discrimination complaint

A gay man has charged in a discrimination
complaint that he was red last week from
his job at the Library of Congress after
being harassed and humiliated for more
than a year by a supervisor who repeatedly
cited passages from the Bible condemning
homosexuality.
Peter TerVeer, 30, a management analyst
at the Library of Congresss Ofce of the
Inspector General since 2008, says in his
complaint that supervisor John R. Mech
created a hostile work environment for him
to such a degree that he suffered severe
stress, forcing him to take disability leave last
fall and earlier this year.
I contend that I have been subjected
to a hostile work environment by Mr. Mech
since August 2009 on the basis of my sex
(male), sexual orientation (homosexual),
and religion (non-denominational Christian/
Agnostic), TerVeer states in an afdavit
accompanying his complaint.
I maintain that Mr. Mech has acted to
impose his religious beliefs on me, TerVeer
says in the afdavit.
TerVeers attorney, Thomas Simeone, said
he will likely le a discrimination related
lawsuit against the library on TerVeers
behalf regardless of how the federal Equal
Employment Opportunity ofce at the
Library, which is deliberating over the
complaint, rules on the matter.
Gayle Osterberg, director of
communications for the Library of Congress,
said TerVeers complaint is considered a
personnel matter and the library never
comments on personnel-related issues

Advocates cheer departure
of campaigns most anti-gay
candidate

Rick Santorum announced on Tuesday
he would no longer pursue the Republican
nominarion lor rhe Whire House, encin
the campaign of arguably the most anti-gay
candidate seeking the presidency.
Durin a speech in GerrysLur, Fa., rhe
former U.S. senator announced he decided
to suspend his campaign after taking a break
to care for his three-year-old daughter who
was hospitalized over the weekend.
"We mace a cecision ro er inro rhis race
at our kitchen table against all the odds, and
we made a decision over the weekend that
while this presidential race, for us, is over
for me, and we will suspend our campaign
effective today, we are not done ghting,
Santorum said.
The departing candidate took no
questions after his exit speech, nor did he
endorse another candidate.
Santorum, who represented Pennsylvania
in the U.S. Senate from 1995 to 2006, won 11
states and earned 285 delegates, the second
highest of all the presidential candidates
behind Mitt Romney.
The candidates exit comes before the
primary in his home state of Pennsylvania
on April 24. Polls showed Santorum was
narrowly ahead in the race. According to a

Mayor hosts screening of
documentary lm Bully

D.C. Mayor Vincent Gray was scheduled
to announce a citywide anti-bullying
initiative Wednesday night at a private
screening hosted by the mayors ofce of
the documentary lm Bully.
This comprehensive plan brings
together D.C. government agencies,
nonprot organizations, community
partners, and educators across the city to
nd solutions to confront and eradicate
bullying across the District, a statement
released by the mayors ofce says.
The statement says the initiative, called
the Anti-Bullying Action Plan, is to be
led by the citys Ofce of Human Rights,
according to the statement.
Grays anti-bullying plan comes less
than two weeks before a D.C. City Council
committee was expected to vote on an
anti-bullying bill that has been stalled in the
Council for nearly two years. The bill calls
for the citys public and charter schools,
the Department of Parks and Recreation,
the public library system and the University
of the District of Columbia to develop
comprehensive anti-bullying policies.
A spokesperson for Council member
Tommy Wells (D-Ward 6), whose
committee is expected to vote on the bill,
said he was uncertain when the bill would
be voted on by the full Council.
The mayors proposal calls for the
creation of a multi-stakeholder task
force, the commissioning of a research
report, creation of a model anti-bully
policy and standards, and a D.C. Agency
and Stakeholder Forum.
The statement released by the mayors
ofce says the task force would consist
of the citys police chief, chancellor of
the D.C. Public Schools, director of the
mayors Ofce of GLBT Affairs; director of
the Department of Parks and Recreation,
director of the Department of Health,
the head of the Department of Youth
Rehabilitation Services, the director of the
Ofce of Disability Rights, head of the Child
and Family Services Administration, and
the University of the District of Columbia.
The problem of bullying transcends
the school yard, said Gustavo Velasquez,
director of the D.C. Ofce of Human
Rights. It is a fundamental issue of human
rights, and requires the entire city to be
present to promote solutions, he said.
We need to investigate where the
bullying occurs in the city and what makes
the District different from other cities in
incidents of bullying so we can develop
and implement solutions to best help our
youth, Velasquez said.
Gray said in a statement that his plans
multi-sector approach would seek
to address the bullying problem in a
comprehensive way.
When one in ve children are targets of
bullying each day, and these events all too
often lead to severe social and emotional
crises for our youth, we must let our youth
know that we hear them, Gray said.
We must come together government,
nonprots, advocates, teachers and parents
to eradicate bullying in the District, and
promote safe and inclusive schools.
The screening of the documentary
Bully was to take place at the E Street
Cinema.
Charles Allen, chief of staff for Council
member Wells, said one of the reasons
the Councils anti-bullying bill had been
stalled was an initial inability to determine
where funds could be identied to pay for
implementing the legislation.
In his statement issued prior to his
announcement of his anti-bullying
initiative, Gray did not say what the cost
of his plan would be and how funds would
be obtained to pay for it.

