On 10/28/2011 at approximately 0048 hours, I, Officer Ragland, along with Officer Graff, was dispatched to the area of 3100 Pearl Parkway on a 911 Hang-Up. While I was enroute to this area, Dispatch advised me they had heard a lot of loud noise and yelling in the background, including comments such as, "Don't kill me." I went enroute to this area emergency at approximately 0051 hours. As I was enroute to this location, Dispatch continued updating me on the noise they were hearing in the background as the phone line was still open. Dispatch told me, "Someone is saying please open the door." Then, "You just tried to kill me" and "I'm going to stomp your head into the concrete." The dispatcher kept hearing, "Johnny, you're fucked up." Then, the dispatcher heard, "They made me so scared I had to do this" and "Just please don't kill me." Then the line went dead. I arrived in the area at approximately 0054 hours. Dispatch did not have an exact location, and they had no further information on who had called 911. Officer Bemis, Stevens, and I drove around the area. Dispatch gave me a more detailed description of the location the cell-phone was calling from. Dispatch told me the call was coming from east of 31st St, south of Pearl Pkwy, and north of Prairie Ave. I responded to this general area and went on foot at approximately 0104 hours. Officer Bemis was in the same area and advised me that he observed an open door to one of the buildings. Officer Bemis and I cleared the building with the open door, which was located at 1906 31st St. The building was clear. At this time, Dispatch advised me they were on the line again, talking with someone by the name of Mike. Mike told them he was near a shed. Dispatch also advised they heard someone say, "He's 28 and can't talk because they will hear him." Officer Bemis, Stevens, and I observed another abandoned building to the south of 1906 31st St. We began to walk to this building. As we were walking, I looked to my left (towards the east) and observed an individual standing near a building. I immediately brought this to the attention of the other officers and we began walking over in this direction. I made contact with the individual, later identified as Charles Edward Waters, at approximately 0115 hours just outside of a building addressed as 3100 Pearl Pkwy. I immediately noticed two other individuals, laying on the ground. One was nearby Waters, in the doorway of a shed. The other individual was approximately 15 feet away to the east. I observed that Waters had blood on his face, and there was blood on the ground in the area. I requested that Pridemark respond to my location. I took a quick look inside the shed to see if there was anyone else inside. I did not observe anyone else. Waters immediately told me he had a knife in his pocket. I told Waters to sit down. I asked him where the knife was. He told me it was in his front left pocket. I reached into his pocket and removed the knife and placed it inside my right pocket. I was wearing personal protective gloves when I did this. Officer Stevens and Officer Bemis were with the other two males that were laying on the ground. Both males appeared to have severe injuries. I asked Waters what happened. Waters told me he was sleeping and they [the two males] attacked him. He told me he had to defend himself. He told me they tried to "choke him out." I asked Waters what had happened to the males. He told me, "I defended myself. That's all you need to know. I plead the 5th." I placed Waters in handcuffs at approximately 0120 hours. I asked Waters to stand up and walk to an area away from the other two individuals. I searched Waters to ensure he had no other weapons on him. I observed a significant amount of blood on Water's right boot, his jacket, and his hands. I asked Waters again to tell me what happened. He told he was sleeping in the shed when "Johnny" and some other guy (Waters told me he did not know the other guy) started bothering him. Waters told me that he had only been at this location for a few hours. He indicated that his property included a bike, backpack, and guitar leaning up against the outside of the shed. Sergeant Aguirre asked Waters if he minded if we checked inside the shed. He told us, "No. The stuff in there isn't mine. The backpack, bike, and guitar are mine." I asked Waters if his backpack was the one leaning against the outside of the shed. He said, "Yes." I observed the backpack was mostly tan. I detected the odor of an alcoholic beverage on Waters. I asked Waters if he had been drinking. He said that he had been drinking but not that much, estimating he'd had about a pint. I talked to Officer Bemis on scene. He told me the individual he was speaking with, identified as Michael Giampino, was sleeping inside the shed when the suspect, who Giampino positively identified as Waters, walked in. Giampino said he awoke to some stuff being said that he couldn't make out; he said it sounded like gibberish.

