The 10th Royal Langkawi International Regatta (RLIR) 2012 is scheduled to take place from 9th to 14th January 2012 in Kuah, Langkawi, with racing across several classes including Racing Class, IRC Class, Sports Boat, Multihull, Club Cruising and Ocean Rover.
2012 is the 10th regatta and the organisers, Royal Langkawi Yacht Club (RLYC), are determined to make this the most successful ever. Coinciding with the anniversary, for the first time the regatta has been accorded international recognition as a Grade 3 Championship by the International Sailing Federation (ISAF). This achievement, which is one of the highlights of the 10th regatta, demonstrates that RLIR is on a solid track to continue its tradition of excellence in attracting highly competitive racing yachts and sailors from all over the world.
Multihull 2011 winner, Phuket-based Andaman Cabriolet Niña
Racing in Bass Harbour
The Rear Commodore of RLYC, and Chairperson of Regatta Advisory Committee, Y.M. Tunku Soraya Dakhlah binti Tunku Tan Sri Abdullah said the regatta also complements the government’s effort in positioning Langkawi as one of the "world’s most widely recognised islands and tourist destinations" under the Langkawi Five Year Tourism Development Master Plan. “It is our aim to maximise these inherent strengths and turn Langkawi into a premier sailing and yachting destination. We are looking forward to welcoming yacht owners from across the globe to participate and register for this thrilling event, which is aimed to cultivate the spirit of friendship and international sportsmanship among participating countries,” Tunku Soraya said. The Regatta Technical Chairman, Ahmad Zailani Bashah, said Langkawi is known for its world-class sailing venue with excellent weather, good wind conditions and good tropical waters. “The wind speed in January usually fluctuates between 8 - 20 knots and we are sure the conditions will be the same in January 2012. The
Kuah Harbour Race and Coastal Race always provide two different scenarios for sailors. We have strong wind conditions with flat waters in Kuah Harbour, as well as strong wind conditions with choppy waters in coastal areas. All participants can look forward to a challenging experience,” Zailani added. RLIR 2012 will be preceded by a curtain-raiser, the AO CHALONG LANGKAWI ‘CHAMPAGNE RUN’. The overnight race will kick off on 7th January 2012 from Ao Chalong Yacht Club (ACYC), Ao Chalong Bay in Phuket, and officially ends at Telaga Habour in Langkawi. Special promotional packages for early bird registrations are offered, where an entry fee of RM550 per team, inclusive of skipper, will be charged for teams that register and make full payments before 30th November 2011. There will be also an additional RM100 fee for each additional crew member. Once the promotion ends, a fee of RM200 will be charged for each additional crew member. The fees will cover the cost of berthing for eight nights at the RLYC, water and electricity and regatta souvenirs.
Langkawi Regatta 10th Anniversary
Teams participating in the RLIR 2012 will compete for the Prime Minister’s Challenge Trophy (for participants of internationally registered yachts), the Commodore’s Challenge Cup (for participants of club-registered cruisers), the LADA-IRC Challenge Trophy (for participants of the IRC 1 Class), the Langkawi Sports Trophy (for participants in the Sports Boat Class) and the Malaysian Multihull Challenge Cup (for participants under the Multihull category). A special award in memory of the late Founding Chairman and first Commodore of RLYC, Almarhum Tunku Tan Sri Abdullah Tuanku Abdul Rahman, the “Tunku Abdullah Sportsmanship Award” will be presented for the best team, both on water and land in the 2012 Regatta. RLIR 2012 is organised by the RLYC and sanctioned by the Malaysian Yachting Association (MYA – The National Authority), a member of the National Sports Council and the Ministry of Youth and Sports, Malaysia.

Dockwise Yacht Transport (DYT), headquartered in Fort Lauderdale, Florida, USA, specialises in the maritime transport of private luxury yachts. Catalina Bujor PR & Marketing Officer, based in the USA, commissioned Helicam to obtain cutting edge aerial still photography and HD aerial video of their transport ship Combi Dock 1, which is a self unloader with cranes on the vessel to unload the yachts directly into the water, as it arrives here in Phuket with its cargo of yachts and superyachts onboard. The Helicam team contacted the pilot at the deep sea port, Khun Jutupron, who allowed us to use the pilot boat as a launching platform. Using the remote piloted helicopter equipped with HDV video and 18 mega pixel stills, Helicam Co Ltd were able to obtain all the required material. International Primary Curriculum
The IPC focuses children’s learning on a combination of knowledge, skills and understanding. No one can properly predict the nature of work and life opportunities that will be available for today’s primary age children by the time they are adults. Many of the jobs they will have don’t yet exist; especially in the fields of ICT, technology and science. So the IPC focuses on a skillsbased approach, developing adaptable and resilient globally-minded learners, prepared for the fast-changing world that they’ll be living and working in.
About the School
With the backdrop of the Andaman Sea and over an acre of grounds, Palm House School aims to provide children with an idyllic, caring and modern primary school experience. Using the IPC, delivered by experienced and driven teachers with a passion for their profession, Palm House will join the thousands of other IPC schools around the world in providing a stimulating and balanced curriculum in a logical and thematic manner.