The White House remains mum about
the idea of President Obama issuing an
executive order requiring federal contractors
to bar discrimination against LGBT workers
despite a call Monday for him to take
action from a gay couple that participated in
the annual Easter Egg Roll event.
Under questioning from NBC News
Kristen Welker on Monday, White House
Press Secretary Jay Carney said he has
no updates on possible or proposed
executive orders when asked to respond
to the gay couples request.
I dont have updates for you on
possible or proposed executive orders,
Carney said. I would note that were
delighted that that couple and many
others were delighted to attend the Easter
Egg Roll and, again, I dont have anything
more on the executive order.
Jarrod Scarbrough and Les Sewell, who
hail from Albuquerque, N.M., and have
been partners for 18 years, intended to ask
Obama to issue an executive order requiring
companies doing business with the federal
government to have non-discrimination
policies protecting LGBT workers during the
White House Easter Egg Roll on Monday.
Asked by NBC News about why the
couple was attending the event, Carney
said the couple was invited along with
other families of all kinds that had been
asked to attend.
Well, theyre here because they were
invited and the president you know,
many, many people families of all kinds
are invited to this wonderful event and
the president is delighted that they and
others were able to attend, Carney said.
Asked to comment further on the
couples actions, Carney reiterated
previous comments hes made in response
to LGBT-related inquiries on Obamas
record on LGBT issues.
I dont have anything for you on
a specic executive order, Carney
said. What I can tell you is, I think, the
presidents position on LGBT issues
record, rather is well known and one
that he and we are very proud of.
The exchange marks the rst time that
a mainstream media outlet has publicly
questioned an administration ofcial about
the proposed executive order. Previously,
all inquiries had come from the LGBT press.
During a conference call with reporters
Monday, Scarbrough said hes seeking
the executive order because he works for
a federal contractor, United Healthcare.
According to the Human Rights
Campaigns 2012 Corporate Equality
Index, the company already has non-
discrimination policies set up inclusive of
sexual orientation and gender identity.
But Scarbrough said he felt it was
important to push President Obama
on an executive order because United
Healthcares policy is voluntary and hes
being relocated to Florida, which has no
statutory non-discrimination protections
for LGBT people in the workplace.
Because of those reasons, I feel that
it is important to advocate for myself,
my family and any other families around
the nation who are affected by this as
well, Scarbrough said.
But the couple didnt have the
opportunity to speak with Obama. Heather
Cronk, managing director of GetEQUAL,
told the Washington Blade, He was gone
by the time their slot was up.
The couple is one voice in a growing choir that
is urging Obama to take action. Last week, 72
House Democrats wrote a letter to Obama
urging him to issue the order. The Mexican
American Legal Defense and Educational Fund
became the rst non-LGBT civil rights group to
endorse the executive order.
Multiple sources have said the Labor and
Justice Departments have cleared such a
measure, but the White House has remained
silent on whether it will take such action.
Since the executive order is similar
in its goal to the Employment Non-
Discrimination Act, the directive has
sometimes been referred to as the
ENDA executive order. However, the
order would be more limited in scope
because it only affects federal contractors.

Glee actress to speak at
Equality Va. dinner
Actress Dot-Marie Jones, who portrays
a high school football coach in the popular
TV series Glee, was to be a featured
speaker at the statewide LGBT group
Equality Virginias 9th Annual Dinner in
Richmond on Saturday.
Joining Jones as a featured guest and
speaker was David McFarland, interim
executive director and CEO of the Trevor
Project, a national group that organizes
programs to curtail LGBT teen suicide.
The Annual Commonwealth Dinner
is Equality Virginias signature event and
Virginias largest black-tie gala gathering
for the Commonwealths GLBT community
and their supporters, according to a
statement on the groups website.
In addition to live entertainment and a
silent auction, the dinner will include the
presentation of Equality Virginias annual
OUTstanding Virginians award to ve

Kameny estate drops
lawsuit against two activists
Timothy Lamont Clark, who was named
by the late gay rights leader Frank Kameny
as the main beneciary of Kamenys
estate, has withdrawn a lawsuit he led
last month against two of four friends and
fellow activists of Kamenys.
Through his attorneys, Clark on March
29 asked a D.C. Superior Court judge to
dismiss the lawsuit against Charles Francis
and Bob Witeck. One of the attorneys,
Glen Ackerman, said the suit was dropped
after Francis and Witeck agreed to return
to the estate property that the suit claimed
the two men wrongfully removed from
Kamenys house shortly after he died last
October.
Ackerman said Francis returned 17
boxes containing a wide array of Kamenys
belongings, including a World War II-era
military uniform and military metals, which
Ackerman said belong to Kamenys estate.
He said Witeck returned a collection
photographs.
Francis and Witeck said before the suit
was led that they had taken the items for
safekeeping and planned to return them.
Kamenys will named Clark as his personal
representative as well as the beneciary of
his house and all other possessions except
his papers, which he bequeathed to the
Library of Congress.
The two others named in Clarks lawsuit
Richard Rosendall and Marvin Carter
have yet to return items they allegedly
took from Kamenys house shortly after
Kameny died, Ackerman said.

Referendum fails for
Baltimore Co. trans law
In a little-noticed development,
opponents of a transgender non-
discrimination law approved earlier this
year by the Baltimore County Council
attempted to kill the law by circulating
petitions to gather signatures needed to
place it on the ballot in a referendum.
Organizers announced on Tuesday that
they failed to obtain signatures from the
required three percent of voters in the
county needed to place the law on the
ballot. The law bans discrimination against
transgender people in the county in the
area of employment, housing and public
accommodations.
With the referendum process
stopped, the law took effect Monday.
Baltimore County becomes the fourth
jurisdiction in Maryland to put in place
a non-discrimination law protecting the
transgender community. Baltimore City,
Montgomery County and Howard County
have similar laws on the books.
Dana Beyer, executive director of the
statewide transgender advocacy group
Gender Rights Maryland, said the group
is considering pushing for a trans non-
discrimination measure in Prince Georges
County next year.

