M. on this date. he was delivered into the custody of the Immigration and Naturalization Service, Ellis !elend, New York City.

On December 12, 1941, subjected executed two copies of a consent to the search of his residence located at 9906 69th Avenue, Forest Bills. Long Island, Ne~ York, authorizing Special Agents~ an~ to ta~ anr of his property which may be desired. Both copies of this consent are being retained 1n the file. of this case 1n the New York Field Office.
On Dece~ber 18, 1941. a search was conducted of the home of subject. 9906 69th Avenue. Forest Hills. Long Island, New York. by Srecia1 Agents. 7& and .... Present at the U;ne of thi8 search was Min CAROL BEIU;A.:..'i.D. ~L Mise BER:.iA.~. who advised that she resided at 114-15 Jamaica Avenue. Jamaica. New York, was Dr. REICH's medical assistant. She stated that ahe i. a graduate ot Paine Ball School of Technical Train1ng, Jamaica. New York. She further advised that her aalary is $80.00 per month. and that this posit1on was obteined thro~h contact an~ acquaintance of Mias ILSE OLLENDORF. while attending Paine Ball School. She also advi&ed that she had worked for Dr. F~rCH for .the paat .9 months and that be wa~ the best employer that she had ever worked for, and· that Dr. BErCH made her feel al thoUCh ·she vere .... orkin' "with ".b.1lA rather thai for him." I refer to Mr. ~. M. C. Smith's memorandum to me dated June 28, development, and mea.ning of the Spec'iaI Case work and of the danger classifications that were made as a part of that worle. After full re-consideration of these individual danger classifications, I am satisfied that they serve no useful pUrpose. The detention of alien enemies is being dealt with under the procedures established by the Alien Enemy Control Unit. The Special Case procedure has been found to be valueless and is not used in that connection. There is no statutory authorization or. other present justification for keeping a ncustodial detention" list of citizens. The Department fulfills its proper functions by investigating the activities of persons who may have violated the law~ It is not aided in this work by classify1na persons as to dangerousness. Apart from these general considerations, it is now clear to me .that this classification system is inherently unreliable. The evidence used for 'the purpose of making the classifications wasinadequatej t.he standards applied to the evidence for ·the purpose of making the classifica'tiona were defective; and finally, the notion ~t ii is possible to make a valid determination as to how dangerous a person is in ~he abstract and without' reference to time, environment, and ot~er relevant ;circumstances, is impractical, unwise. and dangerous. For ~he foregoing reasons I ameatisified that the~ptlon of this classification system was a mistake that should be rectltiedror the fUture.