NOT JUST ABOUT THE BANKERS
What have bankers got to do with oceans, ice sheets & orang utans?
"Like most lotus eaters living here in Paradise Phuket, I paid scant attention to the ‘Occupy’ (New York’s Wall Street, London’s St Paul’s Cathedral et al) movement protesting about… well pretty much everything to do with how the world’s run. That is until I discovered my daughter, Emma, was camped out on a damp November pavement in London, working to get the ‘Occupy’ message across to a skeptical media. It might just be worth putting the gin and tonic down for a moment to consider what this is all about…" Grenville Fordham, Window magazine publisher
Flooded with requests from members of the public, the media and my family to explain why I’m camping out on the chilly cobbles of St Paul’s, I stormed my own brain and came up with this:
I’m here because I believe in real democracy, social justice and environmental responsibility. I’m here because I passionately believe – no, I know – that we need to put planet and people before profit. I’m not here because I hate bankers, or hate cuts. It’s so much deeper, broader and more complex than that… and it’s got a lot to do with loving this earth we live on. Environment and economics are inextricably linked. One doesn’t have to understand fractional reserve banking to understand this. The profit-driven economic system we have is not sustainable. By that I don’t just mean it’s not
‘green’, I mean that in a world of finite resources we literally cannot have perpetual growth. It won’t work. It cannot be sustained. Already the financial system in the Western world has begun to implode. We’ve knocked back the ‘good’ times – the greed times – and now we’re lurching about like drunkards trying to pretend we just need a cup of coffee and then we’ll be fine to drive. I think it’s time the car keys were confiscated because it’s not just economies that we’re crashing, it’s the planet. Economic and social injustice is what many of us are feeling most keenly at the moment but we can’t afford to ignore the looming dual impacts of climate change and resource scarcity. They’ll hit the most vulnerable first, especially those living in marginal lands – the deserts of Africa, the floodplains of Bangladesh – while the superwealthy one percent will relocate to the least affected

areas and insulate themselves in robust palaces. We can’t wait until our low-lying cities flood, until the glaciers melt and the gorillas are gone before we do something about it; if we do it’ll be too late, we’ll be trapped in a chainreaction of crises way more severe than job losses and home repossessions. So, in addition to railing at banks and corporations for stealing our money and corrupting the politicians who are supposed to represent us, we must remember that they are the ones destroying our land–again, for their own profits. Extracting oil from the tar sands of Canada, deep-water oil drilling in the Arctic, fracking for gas in Lancashire, slashing rainforests to grow cash-crops such as palm oil… these environmentally devastating practices need to be stopped. A British environmental lawyer (Polly Higgins) has proposed to the UN that heads of state and directors of corporations be required to take individual and personal responsibility for their actions and that ecocide, the environmental equivalent of genocide, becomes an International Crime Against Peace (alongside genocide itself, crimes against humanity, crimes of aggression and war crimes). While this may give profit-hungry polluters pause for thought, I believe it’s not just the elites who need to re-evaluate; we all do. We need to stop being selfish. Selfishness is behind the unsustainable profit-driven economy, the destruction of environments, over-fishing, over-consumption, pollution and war. We need to look at what is really needed to have a decent quality of life. Let’s try to get those things – food, clean water, shelter, warmth, security, community, education, leisure, meaningful

pursuits – for everyone on the planet… and get rid of everything else. Stop lusting, hoarding, competing. Demand that the bankers do their bit but be prepared to do our bit too. If everyone stopped being selfish we have the intelligence and resources to sort it out. For example, an IPCC Report (Inter-governmental Panel on Climate Change) shows that with political will and investment we could meet 80% of the world’s energy needs with renewables by 2050. That would go some way towards heading off environmental catastrophe; towards saving the oceans, the ice, the orang utans and the people. We might even find enough compassion in our hearts to invite the bankers onto the ark. For more information, visit: www.occupylondon.org.uk
You don’t have to believe everything they stand for, but they’re the only ones making a noise – and there sure is something wrong… GF

Around Phuket Baan Rim Pa
'Location, location, location' as the saying goes. It doesn’t matter how good you are, if you’re not in the right location, forget it. Baan Rim Pa has become one of Thailand’s best-known restaurants, with a reputation stretching much further. It is perched on a cliff, with teak floors and the constant swish of the surf ‘downstairs’. There are some restaurants that just encapsulate the word ‘romantic’ and here, with Tommy Doyle playing classics on his grand piano, the sea breeze and the delicate aromas of world-class cooking in the air, this House by the Sea is one of the most romantic places to eat in Phuket. Situated on a rocky outcrop, overlooking the Andaman Sea, Baan Rim Pa prides itself in superb, authentic Royal Thai Cuisine, an ambience second to none and the most spectacular views on the island. Baan Rim Pa is the winner of the prestigious Wine Spectator Award of Excellence nine years in succession.