obituary
Vann Chen, 52
Vann Chen, a longtime D.C. resident
and self-employed tailor and clothing
designer, died March 31 at his Dupont
Circle area apartment. He was 52.
Danny Aviance, his close friend and
roommate for 17 years, said Chen died
in his sleep. He said the citys Medical
Examiners ofce was still in the process of
determining the cause of death.
Aviance said Chen was the youngest of
nine children born and raised in Vietnam
to Chinese parents. He said Chen arrived
with family members in the U.S. in 1979
or 1980 on the West Coast. Aviance said
Chen initially moved to the D.C. area
to help his sister operate a family-run
restaurant in Falls Church, Va.
During the years that Chen shared an
apartment with him on 16th Street, N.W.,
near Dupont Circle, Aviance said Chen
established a following as an acclaimed
clothes maker who enjoyed making a
living sewing.
He had a style like nobody else,
Aviance said. He did everything from
wedding dresses to throw pillows. He
literally threaded his way into peoples
lives.
Aviance and Chens friend Eileen
Rappoport said Chen also was well known
in the 1990s and early 2000s as a popular
gure at D.C. gay nightclubs, including
Tracks and later Velvet Nation before the
two clubs closed to make way for real
estate development.
Rappoport called Chen an icon in the
D.C. area to those who were regulars at
some of those clubs, especially Tracks.
When Vann arrived, it was a party, she
said. His talent in bringing life and light
to anywhere he went is legendary.
Rappoport added, He was also a
talented designer and seamstress. Many
a bride walked down the aisle in a Vann
Chen original. And like his work with
fabric, Vann weaved himself into my life
and the life of many creating a family that
celebrated the best of life and grieved
when the worst occurred. He was there
to support each and every one of us and
made us better people along the way.
Aviance said he remembers Chen as
the funniest, kindest, sweetest person
he ever knew.
Chens friend David Delatour said Chen
excelled in interior design as well as
clothing design and the term tailor by
itself wouldnt do him justice.
Vann was a high-end artist. His canvas
was the human body and the home, and
his paint was fabric and the needle, said
Delatour. I have never seen anyone do
what he did with his craft.
Delatour and Mark Lee, a nightlife
advocate and former owner of the gay
nightclub Lizard Lounge and other
venues, said Chen was also a generous
supporter of community fundraisers at
the clubs, especially those for AIDS- and
LGBT-related causes.
A memorial service is planned for April
28 at 9 p.m. with midnight toast on Chens
birthday, at Townhouse Tavern Upstairs
(next to Cobalt), 17

and R streets, N.W.
In accordance with his wishes, Chen was
cremated, with his ashes to be sent to
Vietnam, where they will be buried at the
site of his parents interment, Aviance said.

Baldwin raises $2 million in 1

MADISON In a message via Twitter on Wednesday, Rep. Tammy Baldwin
(D-Wis.) announced she secured $2 million in the rst quarter of 2012 from 24,260
supporters in her bid to become the rst openly gay person elected to the U.S.
Senate.
The support for our campaign to ght for the middle class and stand up to
the powerful special interests is humbling and invigorating, Baldwin wrote in a
subsequent tweet.
Baldwin who is seeking to replace Sen. Herb Kohl (D-Wis.) says shes
in a strong position with $2.7 million in cash on hand and more than 40,000
individual supporters for her campaign, and has in previous cycles outraised her

GLAAD, Miss Universe agree on trans inclusion
NEW YORK After initially barring Jenna Talackova from competing for the
Canadian Miss Universe title, the organization behind the pageant has reinstated
the trans beauty queen and said it will no longer bar trans contestants from
participating, according to GLAAD.
For more than two weeks, the Miss Universe Organization and Mr. Trump
made it clear to GLAAD that they were open to making a policy change to include
women who are transgender, said GLAAD spokesperson Herndon Graddick.
We appreciate that he and his team responded swiftly and appropriately
Jenna and all of the LGBT advocates who have called for this change and
spoken out in support of transgender women are to be commended, Graddick
continued. At a time when transgender people are still routinely denied equal
opportunities in housing, employment and medical care, todays decision is in

Pro-Prop 8 witness opposes N.C. amendment
RALEIGH A central witness for the proponents of Proposition 8 in the Perry v.
Schwarzenegger federal case has used a News & Observer editorial to advocate
against North Carolinas proposed constitutional amendment banning state
recognition of same-sex couples.
David Blankenhorn and Elizabeth Marquart began the piece by asserting their
opposition to same-sex marriage, but go on to say the proposed amendment
goes too far and could have far-reaching legal consequences not yet known.
For one thing, it means that North Carolina could not, now or ever, take any
step or devise any policy to extend legal recognition and protection to same-sex
couples, the pair write. No domestic partnership laws. No civil unions. Nothing.
Polling for the amendment has been mixed recently, and some advocates are
optimistic that this could be the rst such ballot measure defeated since such
a measure was voted down in Arizona in 2006, before a less stringent version
passed two years later.
Lambda Legal sues Ohio school over T-shirt
WAYNESVILLE, Ohio When Maverick Couch wore a T-shirt to school reading,
Jesus is not a Homophobe on the 2011 National Day of Silence, the school
threatened him with suspension.
Couch, however, researched his free speech rights and came to the conclusion
the school could not bar him from wearing the shirt, so the high school student
challenged the school.
A year later, Lambda Legal announced it would represent Couch as he sues the
Waynesville school district for the right to wear the shirt.
Schools should be in the business of educating students about First
Amendment freedoms, not trampling on their right to express themselves, said
Christopher Clark, Senior Staff Attorney for Lambda Legal.
Earlier this week, the school agreed to allow Couch to wear the shirt as the case
proceeds through the courts.

