thewordsmeant,itwasalmostlikeamusical
lullaby.Butthisiswheretheexpertscamein.
Afriforumbroughtevidencetoshowthatthe
waythesesongswererenderedbyMalema
madethemachant,andnotasong.Lamont
wasconvinced.Andthusthesongs/chants
seemedtolosesomeoftheirprotection.A
crucialpointhadbeenlostbyMalema.
ThesecondwastheamountoftimeLamont
spentexamininginternationaltreatiessigned
bySouthAfrica.Thesetreatiesspeakto
preventinggenocide.Lamontexplainedhow
mostgenocideshavestartedwithaperson
exhortingpeopletodosomething.That
thensnowballsintoagenocide.Simplyput,
Malemawassayingnowthatpeopleshould
killboers,andthatsdangerous.WhileLamont
didntmentionit,thewordcockroach,orthe
countryRwandaresonatedthroughoutthis
sectionofthejudgment.Thesetreatieswere
admittedasevidencebyAfriforum.Theywere
notproperlycounteredbytheANC.Amazingly,
almostexactlythesamethinghappenedinthe
Glenister/Scorpions/Hawksjudgment.There,
internationaltreatiessignedbyourgovernment
committedustocreatinganindependentanti
corruptionunit.Thissectionoftheargument
wasvirtuallyignoredbygovernment,butlater
foundbythecourttobebinding.Ohdear.
ThemainissueforLamontwaswhetherthe
songsconstitutedhatespeech.Thismeanthe
hadtolookattheliteraltranslation.Buthe
alsohadtolookattheirimpactonthetarget
groupi.e.boersandonthegroupofpeople
theywerebeingdirectedtoi.e.Malemas
audiencesatrallies.Malemasaudiences,says
Lamont,arepeoplewhoarepoliticallyaware,
theyarepoliticallysimilartoMalema.Thus
theywerepeopleinvolvedinthestruggle.

chantsknowingthattheywouldbetranslated

rightsandwrongsofacase.
Andnowtoenforcement.TheANCsaid
duringthetrialthatitwouldbeimpossibleto

of a generation who may know nothing of his teachings except that his is a face with some erstwhile
