The following findings are made, and Order issued, under the authority vested in the Administrator of the United States Environmental Protection Agency ("EPA"), by Section 309(a) · of the Clean. Water ACt ("Act"), 33 U.S.C. § 1319(a) .. The · Admiriistrator of EPA delegated the authority to issue jhis .Order to the Regional Administrator of EPA Region 6, who delegated this authority to the Director' of. the Compliance Assurance and Enforcement Division. .

7. The·Permittee applied for and was issued NPDES Permit Number NM0022250 ("permit") under. Section 402 of the Act, 33 U.S.C. § 1342, which became effective onMay 1,2005. At
all relevant times, the Permittee was authorized to discharge pollutants from-the facility· to. waters of the United States only in compliance with the specific terms and conditions of the permit, . .

FINDINGS

1. . Permittee, Albuquerque Bemalillo County Water Utility Authority, 'is 'a "person," as that terin is' defined" at
· Section 502(5) of the Act, 33 U.S.C. §136Z(5), .§ 122.2. .

8. Part I.A of the permit places certain. limitations on the quality quantity of effluent discharged the Permittee. Ute relevant discharge. limitations are listed in Attachment A.

Inspection Report .37. On March 17,2009, a CEI was conducted at the WWTP, Permit No. NM002225 0, -by representatives of the EPA. As a result of this inspectionvthe' findings specified 'in the following ,paragraphs were made.' , ' 38. Part m.B.3 of the permit was violated in that the Permittee failed operate and maintain the WWTP as, designed.

45. Part III.B.3' of the permit was violated in that the facility has
problems. maintaining emergency .electrical service to the treatment units, and has experienced numerous SSOs from the' collection system. The facility has improperly stored several one-ton ammonia cylinders in an open drive area of the plant. ' The primary clarifier effluent pumps in both pump houses have badly leaking seals. The plant grounds had, a number of areas ' with 5 feet tall weeds that needed mowing.

In the event that the Permittee believes complete correction of the violations cited herein is not possible within thirty (30) days of the effective date of this Order, the Permittee. shall, within thirty. (30) days .of the effective date of this Order. submit a comprehensive wrltten.plan for the elimination of the cited violations within the shortest possible time .. Such plan shall describe the specific .corrective actions to be taken and why such' actions are sufficient to correct the violations. The plan shall include a schedule for -the elimination of the violations within the shortest possible time, as well as measures to prevent these or similar violations from -recurring. D. If Permittee would like to a meeting with EPA .'to discuss the allegationS. in this Order, it should .contact EPA within forty-five .(45) "days' ·of the effective date of this Order. .The meeting will be-held at the Region 6 offices, 1445 Ross' Ave., Dallas, Texas, . and the Perinittee can provide any . information it believes is relevant to this Order ..