President has long

The Obama campaign has ofcially
stated that the presidents opposition to
divisive and discriminatory measures
targeting LGBT families extends to a
pending anti-gay marriage ballot initiative
in Minnesota.
In a statement released this week,
the Obama campaigns Minnesota
communications director, Kristin Sosanie,
said Obama does not support the
measure, which would make a ban on same-
sex marriage part of the state constitution.
While the president does not weigh
in on every single ballot measure in
every state, the record is clear that the
president has long opposed divisive and
discriminatory efforts to deny rights and
benets to same-sex couples, Sosanie
said. Thats what the Minnesota ballot
initiative would do it would single out
and discriminate against committed gay
and lesbian couples and thats why the
president does not support it.
The statement is identical to the
statement the Obama campaign issued
against a similar anti-gay ballot measure
thats pending in North Carolina. The
only difference is that the state has been
changed from Minnesota to North Carolina.
White House Press Secretary Jay
Carney has had similar words when asked
about anti-gay marriage measures during
White House news conferences, saying
the president has long opposed divisive
and discriminatory efforts that deny rights
and benets to same-sex couples.
In an organizational statement,
Minnesotans United for All Families
thanked the Obama campaign for coming
out against the amendment.
Were happy that President Obama
and Minnesotans from all walks of life
see this amendment for what it is a
government exclusion to a group of
people simply because of who they are,
the organization said.
Like the North Carolina statement, the
statement on Minnesota is an update
from a statement the White House put
out against the amendment earlier in May
when the legislature rst voted to send the
measure to voters. The statement at the
time didnt as clearly articulate opposition
to the measure.
The president has long opposed
divisive and discriminatory efforts to
deny rights and benets to same-sex
couples or to take such rights away,
Shin Inouye, White House spokesperson,
said at the time. While he believes this
is an issue best addressed by the states,
he also believes that committed gay
couples should have the same rights and
responsibilities afforded to any married
couple in this country.
While the Obama campaign has
weighed in on ballot measures in
Minnesota and North Carolina, it has said
nothing about the pro-marriage equality
measure in Maine, nor anything about
possible referenda over marriage equality
laws in Washington State and Maryland.
Obama said he could evolve to support
same-sex marriage, but hasnt yet publicly
backed marriage rights for gay couples.

visa, woman faces
deportation to Pakistan

Sen. John Kerry (D-Mass.) is seeking to
aid a married lesbian couple in his state
by asking the Department of Homeland
Security to take administrative action
to ensure the foreign national in the
relationship wont be deported to Pakistan.
In a redacted letter dated March 27 and
obtained last week by the Washington
Blade, Kerry asks Secretary of Homeland
Security Janet Napolitano to hold in
abeyance the I-130 marriage-based green
card petition for the couple until the
Defense of Marriage Act is overturned
either by Congress or the courts.
I know that you and I both believe
that every family is worthy of recognition
and respect, and that no family should
be torn apart based on a discriminatory
law, Kerry writes. Abeyance will allow
this remarkable young couple to move
forward with their dream of building a life
together at home in Massachusetts.
The couple is using their rst names
only, Gloria, a Pakistani national, and
Jackie, who are both 24 and reside
together in Beverly, Mass. The two met
as roommates in college in 2008 and
their shared Christian faith brought them
closer. After falling in love, they married in
Massachusetts in October.
But Glorias student visa expired after
she could no longer afford tuition and had
to stop attending school last year, ending
her legal status in the country and putting
her in a situation where she could be
deported to Pakistan.
In March, Jackie led a marriage-based
green card petition to sponsor Gloria
for residency in the United States. U.S.
Citizenship & Immigration Services has
yet to make a decision on the petition,
but it will likely be denied unless its held
in abeyance because DOMA prohibits
federal recognition of same-sex marriage.
Their attorney, Lavi Soloway, co-founder
of Stop the Deportations and partner at
Masliah & Soloway, redacted their last
names in the letter he gave to the Blade,
saying he did so at their request out of
concern for their safety and safety of family
members overseas. He also declined to
disclose the school they both attended.
Recalling that the Obama
administration has determined DOMA
was unconstitutional and stopped
defending the anti-gay law in court, Kerry
writes this announcement last year left
many same-sex couples wondering how
that will apply to their pending cases and
enables an opportunity for action.

First non-LGBT rights group
to announce support

An organization known as the law rm for
the Latino community has become the rst
non-LGBT civil rights group to announce
support for an executive order that would
require federal contractors to have LGBT-
inclusive non-discrimination policies.
In a letter dated April 5, Thomas Saenz,
president of the Mexican American
Legal Defense and Educational Fund, or
MALDEF, calls on President Obama to take
administrative action to prohibit companies
that do business with the U.S. government
from discriminating on the basis of sexual
orientation and gender identity.
I write to urge you to build on your
successful We Cant Wait initiative in one
concrete way, Saenz said. Specically,
MALDEF asks that you sign an executive
order to ban federal contractors from
engaging in workplace discrimination against
lesbian, gay, bisexual and transgender (LGBT)
individuals, including LGBT Latinos.
Saenz urges the president to issue the
order because the Employment Non-
Discrimination Act, legislation that would
bar job bias against LGBT people, has
stalled in Congress for years.
In recent years, multiple Congresses
have failed to pass the Employment
Non-Discrimination Act (ENDA), which
would ban workplace bias based on
actual or perceived sexual orientation or
gender identity, Saenz writes. MALDEF
believes the time is now right to promote
workplace fairness for LGBT individuals by
taking strong executive action.
Making the case for the order, Saenz
recalls that previous presidents from
Franklin Roosevelt to Bill Clinton have
issued executive orders barring workplace
discrimination. He also cites the military
contractor DynCorp LLC, which implemented
an LGBT-inclusive non-discrimination policy
after it came under scrutiny for anti-gay
harassment on the job; and he notes that top
government contractors, such as Lockheed
Martin, Raytheon and Boeing already have
such policies in place.
Since the executive order is similar in its
goal to ENDA, the directive has sometimes
been referred to as the ENDA executive
order. However, the order would be more
limited in scope because it only affects
federal contractors.
Multiple sources, speaking on condition
of anonymity, have told the Blade
the Labor and Justice Departments have
cleared such a measure, but the White
House has remained silent on whether
it will take such action. A White House
spokesperson didnt immediately respond
to a request for comment on the letter.
Since its founding in 1968, MALDEF has
aimed to promote social change in the areas
of education, employment and immigrant
rights. One victory came in 1982, when a
MALDEF-backed lawsuit known as Plyler
v. Doe prompted the Supreme Court to
strike down a Texas law that allowed school
districts to charge children tuition if their
parents were undocumented immigrants.
The organization has also won legal victories
to make the drawing of Texas congressional
districts more fair to the Latino community.
MALDEF has also taken part in helping
advance LGBT rights. The organization has
led friend-of-the-court briefs in favor of
overturning Californias Proposition 8 and is
part of a coalition supporting the repeal of
the Defense of Marriage Act. MALDEF has
worked to support passage of the Uniting
American Families Act, which would allow gay
Americans to sponsor their foreign spouses
for residency in the United States, and
was among the rst organizations to stand
with Immigration Equality in calling for the
passage of LGBT-inclusive comprehensive
immigration reform legislation.
According to polling made public last
week by the Human Rights Campaign,
Latinos across America strongly support
of the executive order. The poll, which
found 73 percent of Americans support
the directive, also found the order polls at
72 percent among likely Latino voters in
the 2012 election.
Additionally, the letter comes on the
heels of the publication Thursday of the Pew
Hispanic Centers 2011 National Survey of
Latinos poll showing 59 percent of Hispanic
voters believe homosexuality should be
accepted by society. According to the
report, the data is in line with the general
public. Among the public at large, 58 precent
say homosexuality should be accepted.
The letter makes the group the rst non-
LGBT civil rights organization to endorse the
executive order, but not the rst non-LGBT
group. Last fall, the United Electrical, Radio
and Machine Workers of America, which
bills itself as an organization for rank and le
workers adopted a pro-LGBT resolution that
includes support for an executive order
protecting LGBT people against workplace
discrimination. Mary Kay Henry, a lesbian
and president of the Service Employees
International Union, endorsed the order in
an interview with the Washington Blade in
June during Netroots Nation.
Support for the idea of the executive
order is building. Earlier this week, a group
of 72 U.S. House members sent a letter to
Obama calling on him to issue the directive,
saying the measure would extend
important workplace protections to millions
of Americans, while at the same time laying
the groundwork for Congressional passage
of the Employment Non-Discrimination Act
. Rep Frank Pallone (D-N.J.), who drafted
the letter, distributed it among colleagues.

