The aforesaid petitioner most respectfully submits that………

On 2nd may 2005 the petitioner was married to Sarita Bist (Respondent) with all Hindu rituals.

At the time of marriage, the petitioner and respondent were and still Hindu.

3. There is no issue till now through that wedlock

11. One day the petitioner vomited when he was having his lunch in office which was made by respondent. 7. That both parties last resided together on 17th march 2008. 10. . The Marriage was arranged marriage and was done with consent of both parties. The respondent never showed interest in marital relations and never cohabited nor even shown respect for petitioner. 6. 9. After that day he always have some problem with food digestion and when he was returning from office on date 21st January 2008feel severe weakness and fainted on floor. Doctor told him that he is suffering from food poisoning and gave him medicine. The respondent frequently use to go at her parental home and took direction for what to do and what not to do which was quite unbearable for the petitioner and created hardship in daily life of petitioner. 5.4. 8. petitioner due to regular mental tension and workload of home as well as his office was filling weak. During 2years.

15. She wept bitterly and uttered that she was mixing a type of “potion” given by fakir to make the petitioner henpecked. The petitioner also recovered a letter written by respondent to her parents about the fact that she is mixing some potion to petitioner.12. The petitioner. on searching found that packet which was used approximately 85% by respondent. the petitioner caught her and asked about that potion. That on recovery the maid (Dropadi) told the petitioner that the respondent uses to buy something from a fakir since last year. . On Tuesday when the respondent was mixing something into food. 16. 13. The petitioner after that incident handed over respondent to her parents without any physical abuse. 14. 17. The petitioner did not ask anything about that fakir from respondent. Petitioner was on bed for few weeks and during that period the respondent’s behaviour was like a guilty person and she always use to say that if I would follow her it will never happen again. 19. 18.

That the respondent and petitioner both live in dehradun within the jurisdiction of the court. 24. The fix court fee has been paid on that petition. 22. After that 3 years has been passed and in these years the said respondent had never try to talk or come to matrimonial home nor even excuse for her deed. The petitioner has no legal impediments why the said relief sought for is not granted to the petitioner. No such petition is pending or has been decided by any court of law on the same subject matter between same parties. . 23.20. 21. 25. PRAYER it is therefore prayed that a decree for divorce under section 13 of hindu marriage act 1955 there by dissolving their marriage of the petitioner and the respondent on the ground of cruelty and desertion may kindly be passed in favour of the petitioner and against the respondent along with cost of the petition. The present petition has not been by the petitioner filed in collusion with the respondent.