Around Phuket Salvatore’s
Boathouse Wine & Grill
Looking for a break from the tourist spots on Phuket’s west coast – and the best pizza on the island? Follow the locals to Salvatore’s, a rustic 'trattoria' in Phuket Town. Salvatore offers traditional Italian cuisine using only the finest fresh ingredients, such as linguini alla bottarga, sea bass in salt crust, gnocchi with fresh sausage and pizza baked in a wood-burning oven. Other specialties are created with local shellfish, like mouth-watering lobster ravioli and fettucini with crab. Start with the bruschetta, with delicately skinned tomatoes and fresh herbs and beef carpaccio with olive oil. The food is prepared under the careful eye of the Sardinian executive chef and owner, Salvatore Cossu, a fixture on Phuket’s restaurant scene for his cooking skills. He personally shops for the vegetables and fish in local markets. The bread is baked daily; the pastas and sausages are home-made. Ask him about daily food specials as well as wine suggestions. Salvatore offers about 60 labels, including Sardinian wines. The service is warm and the ambience is friendly. But the real star is the food.

Around Phuket Patong Seafood
Take a journey into the home of real Thai food! Patong Seafood Restaurant was the first seafood restaurant to open in the then village-like Patong. It has changed very little from those days except for a major refurbishment after the 2004 tsunami in which major damage was sustained. The restaurant was rebuilt as it was in original Thai style with open dining area and a high circular design ceiling. Only the freshest seafood is brought straight from the boat and market to give you the finest selections, which are on display – chilled and ready to eat. The kitchens at Patong Seafood Restaurant are a place to behold, where their chefs with simply so many years of experience, prepare your seafood and other Thai delicacies to perfection. The first thing that you will notice are the friendly staff. The smiles, the attentiveness and the helpfulness in making your choice are something you will appreciate and you will then know why many visitors and locals come back time and time again to enjoy this real taste of Thailand.

A sampling of our main event including green curry with chicken, Mussaman curry and our famed red duck curry is something not to be missed. End your distinct culinary experience with a local Thai dessert. Enjoy our Thai classical dance show on Monday/ Wednesday/ Friday and Sunday from 7 to 9 pm and is accompanied by a Thai traditional orchestra. The Siam Supper Club
Rossovivo Pizza Pasta Grill
The Siam Supper Club is definitely an icon!! It screams the word. There are few places in the world that provoke such a sense of time and place. The venue is a long bar and grill that has become synonymous with the cool of a bygone age still leaving it's sophisticated imprint. It's cool... in the same way scotch on the rocks is cool. Beautiful... no glorious jazz filling the few empty spaces. One of the most interesting collections of sepia black and whites remain true to this same time and place. When one is at The Siam Supper Club, one has to give up the mantle of tourist or visitor and for a brief time assume the rank of resident or... Phuketian. For when you're at The Siam Supper Club you are well and truly placed in a subtley lit and timbered comfort zone where a cocktail is still a cocktail damn it, the wines are big and the fabulous food reminds you of how things used to be. Ah! The tropics! Big wines. Fabulous food. Great music.