Kerry writes that the case of Gloria and
Jackie clearly justies action because
of the potentially harsh treatment Gloria
would face if sent back to Pakistan.
Homosexuality is a crime punishable by
jail time there and Christians have been
known to face persecution in the country.
She is certain that if she is forced
to return to Pakistan, her life will be in
danger, not only because of her sexual
orientation and her marriage to a United
States citizen, but for religious reasons as
well, Kerry writes.
Its not the rst time Kerry has asked the
Obama administration to take action to
stop the separation of bi-national same-
sex couples. In April 2011, Kerry led a
group of 12 senators who signed a letter
to Justice Department and Department
of Homeland Security asking that the
marriage-based green card petitions for
these couples be held in abeyance.
In a phone interview, Gloria said she
and her spouse feel very frustrated they
face this situation that wouldnt be before
them if they were an opposite-sex couple.
She said she believes the effort will be
worthwhile if some positive outcome
could come out of all this work that were
putting into it.
Additionally, Gloria said she dreads the
prospect of having to return to Pakistan
and face persecution because of her
religious beliefs and sexual orientation.
That would be just a devastating
situation, Gloria said. We dont even want
to think about it. We have built our lives
together here in America and our home is
here. Our friends and family, and everything
that weve built together is here.
In a statement, Jackie also expressed
frustration that DOMA precludes her from
protecting her spouse and that the Obama
administration hasnt yet taken action to
protect married bi-national couples.
It hurts, as an American, to think that my
government causes me and my wife so much
distress by allowing DOMA to do so much
harm, Jackie said. It is not what I expected
of President Obama; I expected more. My
wife and I met in college over three and half
years [ago] and plan to continue building
our lives together. Part of our future will now
be this ght for full equality.
Jackie added that coming out publicly
with their story wasnt an easy decision
because they fear it may mean backlash for
Glorias family in Pakistan as well as for
Gloria if shes forced to return to the country.
But we will not stand by helpless while
our marriage is treated as nothing by the
federal government, Jackie said. I know
that our president in his heart does not
want to do harm to our marriage, and I am
disappointed that hes letting this happen
when he has the power to stop it.
Soloway said the presidents opposition
to DOMA should be matched
with deeds, and that halting the
denial of marriage-based green card
petitions would be consistent with the
administrations stated belief that same-
sex couples shouldnt be forced to make
a choice between staying together and
staying in the country.
The president has an opportunity to
develop policy that protects all LGBT
families impacted by DOMA, Soloway
said. He must now act to save Jackie and
Gloria and thousands of lesbian and gay
bi-national couples who, just like them,
want nothing more than to be able to live
their lives in peace.
LGBT rights supporters have repeatedly
asked the Obama administration to hold
the marriage-based green cards for bi-
national same-sex couples in abeyance on
several occasions, and each time, ofcials
have responded that theyll continue to
enforce DOMA while its on the books.
According to The Advocate, LGBT
groups met with White House ofcials
in January to discuss the possibility of
putting the green cards in abeyance and
administration ofcials told the advocates
that such action wouldnt be taken.
Peter Boogard, a DHS spokesperson,
expressed a similar sentiment when asked
by the Blade to comment on the Kerry letter.
DHS responds directly to members
of Congress, not through the media,
Boogard said. Pursuant to the attorney
generals guidance, the Defense of
Marriage Act remains in effect and
the executive branch, including the
Department of Homeland Security,
will continue to enforce it unless and
until Congress repeals it, or there is
a nal judicial determination that it is
unconstitutional.
While the administration hasnt taken
action to hold the marriage-based green
card applications in abeyance, it has said
it would include bi-national same-sex
couples as part of an effort announced in
August to take low-priority cases out of
the deportation pipeline by granting them
prosecutorial discretion.

