bonafide members. Retirees of the association shall be classified as honorary members and as such shall have no voting rights and cannot be voted upon to hold any position of the Association. Any member, who by promotion (with appointment) is transferred to another school within the division of Butuan City, shall become an associate member by writing a letter of intent of his/her willingness to continue his membership but shall have no voting rights and cannot hold any position of the Association. And as an associate member shall pay all fees such as membership fee, medical aids, death aids and retirees benefit.

3.1- Any member who separates from ANHS for whatever reasons shall be considered an associate member upon submission of letter of intent to continue his/her membership to the Association. Section 4The Association, through the departments concerned, shall inform the retirees and the associate members of its affairs, encourages them to attend all activities and remind of their obligations to the Association.

ARTICLE IV-MEMBERSHIP FEES Section 1Regular members shall pay an annual fee of P50.00 on the first month of the school year and for new members upon application for membership to the Association. Honorary members are required to pay only the death aid benefit of P200.00. Associate members shall pay the medical and death aids prescribed by the Association. Failure to pay of billedpayments of the above mentioned aids for six (6) consecutive months shall mean forfeiture of the said benefits.

ARTICLE V-OFFICERS Section 1The officers of the Association shall be: President, VicePresident, Secretary, First Treasurer, second Treasurer, Auditor, P.I.O., two (2) Business Managers, two (2) Liaison Officers, and two (2) Peace Officers.. They shall be elected through secret balloting by single nomination by the members present in a simple majority during the second regular meeting of the school year and shall serve for 1 term for two years and 1 reelection. Department Treasurers for the current school year shall be deputized as department representatives who shall attend regular meetings called by the president and shall disseminate all matters discussed therein.

ARTICLE VI-BOARD OF DIRECTORS Section 1The affairs of the Association shall be managed by the Board of Directors composed of the officers of the Association, the Department Heads, the Administrator Officer and the immediate past ANHSFERA President with the principal as adviser.

Section 1.1- The Board of Directors shall be composed of the officers of the Association, the Department Heads, the Administrative Officer and the immediate past ANHSFERA President with the Principal as adviser. Section 2The Board of Directors in particular, the Department Heads, Administrative Officer and the immediate past ANHSFERA president shall serve as advisory and consultative committee on the affairs of the association.

ARTICLE VII-AMMENDMENTS Section 1The Constitution and By-Laws of the Association may be amended by two-thirds votes (2/3) of members present during any regular assembly meeting.

BY-LAWS ARTICLE 1-MEETINGS Section 1The regular membership meetings of the Association shall be held twice a year. Majority of the members present shall constitute a quorum. Special meetings of the Board of Directors may be called by the President anytime and majority of the members present shall constitute a quorum to do business. Majority of the members present constitutes a quorum.

ARTICLE II-COMMITTEES Section 1All committees of the Association shall be appointed by the President with the consent of the Board of Directors.

ARTICLE III-DUTIES Section 1The President shall call regular meetings through the Secretary and preside over the meetings, deciding with his/her vote all questions, which may result in a tie. He shall preserve order and defend the rights or prerogatives of the members, order all payments authorized by the Association of the Board of Directors. He shall represent the organization in all activities: civic, social or educational, and see to it that the Constitution and By-Laws and Resolutions adopted by the Board of Directors are strictly complied with. The President shall call regular and emergency meetings through the Secretary and preside over the meetings, deciding with his/her vote all questions, which may result in a tie. He shall preserve order and defend the rights or prerogatives of the members, order all payments authorized by the Association. He shall represent the organization in all activities-civic, social or educational, and see to it that the Constitution and By-Laws and Resolutions are strictly complied with. The Vice-President shall take the place of the President in case of the latters illness, absence or temporary inability to hold office and he shall have, in such cases, the powers and duties of a President. The Secretary shall keep a record of the proceedings of the Association and the Board shall be in charge of the safekeeping of all official records. There shall be two (2) Treasurers of the association. a. The first Treasurer is the custodian of the funds and properties of the Association; deposits all money in a bank in the name of the Association approved by the Board of Directors; keep a book of records and receipts of all funds disbursed fund only with the written consent of the Board of Directors and shall make an annual report of the finances of the Association. b. The second Treasurer collects all fees and dues from all members, receives all donations and issues corresponding receipts; he in turn, hands in all collections to the first treasurer for depositing. Section 5The Auditor shall count the cash and examine the book of accounts of the Association as often as he deems wise and necessary and submit to the Board of Directors through the President, a report of his work as such. His findings are final, appealable only to the Board of Directors. It shall be the duty of the Peace Officers to preserve order during general meetings of the Association.