Aptly named for its stylish and tasteful red interior, Rossovivo or red colour, is a recently opened Italian restaurant in Rawai. With its smart décor and casual ambience along with a superb menu of authentic Italian cuisine, this place to dine is destined to turn heads and attract attention. All the pasta is also freshly made at the restaurant and the Gnocchi with gorgonzola cheese and speck and Bolognese style Tagliatelle are a delicious combination of both pasta dishes. To top off the meal, go for a dessert drink – a Lemon Sorbet with vodka. Refreshing and pleasing to the tastebuds, it'll keep you asking for more. Alex and Vlad Bond
Alex and Vlad Bond, Producer and Director of Palazzo Phuket Theatre, describe the challenges and joys in bringing a new kind of entertainment to Phuket following two decades of life on the global stage.
Where are you from? We were born in Kiev, Ukraine. In 1991, we were selected to attend the Russian States Academy of Theatrical Art. Back then in the Soviet Union, representatives from Moscow would search for the best in the arts and send them to the capital for training and education. After graduating we travelled the world competing and performing. We won awards at the International Circus Festival in Monte Carlo – the ‘Oscars’ for circus artists. Our work took us to Broadway, Las Vegas, to the Cirque du Soleil – in total 162 countries. In 2002 we were granted citizenship in Australia under the category of ‘distinguished talent’ in the arts. When did you move to Phuket? We first came to Phuket nearly two years ago to investigate the possibility of opening a Palazzo theatre here. We thought Phuket would be a good place for family entertainment so we came and spent one year learning the market. We’d never been to Phuket before. Tell us something about your business, Palazzo. Palazzo is a dinner show. This type of entertainment has been popular in Europe for 20 years. At Palazzo there’s no separation between the audience and the actors. There's no stage – the maître d' is an actor, the waitresses are actors, the audience is part of the show. The dinner is part of the show. The audience can see the backstage life: the waitresses fighting, a heartsick electrician, the crazy chef. It’s like being inside the screen, like 5D entertainment. Can you tell us about any new developments in your business? This is our second season, and so far we’ve had very good comments from guests. We aim to have the best entertainment, the best food and the best service. We’re sure that we have the best entertainment and best performers in Phuket, 14 of whom are highly trained professionals brought in from overseas. In December, we’re creating an authentic Christmas atmosphere for guests to enjoy. Though people come to Phuket for the beach, in the evenings they want to dress up and go out. People who come to Palazzo this month will experience a real European Christmas with a touch of Asia. For people who live and work in Phuket, we have a great offer with a loyalty programme and special prices. We’ve also added lunch service this year as a place for people on city tours to stop and enjoy an entertaining meal. It’s a real chill-out atmosphere and a lot of fun. How does working in Phuket compare to back home? In Thailand there are so many hidden rules, especially those relating to foreigners, unlike in Europe, where the process, the costs, etc are clear. And after starting a business there are many new questions and unexpected difficulties that arise. In hiring local artists, we have invited some but we still haven’t found enough that meet the quality we demand for our show. We hope to help develop more quality artists here. Whereabouts do you live in Phuket? What determined your choice of location? We have a nice big house in Kathu, near the Palazzo theatre. We love the beach and our first house was in Bang Tao, but it was easier to live close by the theatre since we spend long days here. Do you own your house or do you rent? We’re renting. We have a property on the Gold Coast in Australia so we don’t need to buy one here. What kind of car do you drive? Vlad: I drive a Yamaha Dragstar – a big, loud and stylish bike. I love to ride and sometimes we take it out to viewpoints around the island. For work, we have a company rental car, which we seem to have to change every month because I’m always getting into accidents! What are your favourite places to go in Phuket? We stay away from the tourist destinations. We like to go to the quiet beaches in the north, and enjoy windsurfing and snorkelling. We have a favourite spot near the beach in Kamala for pizza; a place owned by a Frenchman. The greatest pizza we’ve ever had. Do you have family here? We’ve been married for 21 years and have twins, a boy and a girl, aged nine. They study at the Kajonkiet International School, which we think it will give them the education they need for going back to Australia. We want them to go to university and have a normal life. While we won't push them in any direction I hope they don’t want to be an artist. It’s a difficult life! How do you evaluate success? There are three types of success. First, as an artist you’re successful if you’re seen on TV and become well known. We've had this before. Second, in doing production, we don’t care about being on TV, it’s more about having a quality reputation for service and the show. Third is family, to combine our artistic and creative life with our business and family. Phuket gave us this opportunity to have a nice life with our family. Are you involved in any other local projects or charities? About once a month we provide a free show for a local government department or community event, and we recently did a special show for the Phuket International Women’s Club. We’ve also set up a youth activity centre, a ‘circus school’, at the theatre where kids of all nationalities can come after school for training in drama, music, acrobatics and dance. It’s a great chance for Phuket children to learn from our world-class artists.

