JudgeCollinLamonthassetout,inacarefully
craftedjudgment,exactlywhyMalema,andthe
ANC,arenolongerallowedtosingtheDubula
Ibhunusongs.Hisreasonspointtotwothings.

Andtwo,thetensionsbetweentheEquality
Julius Malema must be wondering why nobody likes him at the moment. First he loses every application
before the ANCs national disciplinary committee, then he loses his hate-speech trial. Did he suddenly
get abandoned by his mojo the one that served him so well lately? And should we all be wondering

Afriforumbroughtevidencetoshowthatthe
waythesesongswererenderedbyMalema
madethemachant,andnotasong.Lamont
wasconvinced.Andthusthesongs/chants
seemedtolosesomeoftheirprotection.A
crucialpointhadbeenlostbyMalema.
ThesecondwastheamountoftimeLamont
spentexamininginternationaltreatiessigned
bySouthAfrica.Thesetreatiesspeakto
preventinggenocide.Lamontexplainedhow
mostgenocideshavestartedwithaperson
exhortingpeopletodosomething.That
thensnowballsintoagenocide.Simplyput,
Malemawassayingnowthatpeopleshould
killboers,andthatsdangerous.WhileLamont
didntmentionit,thewordcockroach,orthe
countryRwandaresonatedthroughoutthis
sectionofthejudgment.Thesetreatieswere
admittedasevidencebyAfriforum.Theywere
notproperlycounteredbytheANC.Amazingly,
almostexactlythesamethinghappenedinthe
Glenister/Scorpions/Hawksjudgment.There,
internationaltreatiessignedbyourgovernment
committedustocreatinganindependentanti
corruptionunit.Thissectionoftheargument
wasvirtuallyignoredbygovernment,butlater
foundbythecourttobebinding.Ohdear.
ThemainissueforLamontwaswhetherthe
songsconstitutedhatespeech.Thismeanthe
hadtolookattheliteraltranslation.Buthe
alsohadtolookattheirimpactonthetarget
groupi.e.boersandonthegroupofpeople
theywerebeingdirectedtoi.e.Malemas
audiencesatrallies.Malemasaudiences,says
Lamont,arepeoplewhoarepoliticallyaware,
theyarepoliticallysimilartoMalema.Thus
theywerepeopleinvolvedinthestruggle.
He quoied pievious judgmenis ilai defned
familiesofthoseinvolvedinthestruggleas
soldiersbecausetheywerealsoatriskof
physicalharmbecauseoftheactivitiesoftheir
relatives.Asaresult,thepeopleattherallies
aresoldiers.Thustheyarereceivingorders
fromMalema,heisusingthesong/chantto
dehumanisetheenemy.
Ontheotherside,LamontsaysMalema
hastotakeresponsibilityfortheimpactthese
songs/chantswouldhaveonthetargetgroup.
Thelogicgoesthus:Malemainvitedthemedia
totheserallies,attherallieshesangthesongs/
chantsknowingthattheywouldbetranslated
bythemediaasshoottheboer.Thushe
knewthatthetargetgroupwouldbegiventhis
meaning.Andhesangthemanyway.Thusheis
thecauseofthehurttothetargetgroup.
Itsprettysimple.AndyettheANCs
lawyers,andtherewerethreeofthemall
veryexperienced,werentabletocounterit.
Sometimesinlaw,thatsprettyindicativeofthe
rightsandwrongsofacase.
Andnowtoenforcement.TheANCsaid
duringthetrialthatitwouldbeimpossibleto
enforceanorderbanningthesongs/chants.
Whataboutpeoplesingingitinprivate,said
itslawyers,orthosewhomightspontaneously
burstintosong?Somethingthatdoeshappenat
politicalrallies.
Lamontsviewisthatthatisnotan
argument.ThewholepointoftheEquality
Actistocreateabettersociety.Tosaythathe
mustntmakeanordersimplybecausepeople
willnotobeyhimisnotgoodenough.Hesays
thatpartiestoproceedingscanbedirected
tocomplywiththeprovisionsoftheEquality
Act.Suchpartiescanbedealtwithbywayof
contemptproceedingsfornoncompliance...
personswhoareawareofthelinewhichhas
beendrawnbythecourtareasamatterofboth
lawandubuntuobligedtocomplywithit.He
goesontosaythattheremaybenoimmediate
criminalsanction.
Inotherwords,hecanandhasorderedthat
peoplemustnotsingthesongs/chants.On
apracticallevelofcourse,therewasagroup
ofMalemasupportersthatsangthesongs
immediatelyaftertheruling.Andjustoutside
thecourtbuildingnogal.Thatwasalways
goingtohappen.ButitdoesmeanthatMalema
reallycantsingitagain.Andhecantsingkiss
theboereither,becauseLamont,whoreally
examinedhowlanguageencodingworks,says
itsobviousthatthatmeansexactlythesameas
killtheboer.
Thereareseveralpoliticalimplicationsof
allofthis.

Like Che Guevera, Steve Biko is the poster child for revolution. His face adorns the T-shirts and posters
of a generation who may know nothing of his teachings except that his is a face with some erstwhile
signicance. Thirty-four years after his death, Steve Biko is an icon but he is also a lot more than a
triing symbol of an ancient idea. KHADIJA PATEL talks to Steve Biko scholar, black consciousness

Biko,MngxitamabelievesBikoisathreatto
thecurrentsetupthatstartedin1994which
continuestotreatblackpeopleassubhuman.
Tle ANC is basically managing ile aicliieciuie
whichisantiblack.Twoweeksago,atthe
openingsessionoftheMailandGuardian
LiteraryFestivalattheMarketTheatrein
Johannesburg,Mngxitamashockedthe
audiencewhenhesaid,SouthAfricaisawhite
countryunderblackmanagement.
ThebesttributewecanpaytoSteveBiko

tobefree.Itisnotthepictureitisnow.(Bikos
vision)issimplyacanteringofblackpeople
andtheirdignitysothateverypolicy,every
law,everyactbyourgovernmentispostulated

ofBikosideasinSouthAfricaiscertainly
debatable,thereislittledoubtthatBikoslegacy
isindeedapowerfulone.
Ithinktheideathatblackscanbethe
bossesoftheirowndestinyisthemost
powerful,distinctlegacyofBiko,says
Mngxitama.Youmustrememberthatuntil
theemergenceofblackconsciousnessinour
country,blackpeoplehadgivenuphope.
1976isinasensetheculminationofBikos
teachings.Andweallknowthatitprovedbea
ieinvigoiaiion of ile PAC and ile ANC leadeis
inexile,andgavehopetotheleadersonRobben

privilegeintocircles.

But is Andile a socialist? Only if you say
socialism will maximise democratic life and the
democratisation of wealth he says cautiously.
Ultimately Mngxitama says his vision for South Africa
is one where communities are happy and secured.