John Mech, an accountant and lead auditor
for the librarys Ofce of The Inspector
General, nor any other library employee
familiar with TerVeers case would be
permitted to comment on the case.
Simeone said a key factor in the
case is that library ofcials promoted
TerVeer three times and praised his
work and that negative job performance
reviews suddenly began after Mech
learned TerVeer was gay.
Asked about a policy adopted by
the Library of Congress in the 1990s
prohibiting employment discrimination
based on sexual orientation, Osterberg
declined to conrm whether such a policy
is still in effect.
We adhere to Title 7, period, she said,
referring to a provision in existing U.S. civil
rights law that bans job discrimination
based on race, religion, national origin,
sex and other criteria but not on sexual
orientation.
An internal Librarians Policy Statement
Regarding Non-Discrimination issued
to Library of Congress Employees on
May 6, 2010, reiterates the 1990s-era
statement pertaining to sexual orientation
discrimination.
Discrimination on the basis of race,
color, religion, sex (including sexual
harassment), national origin, age,
disability, sexual orientation, gender
identity, and/or political afliation will not
be tolerated, the statement says.
Osterberg declined to disclose whether
that and previous sexual orientation non-
discrimination statements were still in effect.
TerVeers complaint, led with the
EEOC, follows a September 2008 federal
court decision nding that the Library of
Congress violated federal law against
sex discrimination by denying a job to a
transgender woman.
In that case, the library had determined
that the applicant was qualied and hired
her shortly before she announced she was
transitioning from male to female. When
ofcials learned that David Schroer was
transitioning to Diane Schroer they rescinded
the job offer and refused to hire Schroer.
A U.S. District Court judge ruled
in September 2008 that the librarys
refusal to hire Schroer violated a federal
law prohibiting sex discrimination, a
development hailed by the ACLU as an
important breakthrough for transgender
rights. The library decided against
appealing the case and agreed to an out-
of-court settlement with Diane Schroer in
which it paid her compensatory damages.
U.S. Sen. Charles Schumer (D-N.Y.), who
chairs a joint congressional committee
that oversees the Library of Congress, said
on Tuesday that the committee would look
into allegations that the library engaged in
discrimination by ring TerVeer.
We certainly believe that there should
be no discrimination on the basis of sexual
orientation, Schumer told the Blade
Tuesday following a news conference on
an unrelated issue. So were going to
look into this specic case and make sure
that justice is done.
Thats something Ive stood for my
whole career, said Schumer in referring to
policies aimed at barring job discrimination
based on sexual orientation.
Im head of the committee on the
library, and so we will make sure we get to
the bottom of this, he said.
An ofcial congressional directory of
committees on the House and Senate
websites shows that Schumer is chair
of the Joint Committee on the Library,
which has jurisdiction over the affairs and
administration of the Library of Congress.
Other senators on the committee
include Richard Durbin (D-Ill.), Patrick
Leahy (D-Vt.), Lamar Alexander (R-Tenn.)
and Thad Cochran (R-Miss.). House
members include Rep. Gregg Harper
(R-Miss.), who serves as vice chair; and
Reps. Daniel Lungren (R-Calif.), Robert
Brady (D-Pa.), Zoe Lofgren (D-Calif.), and
Ander Crenshaw (R-Fla.).
At a news conference Wednesday
morning, held in front of the library building
where TerVeer worked, attorney Simeone
said Sen. Schumers expressed interest in
the case, as rst reported on Tuesday by
the Blade, has boosted TerVeers hopes
that library ofcials will take steps to quickly
respond to TerVeers complaint.
On behalf of Peter, we welcome
and applaud his involvement in this
case, Simeone said. We will cooperate
fully, he said, should Schumer open a
congressional investigation.