The apex sphere symbolizes a sense of elation discovered only by balancing the first five – the unique experience of all senses elevated beyond expectations. Six Senses has created a body temple incorporating the principles of feng shui using fire and water, which delights beyond all expectations. The Royal Spa
To experience The Royal Spa is to feel the true beauty of nature and reflect on the power of body, mind and spiritual connections.
The Royal Spa and Health Club
In the heart of bustling Phuket Town lies a quiet haven of heavenly peace. With the continuous sounds of water, trickling, bubbling and steaming, and with the sweet fruity scents that fill the air, the being is enticed into a flowing stillness of body and mind. The Royal Spa and Health Club is a popular tropical day spa with both locals and visitors alike, which is managed by the Royal Spa Development and Management Company. With an excellent reputation in the spa development industry through its experience and attention to detail, the Royal Spa and Health Club offers a distinctly personal experience. Of the signature treatments, the Royal Stone Therapy is one that is particularly interesting. The Hot Stone massage technique, founded 5000 years ago, uses black volcanic stones, which are heated and placed on the body, producing a profound effect, stilling the mind and easing the body. Unlike many of the high-end spa complexes on the island, which market themselves exclusively to tourists, the reasonable prices and relaxed but professional staff at the Royal Spa, means that many local Thais, as well as tourists, are beginning to use the spa. This has helped to erase the often stiff, and over-formal atmosphere at many of Phuket’s spa resorts, giving the Royal Spa an ambience of authentic relaxation and pleasure. All the therapists working at the Royal Spa have been trained at the in-house 'Phuket Spa Academy', established in 2004, to provide a comprehensive spa training course. The curriculum and assessments provide a measurement of therapist expertise and knowledge within the Thai spa industry. Since then, the Royal Spa Development and Management Company have provided comprehensive and professional spa management, and development programs, for spa retreats throughout Thailand. Their aim is to provide a standard of service and expertise throughout the Thai spa industry, to ensure a high quality of service and standard of treatment, throughout Thailand. It truly offers the ‘one stop services for Thai spa business’ and a quality of relaxed professionalism, rarely found in luxury spa resorts. Right now The Royal Spa have 12 branches that are managed in resorts in Patong, Kata, Karon, Panwa, Ao Chalong and Phuket Town and you are welcome to experience our spas with us anytime. As a special for our 8th year anniversary, we offer 'BUY ONE GET ONE FREE' value.

Sukko Cultural Spa
Sukko means "Beyond Happiness". My first feeling when I stepped through the impressive gates of the Sukko spa was, "I’m in paradise". The Sukko staff are dressed beautifully in traditional Thai style and the spa design, influenced by the ancient Siamese capital, creates a haven of calm yet regal serenity. I felt I had left all my troubles behind.
Chilled out by the soothing background music, my mind was filled with a peaceful wellbeing as I enjoyed the warm traditional welcome (again from Sukko culture) of the ‘Flower Floating Ritual’ – similar to ‘Loy Kratong’, where the idea is to float away past stresses and wish for luck and joy from that moment on. A variety of 40 spa treatments – prepared by Sukko's certified Thai Herbalist and based on ancient Thai medical theory – is offered at Sukko, in packages lasting from 2 hours to 4 hours. Each package has a specific purpose and can be selected to suit your lifestyle or the way you feel on the day. These herbal recipes and procedures have been handed down through generations and are totally free of petrochemicals, synthetic perfumes or colouring. Some of the herbs and spices are grown in Sukko’s own herb garden and picked just for your treatment, ensuring they are as fresh as can be. I was pampered with the ‘All-Soother’ package, a 2 1/2 hour experience that left me feeling relaxed and refreshed. This four-treatment combination began with 30 minutes in the steam room and the Jacuzzi, followed by a Thai Turmeric Body Scrub designed to soften your skin and awaken your senses. The scrub was followed by a traditional Thai massage, the pressure applied gently but firmly. "Is this pressure okay? Too strong? How are you feeling?" my therapist asked me from time to time. “Mmm… perfect…” were the only responses that seemed to suit how I felt. My last step, which came all too soon, was the Thai Herb Purifying Facial Treatment, using creams and herbs that left my face feeling smooth and glowing – and even looked good enough to eat! Sukko Spa’s restaurant, Suk Savoey Spa Cuisine, presents a unique concept: "Menu by Blood Types" and "Menu by Element". For those who want to exercise, the Suk Sanan Club provides a myriad of fitness opportunities, including ‘Rue Sri Dat Ton’ (the hermit self stretching), a traditional Thai exercise or, for something more strenuous, try ‘Muay Thai Chaiya’, a traditional and effective art of selfdefense. Parents who come to Sukko to relax can leave their kids at Suk Zon Kid's Club, where they will enjoy with a variety of fun yet safe activities. Sukko Spa, one of Phuket’s most luxurious spas, is located on Chaofa Road just 30 minutes from Phuket International Airport, 10 minutes from Phuket Town, 30 minutes from Kata or Karon Beach and 20 minutes from Patong Beach. It is creatively designed in a contemporary Thai style, set amongst 15 rai (6 acres) of luxuriously landscaped tropical forest.

