Attorney General Van Hollen announced today that the Department of Justice will not petition the Supreme Court to review the Wisconsin Court of Appeals decision that reversed the misconduct in office convictions of former Representative Scott Jensen and his aide Sherry Schultz. Under the Court of Appeals decision Jensen and Schultz will get new trials. Dane County District Attorney Brian Blanchard plans to request a retrial at the “earliest opportunity”. • Special Session

The Wisconsin Taypayers Alliance reported this week that Wisconsin sales tax rose just 0.8% in 2006, while corporate income tax rose 14.1% and individual income tax 7%. The lagging housing market, high cost of oil, and internet sales are all contributing to the sluggish sales tax. This could be a problem for Wisconsin because the 2007-09 state budget assumed sales tax collections would be 3.6% in 2007 and 3.9% in 2008; sales tax is a large portion of the state general fund. If sales tax collections continue to lag the state could face cash flow deficit of close to $375 million over the biennium. Representative Steve Nass (R-Whitewater) who voted against the 2007-09 spending plan sent out a press release noting “that the State of Wisconsin has done no planning for the potential of a significant economic slowdown or recession. Every day state government operates, it does so on revenue projections that are intentionally optimistic and simply the byproduct of a horrible budget deal cut by Governor Doyle and legislative leaders”. • Wisconsin Department of Revenue v. The Supreme Court heard oral arguments this week in a familiar case about whether mass marketed computer software that is modified and customized to better suit a customer’s need is taxable under state law. The Dane County Circuit Court ruled that the software is subject to sales tax, while the Wisconsin Court of Appeals sided with Menasha Corporation. Wisconsin One Executive Director Scot Ross issued a statement calling for new Justice Annette Ziegler to recuse herself from the case because of Wisconsin Manufacturers & Commerce’s ties to the Menasha case and its $2 million involvement in Ziegler’s recent Supreme Court race as well as a contribution from a former executive of Menasha Corporation.