Gay staffer says superior stalked him
he wants to expose what happened here
at the Library of Congress. And after he
exposes it he wants to make sure it doesnt
happen again.
About a dozen Library of Congress
employees supportive of TerVeer
gathered outside the building to listen to
the news conference. Some said they were
members of the librarys LGBT employees
group called GLOBE.
Asked why he waited nearly two years to
le his complaint with the EEO ofce at the
library after alleging he was subjected to
discriminatory action by his supervisor since
August 2009, TerVeer said he had hoped the
matter could be resolved without his having
to le a formal complaint.
Im from a small town in Michigan, he
said. I came here and this was a job of a
lifetime. This was everything to me.
TerVeer added that he expected to
make a career at the Library of Congress
and the thought of leaving was devastating
to him, prompting him to try to nd a way
to resolve the discriminatory action by his
boss short of ling an ofcial complaint.
He said the hostile work environment,
however, eventually forced him to take
unpaid disability leave beginning in
October 2011. He said he has not been back
on the payroll since then, causing a nancial
hardship that resulted in the loss of his
apartment and the likelihood that he may
have to return to his mothers in Michigan.
Christopher Wiggins, a publicist helping
TerVeer said both he and Simeone were
working on the case on a pro bono basis.
He said the ACLU and the national LGBT
litigation group Lambda Legal were
looking into whether they might join in the
legal effort to help TerVeer get his job back.
Library of Congress:
AWOL for 37 days?
In a March 29 letter to TerVeer, Karl W.
Schornagel, the librarys Inspector General
and head of the division where TerVeer
worked, said he approved TerVeers ring
on grounds that TerVeer had been absent
from work without approved leave or
AWOL since Jan. 4, 2012.
Schornagel states in the letter that
under library personnel rules, absence
without approved leave is considered
a form of misconduct that could lead to
disciplinary action, including dismissal.
I considered that you failed to report for
duty as scheduled for over 37 consecutive
workdays and failed to properly request
approved leave despite being reminded of the
proper procedures for requesting approved
leave and advised of the consequences of
your failure to report for duty as scheduled,
Schornagel said in his letter.
TerVeer told the Blade that library
ofcials approved disability leave he had
requested in October 2011 at the urging
of his therapist and doctor based on the
therapists determination that a hostile
work environment at the library caused
him to suffer severe mental stress.
According to TerVeer, the unpaid
disability leave approved by the library
expired in January 2012. He said library
ofcials declined his request for a transfer to
another ofce and demanded he return to
duty with Mech remaining as his supervisor.
Simeone, TerVeers attorney, said library
rules may have allowed TerVeer to apply
for an extended disability leave. But he
said TerVeer by that time had exhausted his
nancial resources following three months
of unpaid leave and couldnt afford to pay
doctors and his therapist for the necessary
examination and documentation needed
to apply for extended disability leave.
He was in a bind, said Simeone. He
loved working there and he wanted to
continue. And as you can tell, he needed
the money. He tried to get a transfer to a
new setting or a new area, but it was just
not possible. They wouldnt do that.
Simeone said going back to the
ofce where TerVeer knew he would be
subjected to the same harassment and
stress wasnt an option he could accept.
Outed by bosss daughter
TerVeer told the Blade he never intended
to come out as gay at work when he rst
started his job at the library in February 2008.
He said he had recently moved to D.C. from
rural Western Michigan, which he said was
devastated by the economic recession.
With a bachelors degree in business
management from Hope College in
Michigan and his enrollment at the University
of Maryland for a degree in accounting
and auditing, TerVeer said the start of his
employment at the librarys Ofce of The
Inspector General appeared to be a perfect
t for his chosen career path.
The rst year and a half, almost two
years I was there I was closeted and
essentially I was kind of the golden boy in
the ofce, he said. He took me under
his wing and we had a cordial discourse,
he said of Mech. And he appeared to
come off initially as really nice.
TerVeer said the cordial relationship was
based, in part, on their shared interest in
sports and TerVeers role as captain of a
school football team in Michigan. At one
point Mech invited him to join his wife and
son at a University of Maryland football
game, TerVeer said.
As TerVeer tells it, his problems started
just after that, when Mech invited him to
look up his daughter in the late summer
or early fall of 2009. Within days, said
TerVeer, Mechs daughter Katie contacted
him on Facebook and asked to become
Facebook friends.
He said he accepted her request after
using the appropriate Facebook privacy
controls to hide information on his own
Facebook page that identied him as gay.
But a short time later, Facebook put in
place changes in its settings in such a way
that TerVeers link to a Facebook group in
support of gay adoptions became publicly
visible, TerVeer said.
I get home one day and she saw it and
commented and she said, Youre not one
of those weirdoes are you? I said I am
actually, in fact, one of those weird ones
if youre referring to the fact that Im gay.
TerVeer said Katie Mech initially said she
wasnt troubled by this discovery, saying
she had a good friend in San Francisco
whos gay.
However, the following day TerVeer
said he discovered that she had both
de-friended and blocked him from her
Facebook page. Within days of that, John
Mech began raising his religious beliefs
with TerVeer in emails and in face-to-face
conversations with him, TerVeer said.
All of a sudden now, every time Im
going into his ofce hes starting off with a
religious conversation. Then it comes out
where he pointed out he was a believer
with a literal translation of the Bible, said
TerVeer. Then he goes specically into
homosexuality.
TerVeer said he knew then that Katie
Mech informed her father that he is gay.
In his afdavit, TerVeer said things came
to a head on June 21, 2010.
He came into my ofce on that date
and said he wanted to educate me on hell
and that it was a sin to be a homosexual,
TerVeer says in the afdavit. He said
he hoped I repented because the Bible
was very clear about what God does to
homosexuals.
Among other things, TerVeer says in
the afdavit that Mech quoted the Old
Testament passage of Leviticus, stating,
If a man lies with a man as one lies with
a woman, both of them have done what
is detestable. They must be put to death;
their blood will be on their heads.
TerVeer says in the afdavit, He stated
that as a homosexual I could never succeed
because it was against Gods law.
Four days later, on June 25, 2010,
Mech spoke with TerVeer about TerVeers
annual performance review and TerVeer
expressed concern that his ratings were
lower than he believed they should be, he
says in the afdavit.
According to the afdavit, he politely
told Mech he was concerned that the
lower performance review might be biased
because of Mechs strongly expressed
religious beliefs toward homosexuality.
Mr. Mech became extremely upset and
vehemently denied that my homosexuality
and his personal views had an impact
on his rating of me, TerVeer says in the
afdavit. He accused me of attempting
to injure his career and reputation and to
bring down the Library.
TerVeer says in his afdavit that
beginning in July 2010 through the middle
of 2011 Mech appeared to be piling on
work assignments in an effort to set him
up to fail. He said one particular project
he was assigned to handle by himself had
been previously worked on by six full-time
employees and took more than a year to
complete, yet he was told to complete it
during a shorter period of time.
I believe that Mr. Mech gave me this
assignment to set me up for failure and to
give him a better opportunity to identify
and manufacture deciencies in my
performance, TerVeer says in the afdavit.
I believe he decided in advance to give me
negative ratings in my next performance
review and began to create a record of
alleged job deciencies to support this.
In an effort to appeal what he
believed to be an unfairly negative job
performance rating calling for denying
him a normally routine step pay
increase, TerVeer said he approached
Mechs supervisor, Nicholas Christopher,
the assistant inspector general for audits.
Mr. Christopher declined to change my
performance evaluation and denied me a
WIGI [Within Grade Increase] in pay, he
says in the afdavit.