To visit this home of award-winning spa oils, creams, soaps and so many other exquisite products is a delight. The aromas are enchanting. At Lemongrass, you can enjoy a spa treatment to sample and choose from their huge range, then take home your choice to enjoy at your leisure. They even have a great range of kid’s spa products.
Bobby Duchowny studied aromatherapy – a healing art that promotes massage, when combined with specific herb and spice oils, as a method to reduce stress, boost energy and heal certain physical ailments – at the American Aromatherapy Association. Some years ago while on holiday in Thailand, he visited an organic farm in Petchaboon province and became interested in the natural healing properties of Thai herbs and spices. “I was particularly attracted to lemon grass as it was used in many popular Thai foods, as a medicine for stomach disorders and even as a repellent for mosquitoes,” he recalls. Bobby used lemon grass as his signature herb to create a line of essential oils, face and body creams, shower gels and bath crystals, which he and his wife Palita sold at Bangkok’s world-famous Weekend Market. What started, several years ago, as a modest enterprise has blossomed into a successful operation offering over 90 oils and a wide range of body care products through many outlets, as well as supplying many of Thailand’s top resorts and spas with aromatherapy oils. “Our advantage is that we produce the freshest spa products and our stock is never kept longer than three months; using fresh spa products can be likened to eating fresh food rather than processed food.”
Based on his years of experiences at some of the top spas in Southeast Asia, Bobby has developed a full line of healthy skin care products. For example, his hydrating face and body creams have 25 per cent aloe vera, white orchid and cucumber extracts. And he’s developed a revitalizing mineral muscle soak made from Andaman Sea salt crystals, blended with white orchid and chamomile extracts, to help draw out impurities and soothe and revive tense muscles. “People are sensitive to different scents at different times of day. It’s a good idea to get a variety of essential oils and experiment with what smells and feels good to you,” he says. “Our aromatherapy massage and body oils can be either uplifting or calming to the spirit. They’re carefully balanced handblended oils created by adding pure essential oils to nourishing, vitamin E enriched, sweet almond and jojoba base oils. Lemongrass has won many awards, including Condé Nast Hot List 2007, and has been featured in several top magazines, including Time Magazine’s “Best of Asia”. According to Time, “If you want to smell like no one else, try mixing a selection from the more than 90 natural scents at Lemongrass House.” Lemongrass House is located in Cherngtalay, Surin Beach and Chalong, where you can buy their full range of spa products at modest prices, making perfect gifts for friends and family who can enjoy the aromatic scents of Asia in the privacy of their homes – no matter where in the world they live.

Tipple Travel :
Phuket’s BEST Beach Bars
With the high-season sun burning up the rainclouds, we set out on a mission to find the best spots on the island for drinking and dining with a dash of sea, sun, sand and style. Juggling a notebook and pen with a cocktail in hand is a tough task, but we diligently took on the challenge. Here’s what we found:
East 88 Beach Lounge at Serenity Resort & Residences
With a pool at its heart and the sea and sky stretching out beyond it, East 88 serves up a near-perfect tropical tableau for idling away a sunny afternoon. Watch yachts and long-tail boats glide by in the distance while egrets wade close by in the shallows. Coveted spots are the beachfront double sunbeds, ideal for contemplating the changing hues of the sea. With families welcome, expect to see (and hear) lots of splashy exuberance in the pool. Night time brings smooth DJ tunes. Try this: Sex on Friendship Beach – a nod to its neighbouring resort, this cocktail delivers sweetness with a kick, a blend of vodka, peach liqueur, orange and cranberry juice, and a dollop of banana syrup. serenityphuket.com
Catch Beach Club
Catch Beach has led the way in Surin’s evolution from a low-key stretch of sand to a stylish chill-out spot for sunseekers. By day, the wide dining area is strewn with sun-bronzed holidaying families and business people out to impress, then as the sun sets the cocktails flow more freely and the rhythmic music cranks up. An alarming number of diners were seen on a recent afternoon staring into their smart phones and tablets, yet Catch Beach does its best to keep face-to-face social sparks flying. White cardboard drink coasters give space to write your name, number, email and zodiac sign, easing your chance of reeling in your catch of the day. Best to go: Sunset for a cocktail and the dinner buffet with rotisserie chicken. catchbeachclub.com

Sienna Rocks & Vanilla SkyBar at Cape Sienna Resort
This decidedly ‘kid-unfriendly’ resort bar clings to the rocks at the ‘Millionaire’s Mile’ end of Kamala Bay. Though not on the beach, its sandy floor and sun loungers offer a stylish sunbathing alternative, especially if you opt for a soak and swim in the glittering whitemarble infinity pool (non-guests of Cape Sienna pay 1,000 baht for pool use). Though the bland pop music selection adds little to the ambiance, judging by the number of people seen snoozing poolside this is a prime spot for a peaceful retreat. Be sure to order a ginger and lemongrass martini for some afternoon zip. Best to go: For a fab Friday forget-about-the-week escape, stop in at Sienna Rocks for its daily two-for-one happy hour from 3-5pm, then hop across the road and upstairs to the stunning rooftop Vanilla SkyBar in time for a sunset wine and tapas session. capesienna.com
Baba Nest at Sri Panwa Villa Resort
Sri Panwa’s swish Baba Poolclub was apparently not lofty or exclusive enough for some, thus Baba Nest was created to give the elite set a higher-up hideaway spot. This platform on the top of a private villa features a wraparound pool and incredible sweeping views across a south Phuket seascape. Bean-bag cushions and low round tables lend an intimate, playful air. Inside is a sparkling white dining lounge with a roof-covered terrace to escape into if the winds pick up strength, which are known to sometimes send the sashimi flying. With prices to match Baba’s elevated heights, be prepared for a splurge. Reservations essential. We like: The Baba Daiquiri for sweet refreshment or, for something more tangy, the Sake Mojito. Best to go: Sunset is a must, for the 360º view of the blazing sky. sripanwa.com

