Terms and Conditions 1. CHECK-IN TIME IS AFTER 3 P.M. AND CHECK OUT IS 11:00A.M.

Please note checkout means everyone; personal belongings, and vehicles are off the cabin property by 11:00AM on your checkout date. This is to allow enough time for proper cleaning of cabin, towels, and bedding to be washed & dried. 2. This is a NON SMOKING cabin. 3. Pets are permitted only with prior approval. $50 per pet fee applies. All pets must be leashed at all times. Pet owners are responsible for cleaning up of any/all pet refuse. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees. The cabin owners assume no responsibility for illness or injury that may incur to your pet while on the premises. 4. DAMAGE/RESERVATION DEPOSIT- A damage/reservation deposit of $200 is required at the time of reservation. This must be received within 4 days of booking the reservation. The deposit automatically converts to a security/damage deposit upon arrival. The deposit is NOT applied toward rent; however, it is fully refundable within (7) days of departure, provided the following provisions are met. No damage is done to cabin or its contents, beyond normal wear and tear. No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay. All debris, rubbish and discards are removed from the premises, and soiled dishes are cleaned. Keys are left on wolf key ring inside front door and cabin is left locked. Note: deck door locks automatically when closed. You will be provided with code for your stay. All items on the Rustic Retreat checklist are completed. No linens are lost or damaged. 5. PAYMENT 100% of your total rental rate is required prior to your arrival. Please make payments in the form of traveler's checks, bank money orders, cashiers checks made out to charles palmer, or by credit card using Paypal. The BALANCE OF RENT is due twenty one (21) days prior to your arrival date. 6.. CANCELLATIONS A seven (7) day notice is required for cancellation. Cancellations that are made more than seven (7) days prior to the arrival date will incur no penalty unless deposits were made via credit card. All credit card cancellations are subject to a 5% Cancellation fee or $50 whichever is greater. Cancellations or changes that result in a shortened stay, that are made within 7 days of the arrival date, forfeit the full payment. Cancellation or early departure does not warrant any refund of rent. Deposit is subject to terms of item #4. 7. MONTHLY RESERVATION CANCELLATIONS Monthly renters must

cancel thirty (30) days prior to check-in. Monthly renters who make a change that results in a shortened stay must be made at least fifteen days (15) days prior to check-in. 8. MAXIMUM OCCUPANCY- The maximum number of guests in this cabin is limited to eight (8) persons. 9. THIS PROPERTY REQUIRES A TWO (2) NIGHT MINIMUM STAY Longer . minimum stays may be required during holiday periods. If a rental is taken for less than two nights, the guest will be charged the two-night rate. 10. RATE CHANGES Rates subject to change without notice. 11. FALSIFIED RESERVATIONS Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in. 12. WRITTEN EXCEPTIONS Any exceptions to the above mentioned policies must be approved in writing in advance. 13. PARKING Vehicles and accessories are to be parked in the driveway area only. Parking on the road is not permitted. Any illegally parked vehicles are subject to towing; applicable fines/towing fees and is the sole responsibility of the vehicle owner. 14. MAINTENANCE OF PROPERTY-Tenant agrees to maintain the premises in the same condition as when received and will not allow any waste, misuse or neglect. Should waste, misuse or neglect occur on the leased premises that the responsibility therefore shall be that of the tenant. 15. The premises will not be used in such manner as to generate noise (including Loud Music) which will disturb other neighbors, nor will neighbors be harassed or bothered in any manner. No loud parties, or groups larger than the agreed upon number of guests in this completed, signed agreement will be allowed." Violation of these Terms of Agreement will be grounds for immediate eviction and renter will forfeit all monies paid. In addition Renter _________________ agrees to pay for all additional damages caused by violation of the Terms of Agreement within 15 days of receiving INVOICE of DAMAGES. 16. Should any repairs be necessary, the owners will be notified as soon as possible. 17. Furnishings, appliances, and any other items provided in the cabin are not to be removed from the premises; borrowed or loaned at any time. 18. LIABILITY- The owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The

Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 19. The cabin phone number is 520-303-2390 via magic jack internet phone. 20.Guest acknowledges and understands that each and every guest or guardian is solely responsible for any property damage, accident, injury or loss sustained to any person while in residence and neither the Agent nor the owner accepts legal or financial responsibility. Guests and guardians, assume all risk of injury or other loss resulting from a recreational activity and will hold the Agent and Owner harmless with respect hereto. Guests hereby agrees to indemnify and hold the property owners harmless from any claim, including those of third parties, arising out of or in any way a result of the guests use of the premises or items therein. Owner cannot be held responsible for: The failing of any other company due to said companys error or service interruption (i.e. electricity, water, gas, satellite, cable etc). Acts of neighbors such as: Construction, road repair, and maintenance or act of god (weather). However, Owners agree to do all that is humanly possible to remedy any issue as quickly as possible. Owners reserve the right to enter property at any time to investigate disturbances, check occupancy, check damages, make repairs, alterations and improvements.