Then, Giampino felt pain in his back, chest, and face. Giampino said Waters started punching and kicking him. Giampino mentioned he does not know Waters. Giampino was transported to Boulder Community Hospital (BCH) at 1100 Balsam by Pridemark. The paramedic who transported Giampino . Giampino told Officer Bemis he had crawled outside of the shed to the location in which we had found him. When we made contact with him, he was on the phone with Dispatch. I stayed on scene and returned to Waters. Firemen on scene were checking out Waters' injuries. It was determined that he needed to be medically cleared because his nose was swelling. Prior to leaving the crime scene, I spoke with Officer Lopez, who was processing the crime scene. I told him about the knife I had removed from Waters. Officer Lopez told me he would take custody of the knife to log in with the other evidence he was collecting. I told Officer Lopez I had removed the knife from Waters' front left pocket. Officer Lopez took the knife and placed it in a small evidence bag. I also told Officer Lopez that Waters had told me the tan backpack, bike, and guitar leaning on the outside of the shed belonged to him. I pointed these items out to Officer Lopez. I transported Waters to BCH at 1100 Balsam. While I was enroute, Waters started uttering statements freely, saying, "All I was trying to do was sleep. They attacked me and I'm the one getting in trouble." At the hospital, Waters continued to utter statements, saying, "They had me around my neck trying to kill me. I was sleeping. They're idiots." These statements from Waters tie in with the statements Dispatch heard while the line was open, about making someone being so scared they had to do this. The hospital was busy so I waited in the lobby with Waters for awhile. I did not observe any physical marks on Waters' necks, such as bruising or redness, which would be consistent with being strangled. While we were waiting in the hospital lobby, Officer Weisbach took pictures of Waters, documenting the blood and injury on his face, the blood on his hands, and the blood on his clothing and shoes. Officer Weisbach also scraped beneath Water's fingernails for evidence. I also spoke with Officer Stevens while I waited for Waters to be treated. I asked Officer Stevens what information he had obtained from his victim. He told me he had almost no information. He said his victim had not said anything and was very drunk. The only information we had on this victim was that he goes by "Johnny", at least according to Waters. Officer Stevens also told me the victim had life-threatening wounds and had been rushed to the operating room. Waters was finally taken back to the treatment area. The nurse at the hospital asked Waters how his nose had gotten injured. He would not tell the nurse how his nose was injured. He told her he got attacked and "that's all I'm saying." The nurse gave him an ice pack for his nose. Waters said he didn't need it for his nose but he did say, "I will use it for my fingers. They hurt." Waters was pointing to and indicating that he had pain in his knuckles on his right hand. Waters placed the ice pack on his right hand. While we were waiting for the doctor, Detective Sloan arrived on scene and I stepped out of Waters' room to update Sloan on what had happened. After speaking with Sloan, I returned to Waters' room and he said again, "All I wanted to do was go to sleep. Now I'm in trouble because I defended myself. It was 2 to 1 and I'm in trouble." He said, "I do not look for trouble. I don't bother or offend nobody. I just play my guitar. I have a bruised nose, bruised knuckles. I defended myself. I have no reason to be fearful." Waters also asked what was going to happen. I told him we would be going to jail after the hospital. Waters declined having x-rays taken of his injuries, saying it would be a "waste of time and money." He was medically released. I transported Waters to the Boulder County Jail at approximately 0418 hours. While I was enroute to the jail, Waters asked me if I knew about the other guys. I told him I did not know their condition. On arrival at the jail, I collected all of Waters' clothing. This clothing will be booked into the Boulder Police Department Property and Evidence. At approximately 0455 hours on 10/28/2011, I read Waters his Miranda rights. I asked Waters if he understood his rights and he said, "Yes." I asked Waters to tell me what happened. He said, "I was sleeping on the floor in the shed area. Johnny said he was allowed to be there." I asked how the other two individuals had gotten injured. He said, "I don't know. I don't want to say anything other than that. I defended myself. That's as much as I'm saying." I asked how he got his injuries. He said, "They started stomping on me. I didn't know what was going on." I told him I had a problem because the other two individuals had both been stabbed. He said, "Well they must have been on something really intoxicating. They had to be doing something more than drinking. I want to talk to a lawyer." Waters kept talking, saying, "I was asleep. I was attacked and I'm in trouble." I told Waters I didn't have any more

The statement Waters made about the males being more than just intoxicated correlates with the statement heard by Dispatch about "Johnny" being "fucked up." The doctor signed off on a Serious Bodily Injury form for Giampino. The other victim has still not been identified, other than being known as "Johnny" by Waters. At approximately 0945 hours on 10/28/2011, the detectives notified me that "Johnny" had been pronounced dead at the hospital.