Ao Chalong Yacht Club
With more salt than style, the Ao Chalong Yacht Club is a casual open-air waterfront hangout where sailors gather around the bar to trade tales and tips, yet it’s not so clubby that landlubbers seeking refreshment don't feel welcome. In fact, you're just as likely to get roped into a discussion on golf handicaps or local politics as the results of the last regatta. Handy for sea lovers, you can motor your dinghy right up to the club and tie it up to the pontoon pier or haul it ashore up the boat ramp. Service runs on tropical time so don’t expect a speedy meal – all the better for savouring those sea breezes. We like: Views of the Chalong Bay panorama, taking in the pier, Khao Khat, Lon Island and dozens of bobbing yachts in the bay. Borrow the bar’s binoculars for a better look. Best to go: Happy hour from 5-7pm, to save an extra 10 baht on the already well-priced beer. acyc-phuket.com
The Boathouse Wine & Grill and Re Ka Ta
The first spot in Phuket to bring sophistication to the sands, The Boathouse recently emerged from an extensive makeover and is now looking poised to reel in a new generation of wining and dining globetrotters. Wine lovers, indeed, are sure to salivate over the big red menu listing more than 800 selections. With friendly wait staff helpful almost to a fault, you’re treated like royalty here – though expect to pay royal prices, too, for the French and Thai fare. The Re Ka Ta beach club, opened in late November, promises to ante up the beach chic with poolside dining and an all-new menu. We like: The marvellous mojito cocktail – fresh, zingy and perfect for toasting the setting sun. Best to go: Happy hour from 5-7pm to enjoy a sundowner with 50 percent off drinks (except wine). boathousephuket.com

ARBITRATION AND MEDIATION OF CONTRACTUAL DISPUTES IN THE KINGDOM OF THAILAND (PART 1)
The question often arises amongst businesses and individuals alike as to whether it is advisable to arbitrate or mediate a contractual dispute in lieu of filing a complaint directly with a civil court in Thailand. In many cases, arbitration or mediation may be an option but electing to arbitrate or mediate, and bypass direct civil litigation at least temporarily, should be carefully considered by the party considering pursuing a claim under a contract. There is often confusion as to the difference between the terms ‘arbitration’ and ‘mediation’ and this article provides some clarification in respect of these options, basic processes for implementing these options and when such may be available to the parties. Furthermore this article briefly summarises the potential benefits of electing an alternative dispute resolution procedure to resolve a contractual dispute. When laypersons elect not to use lawyers, and simply cut and paste old contracts, they often forget that the disputes clause may one day be used, and therefore a skilled professional should be asked to provide an opinion on that particular clause in all contracts.
arbitral proceeding, and may indeed act as the arbitrator of a particular case, although it is advised that they have a qualified legal background in Thailand or another country in order to understand the nature of the transaction, legal obligations, and dispute resolution. In the case of an arbitrator, if such a person is a foreigner, then he or she must possess a valid work permit in Thailand, and be enrolled as with the TAI on the list of arbitrators. The credentials of the arbitrator should be scrutinized. Once an arbitration proceeding is filed, the general arbitral process is as follows: • The complaining party (the Claimant) files a Statement of Claim setting out the basis for the dispute and the request for an award; • The responding party (the Respondent) then files Statements of Request (motions) or a Statement of Defence and Counterclaim; • The Parties submit an appointment of the arbitrator(s); • After an arbitrator is appointed, the Parties meet with the Arbitrator to set out procedural issues and to set a hearing date; • On the hearing date, parties to present evidence and argue their case in front of the arbitrators; • The arbitrators rules on the case and issue an arbitral award in favour of a party or dismiss the case. Arbitration fees and costs are distributed according to the rules. The timeline for the entire arbitration procedure can vary from 6 months to over a year. Should the arbitrators issue an award, this award is generally binding on the parties under the Act and arbitration agreement, but if enforcement is necessary the prevailing party typically must proceed to the Thai civil courts for execution of judgment.
Overview of Arbitration
Parties to a contractual dispute may have the option to resolve a dispute through arbitration subject to the drafting of their contract(s). In a contractual dispute, at the time a contract is signed the parties should have considered whether or not to include a so-called ‘arbitration clause’ in the contract whereby the venue and rules of the arbitration proceeding are agreed upon. Many commercial contracts, and in particular contracts in real estate, that are performed in Thailand provide for referral of a case to arbitration in the event a dispute occurs as to the construction, interpretation, or a default by one of the parties under the terms of agreement. If the agreement has included an arbitration clause, and the agreed jurisdiction for the arbitration proceeding is in Thailand, typically the Thai Arbitration Institute in Bangkok (TAI) is the venue of choice which is attached to the Office of the Judiciary under Alternative Dispute Resolution Office. Otherwise the parties may have elected to proceed at an offshore international arbitration tribunal in jurisdictions such as in Hong Kong or Singapore. More often than not, it seems the reason for a choice of venue hasn’t been considered properly with regards to the subject matter of the contract. In Thailand, arbitration procedure is governed by the Thai Arbitration Act B.E. 2545 (2002) (the “Act”) and the rules and procedures of the arbitration venue hearing an arbitration case. For example, the TAI promulgates the Thai ‘Arbitration Rules’ (the “Rules”) which are essentially the code of civil procedure for a case filed at the TAI. In the event the rules or the Act do not cover a particular procedural matter at issue in a case, the rules of the Thai Code of Civil Procedure may ‘fill in the gap’ for clarification of the particular matter. In accordance with Section 11 of the Act, to file a case in the TAI an ‘arbitration agreement’ should be in place. The arbitration agreement could be an ‘arbitration clause’ to a contract or a separate agreement to mutually refer the case to arbitration. In either case, the agreement should be in writing and signed by all parties who wish to refer the case to arbitration. Although having an arbitration agreement is not a strict requirement to commence arbitration, one is highly recommended. This is because the agreement could set out the basic rules of the arbitration proceeding as the parties prefer, including setting the language in which the proceeding will be conducted, the number of arbitrators, and how the costs of the proceeding are to be distributed. Even non-lawyers can directly participate as the representatives of parties to an