It shall be the duty of the Peace Information Officers to give publicity on any of the association though the press radio or any other form of information and to inform the members of relevant issues and concern by upgrading the bulletin board of the Association. It shall be the duty of Liaison Officers to make the necessary contacts on follow-ups on matters concerning the affairs of the Association with other entities. It shall be the duty of the Business Managers to manage the affairs and business of the Association successfully.

Section 10- It shall be the duty of the ANHSFERA General P.T.A. Secretary to take the minutes of the meeting of the General P.T.A. Officers and report to the association whatever issues or concerns pertain to members or to school per se. Section 11- The affairs of the Association shall be supervised by the Board of Directors whose action on any matter not contrary to any of the expressed or implied provisions of the Constitution and ByLaws may be taken without the necessity of holding a meeting, merely by putting the notation Approved or Disapproved.

ARTICLE IV-UNIFORM Section 1All members of this Association shall wear the duly prescribed uniform and to observe dress code abiding to the CSC MC during the CSC Orientation for the purpose of dignity, unity, decency and discipline for the good of the service. A decent uniform attire shall be worn by teachers during their Physical Education and Practical Arts activities only. Any member not wearing uniform for 5 times a month without valid reasons shall be reported to the Principal and shall be dealt with per Civil Service Commission rules and regulations.

ARTICLE V-MORAL ETHICS Section 1As public servants holding a noble and respectable profession, all members of the Association are expected to observe unquestionable morality and integrity in and out of school and uphold the good name of the school in all places at all times.

ARTICLE VI-FINES Section 1Any member who shall fail to attend a regular meeting without prior written excuse addressed to the President shall pay a fine of twenty pesos (P20.00) and to pay fifty pesos (P50.00) on required affairs and activities of the association. No fine shall be collected for non-wearing of the prescribed uniform. All fines shall be collected by the department Treasurer at the end of the month for remittances to the Second Treasurer and to the First Treasurer for depositing.

ARTICLE VII-FUNDS Section 1The Association shall have funds which will be derived from the following sources, membership fees, fines, donations, contributions, rentals, proceeds from fund raising activities, interest of the Association deposited in the bank with the President and Fist Treasurer as signatories.

ARTICLE VIII-SEED MONEY Section 1Every bona fide member of the Association shall give a seed money of the two hundred pesos (P200.00) to take care of the immediate death/ medical benefits of the members which shall be replenished on the nearest pay day, amount of which shall be deposited in the bank with the President and the Second Treasurer as signatories.

ARTICLE IX-MEMBERSHIP BENEFITS Section 1Any member who retires in the accordance with existing retirement laws of the government shall receive a cash gift equivalent of ten pesos (P10.00) from each member for every year of service in the Agusan National High School. Any member who retires and/or separates from ANHS for whatever reasons shall receive a cash gift equivalent of ten pesos (P10.00) from each regular member for every year of service in the Agusan National High School. Any active member who gets married in the service of ANHS shall receive a cash gift of ten pesos (P.10.00) from each member.

A medical aid of ten pesos (P10.00) shall be given to any member who will undergo an ordinary illness, twenty pesos (P20.00) for minor operation, thirty pesos (P30.00) for major operation and one hundred pesos (P100.00) for special cases for cancer patients on his/her second chemotherapy, regardless of the amount to be incurred during the operation provided that he/she shall submit medical certificate or any pertinent paper for recording purposes, that he/she is confined in the hospital or to any medical institution; that he/she is recommended to receive medical aid by his/her immediate superior. Any bona fide member who shall die be given two hundred pesos (P200.00) by each member of the Association. In case any of the immediate relatives of the active member dies shall be given a financial aid in accordance with the following contributions: P100.00 P50.00 P50.00 P25.00 P15.00

A voluntary contribution may be given for immediate relatives not related by consanguinity. Section 5A financial aid of not more than ten pesos (P10.00) shall be given to any bonafide member facing legal suits related to work on duty of which shall be evaluated by the Board of Directors.

ARTICLE X Section 1This Constitution and By-Laws of Agusan national High School Faculty, Employees, and Retirees Association consisting of 7 Articles of the Constitution and 10 articles of the By-Laws shall take effect after having been reviewed by the Board of Directors and ratified by all members of the Association in a special meeting called by the President. A copy shall be signed by each member of the Board of Directors and be returned to the Association Secretary for file.
