February 27th 2006, AGENDA SESSION President Apai called to order the meeting of the February27th, 2006 AT 6:34.P.M. President Apai read the following Open Meetings Statement: “The notice requirements provided for in the Open Public Meetings Act have been satisfied. Notice of this meeting was properly given as per N.J.S.A. 10:4-18 and was transmitted to the Times of Trenton and Trentonian on January 4th, 2006 for publication on January 6th, 2006. Documentation and notice have been filed with the Clerk of the Township of Ewing and posted in the Ewing Township Municipal Complex as is required by law. Ms. Wollert (Present) Mr. Murphy (Present) Mr. Steinmann (Absent) Mr. Summiel (Present) President Apai (Present) DISCUSSION: President Apai introduced AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF EWING IN THE COUNTY OF MERCER TO PROHIBIT SMOKING IN ALL TOWNSHIP BUILDINGS, ON ALL TOWNSHIP PROPERTY, IN ALL TOWNSHIP PARKS AND IN ALL TOWNSHIP VEHICLES. (2006) Mr. McManimon discussed the proposed ordinance in detail with Council. After some minor amendments were proposed, the ordinance was approved for action. • President Apai introduced a resolution providing the Consolidation of Voter District # 30 because of low voter turnout. Solution combine Districts # 17 & # 30 into one district (District 17) and rename District 33 District 30. The resolution was approved for action. President Apai introduced a resolution providing for the moving of the polling location for district 18. The new polling place proposed for District # 18 will be Ewing High School. The resolution for approved for action. President Apai introduced a resolution proving for the Sale of Township owned Property. After discussion, the proposal was approved for action. President Apai noted the change of location for the Council meeting on Tuesday, February 28 to the auditorium at Fisher Middle School. President Apai introduced AN ORDINANCE AUTHORIZING THE TOWNSHIP OF EWING TO RECEIVE THE ASSIGNMENT OF A CONTRACT BETWEEN AMERICAN PROPERTIES AT EWING, LLC AND CRODA ADHESIVES, INC. FOR THE ACQUISITION OF THE LAND AND IMPROVEMENTS LOCATED AT 200 UPPER FERRY ROAD/2 GRAPHICS DRIVE, EWING, TOWNSHIP, MERCER COUNTY, AND ACQUIRE SAID LAND PURSUANT TO THE CONTRACT TO BE UTILIZED FOR PURPOSES OF A SENIOR CENTER AND EMERGENCY MANAGEMENT SERVICES BUILDING. ORDINANCE (S) FOR FIRST READING AND INTRODUCTION 1. President Apai introduced AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF EWING IN THE COUNTY OF MERCER PROHIBITING PUBLIC URINATION. (2006) The ordinance was approved for action. 2. President Api introduced a REFUNDING BOND ORDINANCE AUTHORIZING THE ISSUANCE OF UP TO $1,500,000 OF GENERAL OBLIGATION REFUNDING BONDS AND NOTES OF THE TOWNSHIP OF EWING, COUNTY OF MERCER, NEW JERSEY, TO PROVIDE FOR THE PAYMENT OF CERTAIN OF THE TOWNSHIP'S OUTSTANDING OBLIGATIONS; MAKING CERTAIN DETERMINATIONS AND COVENANTS IN CONNECTION THEREWITH; AND AUTHORIZING CERTAIN RELATED ACTIONS IN CONNECTION WITH THE FOREGOING. (2006) The ordinance was approved for action. ORDINANCE(S) FOR SECOND READING, PUBLIC HEARING AND FINAL ADOPTION 1. President Apai introduced AN ORDINANCE OF THE TOWNSHIP OF EWING IN THE COUNTY OF MERCER, AMENDING AND SUPPLEMENTING THE REVISED ORDINANCES OF THE TOWNSHIP OF EWING, TO AMEND CHAPTER 15, LAND DEVELOPMENT, TO INCLUDE STORMWATER CONTROL ORDINANCE. (2006) The ordinance was approved for action. 2. President Apai introduced AN ORDINANCE ESTABLISHING A MUTUAL AID AGREEMENT FOR EMERGENCY POLICE SERVICES AMONG AND BETWEEN THE MUNICIPALITIES OF MERCER COUNTY. (2006) The ordinance was approved for action. 3. ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF EWING IN THE COUNTY OF MERCER TO PROHIBIT ANY PARENT OR OTHER PERSON FROM ILLEGALLY ENROLLING A NON-RESIDENT STUDENT IN THE TOWNSHIP OF EWING SCHOOL SYSTEM. (2006) The ordinance was approved for action. NEW BUSINESS 1. President Apai introduced a RESOLUTION AUTHORIZING THE PREPARATION AND SUBMISSION OF AN APPLICATION TO THE LOCAL FINANCE BOARD PURSUANT TO N.J.S.A. 40A:2-51 et. seq. The resolution was approved for action. 2. RESOLUTION OF EMERGENCY TEMPORARY APPROPRIATION The resolution was approved for action. STATEMENTS AND COMMENTS FROM MEMBERS OF THE PUBLIC Roy Bleakly (125 Rutledge Ave) and Ron Prykanowski (16 Thurston Ave.) commented on the ordinance concern out of district school children; Debbie Calle (511 Grand Ave.) asked about the property sale and the bond sale; Ron Jones (150 Browning Ave) asked about the smoking ordinance, property sale and problems regarding rental properties; Rev. Wittick (94 Carlton Ave) asked about the property sale and rental property issues; Dave Martin (16 Dawes Ave) asked about the Township budget and the property tax bill; Tom Toth (15 Corey Drive) asked about land for proposed Senior Citizens Center and rental properties; Anthony Ianni (74 Willis Drive0 asked about the property tax billing.

At 9:14 pm, Mrs. Wollert moved to go into closed session to discuss pending litigation and contract negotiation, seconded by Mr. Murphy. The motion carried unanimously. At 9:48 pm the meeting was reopened. There being no further business to discuss, Mr. Summiel moved to adjourn at 9:51 pm, seconded by Mr. Murphy. The meeting was adjourned.