There has been a lot of water flooding into Bangkok and other regions lately, and even buying bottled water in Phuket has been difficult for some as the floods reduced supply to supermarkets and outlets. A recurring question posed by many tourists and residents to Phuket is can I drink the water? From a health perspective, the answer to that question is not as clear as the water should be.
According to local health authorities, tap water in Phuket Town and Patong is safe to drink. There are even signboards around Phuket advertising this claim. “The water supplying these two municipalities is treated and checked based on drinking water standards set by the Thai Industrial Standards Institute and the World Health Organization”, said Sayan Wareearunroj, Manager, Phuket Provincial Water Works Office some years ago. However, he cautions that a regular check of water pipes within and leading to the home is necessary to prevent contamination, as the water may be safe when it leaves the processing plant, but it may become contaminated because of debris and other contaminants entering the supply from broken pipes, corrosion or other sources. Outside of Patong and Phuket Town, it's generally accepted that water treatment systems are either non-existent or not scrutinized, and most would advise caution when drinking from these sources, if at all. However, many residents who live in the more rural areas of Phuket would claim that they have been drinking the water for many years without complications, so the answer remains as clear as mud. Drinking contaminated water could cause diseases such as typhoid, polio, hepatitis A or cholera – but these are very rare in Phuket. The

Water most common problem associated with drinking contaminated water is gastroenteritis (diarrhea) from bacteria. Parents should take note that fluoride is not added to any water source on the island. Phuket also sources its water from dams and catchment areas, as well as water stored in deep abandoned tin mines, and for many, bore (ground) water is used. The quality of the water that you receive from your source can be tested; however, testing requires proper collection bottles and should be sourced from a certified laboratory. One laboratory in Bangkok, Test Tech Company Ltd Tel: 02 8773271-74 will send you the bottles and instructions on shipping requirements to Bangkok. Local companies such as Environmental Solutions & Protection Corporation (ESP) Tel: 081 030 4278 will also arrange for testing; a comprehensive “International Standard Drinking Water Analysis” from a lab and will cost around 14,000 baht, covering 34 tests for bacteria, physical and chemical properties as per most international and WHO requirements. If the water is found to have unsafe levels of contaminants, a reputable filter from a well know international company such as a reverse osmosis or UV light system can be installed at a cost of around 20,000 baht. Cheaper copies of these filtration systems are available from most hardware stores. An alternative is to use bottled drinking water, which is inexpensive and can often be delivered right to your home. For the large 20 litre plastic containers that are sold across the island, my understanding is that no governmental standards or checks are applied to check the quality of this water, and the cleanliness is left solely to the businesses who bottle it, as is cleaning the returned bottles and containers. I used to use this water for many years, until I started
receiving containers with sediment and green algae inside the bottles indicating that they may not be as clean as they should be. Another more expensive alternative is to buy branded water, such as Nestle or Singh water from the supermarkets and shops. Being more expensive does not guarantee that it's pure though, so the choice is yours. Installing and then maintaining a filter system maybe the safest approach.