Dance diva playing

Its 11 a.m. on a recent weekday in Burbank,
Calif., and Kristine W. is in a happy mood
she just got measured for alterations for a
dress shes going to wear this weekend for
one of her D.C. performances.
Its a relief, she says en route to a
rehearsal. You have to have something
great to wear in a parade. We just left
the costume shop where they tted it.
Sometimes thats the biggest challenge
nding something to wear.
The dance diva whos famous for having
scored a whopping 16 No. 1 hits on the
Billboard Hot Dance Club chart over a 20-
year recording career, has two gigs slated
for D.C. this weekend shell perform in
a cherry blossom parade then Saturday
night around midnight shell do a 20-minute
mini-set at Town. Though shes only briey
cracked the Hot 100, she trails only Madonna
and Beyonce as the top dance charter for
the 00s and has had more consecutive
dance No. 1s than any other artist.
Shes looking forward to returning to
Town, she says.
Its an amazing club and Ed (Bailey) is a
great guy. And you know, its a real club, its
the real deal. Some clubs are very put on but
this is Town, a real club with real chill DJs.
The dancing queen is a bit of an
enigma shes vague on personal
details though shes talked publicly about
being a Washington state native and a
cancer survivor. She admits to being in a
relationship at the moment, but declines
to elaborate. She has a couple of very
cool kids, a girl and a boy, 11 and 12.
Theyre in school and having a great time.
My girl plays the violin and my boy is a guitar
player and a great golfer. Kristine has lived
in Las Vegas for about 18 years. She says its
a great home base though shes on the road
at least 60 percent of the year on average.
Shes been successful at continuing her
chart success despite the rampant music
industry changes over the last several
years. Kristine says her performances fuel
her recording efforts. Her last album, a jazz
project that had several remixed singles,
did well and led to some cabaret gigs
for her. Next up is a mostly new album
eight new songs and four hits in newly
remixed versions for a project slated to
drop in early June.
Despite all the high-concept
photography and sonic production,
Kristine says she lives a mostly low-key life
when shes not working.
I dont live a ashy life and I mostly put
everything back into my music. My shows
have subsidized my music. I put everything
into promotion, pay my graphic artist,
my project manager, then my livelihood
comes from my live shows.
Kristine gives mostly succinct answers
during a 20-minute phone chat, but a
question about her earliest gay inuences
inspires a story.
The choir director at our church was
gay but nobody ever talked about it, she
says. Theres no way he would have come
out but he was one of my best friends. My
mom would pretend to be his girlfriend
and all four of us my dad had died
when we were little, we were like 2, 3, 4
or 5 when he died but he stepped in
and because I was so crazy about music,
he really had an inuence on me. So he
taught sixth grade and had this award-
winning childrens choir, and my mom was
like we totally get it that you could not say
anything, it would ruin his career, but then
later they were naming a school after him.
He died of cancer when I was like 13. He
would love it now that I have such a gay
following with my music. Im pretty sure
he probably died of AIDS but back then
everybody just said it was cancer.

Gay advice columnist has
new MTV sex show

The Blade caught up with Dan Savage
last week hes plugging his new MTV
show Savage U (Tuesdays at 11 p.m.)
and took a few minutes out of a dizzying
schedule of writing advice columns,
editing newspapers, hosting the new
show and being an anti-bullying advocate
in addition to being a family man to
riff on this and that.
BLADE: Thereve been so many cable
sex advice shows over the years the
old MSNBC shows, Sue Johanson and
even MTVs own Loveline with Dr. Drew
and Adam for those of us old enough to
remember it. What can yours add that
hasnt been done before or does every
generation need its own sex advice show?
SAVAGE: Hopefully what I bring to it is
what I bring to Savage Love (his syndicated
advice columnist which runs locally in City
Paper) a sex-positive, kink-positive
take and one that embraces pleasure as a
legitimate goal that celebrates peoples
desire. A lot of what Ive seen is really kind
of sex negative that starts rst with no,
then with maybe. Savage Love works its
way from maybe to yes to yes, denitely
theres a school of thinking that says, Oh my
God, you cant have sex if theres any risk,
but theres risk in all kinds of things. What
needs to be discussed is how to mitigate
the risk as much as possible but then at a
certain point yes, you have a right to go for
it. You also have to be able to shoulder the
consequences. Theres always a risk but
you dont hear people advocating against
sky diving or snowboarding. Theres a whole
bunch of people who will drop dead today
from eating chicken salad and yeah, youd
be an idiot to leave it out in the sun for three
days and then eat it, so we can apply that
same brainy shit to sex.
BLADE: How do you get these college
students to go on the air and say, I have
herpes or Im a virgin. Are you involved
in nding them or do producers do that?
SAVAGE: There are producers who do
that ahead of time. I need to be hearing
about their stories for the rst time when
we lm, so there are layers of producers
who vet them ahead of time. There are a
lot of old farts like me who think YouTube
and Facebook and Twitter and all that is
something new and always will be, but for
somebody whos 19 and basically grew up
with this stuff, they have different attitudes
about privacy weve started some
taping and then stopped .
BLADE: Why? What would be an
example of someone whose story
shouldnt be aired?
SAVAGE: This was someone who
obviously had a deeper-seated medical
issue that became evident on camera and
we felt talking about the issue would have
unfairly outed the person and would have
been kind of dishonest so we unplugged
the mics we try to be honest and honor
the kids without exploiting anyone.
BLADE: You seem so much nicer on the
show than in your column where you often
seem very exasperated and caustic. Why?
SAVAGE: Well I told someone in the
premiere episode they were an idiot so
Im a little caustic here and there on the
show but I think in the column, some of it
is having to boil so much down to t the
space that it can make me seem more
caustic and sarcastic than I am. Ive had
people say for the podcast I seem so much
nicer but thats the benet of being able to
run my mouth. Its a different venue also
on the show, Im a lot more willing to cut
these kids some slack because theyre 18.
Im a lot more patient with an 18-year-old
fuck up than I am with a 38-year-old fuck
up. Its like of course youre fucked up when
youre 18 because 18 is fucked up anyway.
BLADE: Are you of the school of thought
that a Santorum nomination would have
been better for Obama than a Romney
nomination or does any Santorum success
cause you to shudder?
SAVAGE: I agree with Bill Maher on
that I dont trust the American people
enough to have had Santorum be the
nominee. This is a country that elected
Bush, at least once, he stole it the rst
time, but I would take Romney over
Santorum though theyre two bars set so
low theyre basically on the oor.
