JUDGMENT For the reasons explained this day in the courts Findings of Fact and Conclusions of Law, the court hereby enters Judgment as follows: 1. Apotexs generic equivalent of Alcons patented allergy topical ocular medication, Patanol, that is the subject of Apotexs ANDA No. 78-350, infringes claims 1-8 of United States Patent No. 5,641,805 (the 805 patent). 2. Apotex is liable for direct infringement of claims 1-8 and for contribution to infringement of claims 1-8. 3. 4. 5. Claims 1-8 of the 805 patent are valid. The claims of the 805 patent are enforceable. Pursuant to 35 U.S.C. 271(e)(4)(A), the effective date of any Food and

Drug Administration approval of Defendants ANDA No. 78-350 shall be not earlier than December 6, 2015, the expiration of the 805 patent (including pediatric exclusivity). 6. Judgment is hereby entered in favor of Plaintiffs, Alcon Research, Ltd. (f/k/a Alcon Manufacturing, Ltd.), Alcon Laboratories, Inc., and Kyowa Hakko Kirin Co. Ltd. (f/k/a Kyowa Hakko Kogyo Co. Ltd.), and against the Defendants, Apotex Inc. and Apotex Corp., as to all claims in Plaintiffs Complaint and all claims in the Defendants Counterclaim. Defendants shall take nothing by way of their Counterclaim.

SO ORDERED this 23rd day of May 2011.
