The Lessor, by virtue of the Deed of .attested by ., Notary Public seised and possessed of or otherwise well and sufficiently entitled to the divided and defined allotment of land marked depicted in Plan No. .. dated made ., Licensed Surveyor together with the House and everything else standing thereon of the Land called .bearing Assessment No ..situated along Road in .within the ..Municipal Council Limits of ..in morefully described in the schedule

hereto (which is hereinafter referred to as the Demised Property)

The Lessor have agreed to lease out and the Lessee are agreeable to taking on lease the Demised Property and have agreed to enter into this Lease Agreement with the Lessees incorporating the terms and conditions that will apply to this Lease; Witnesseth

Now this Indenture further witnesseth that in consideration of the rentals to be paid by the said Lessee as hereinafter provided unto the said Lessor and her aforewritten and in consideration of the covenants provisions and agreements hereinafter contained to be performed the said Lessors doth hereby let lease and demise unto the Lessee all that of the Demised Property morefully described in the Schedule hereto and together with all and singular the rights privileges easements servitudes and appurtenances whatsoever to the said Demised Property belonging or used or enjoyed with reputed or known as part and parcel thereof and all the estate right title interest property claim and demand whatsoever of the said Lessor of in to upon or out of the same. To have and to hold the said Demised Property fully described in the Schedule hereto together with all and singular the rights privileges easements servitudes and appurtenances whatsoever to the said Demised Property belonging to the said Lessor for and during term of Fifteen Months commencing from .() day of ..(month) (year) to the (th) day of (Month) ..(year) (hereinafter sometimes referred to as the said term). Yielding and paying therefor unto the said Lessors during the said term a lease rental of Rupees (Rs../=) of lawful money of Sri Lanka being the rental for the full period hereof (computed at the rate of Rupees only (Rs./=) per month and which monthly rental for a particular month is to be paid unto the Lessor or his duly authorised nominee on or before the .( ) day of each and every succeeding month and the last monthly rental being paid on ..(Month) ..(year)
(a)

Lessees Covenants: The Lessee to the intent that the obligations hereby created shall continue throughout the said term agrees and covenants with the Lessors as follows;

This Agreement shall be deemed to commence with effect from .() day of .(Month) .(year) The Lessee hereby agrees to pay to the Lessor or his duly authorised nominee Rupees (Rs/=) per month regularly and punctually on the dates aforementioned and without any default. The Lessee shall pay in addition electricity, telephone and water bills during the period of the lease including all bills connected with the use of Internet/ADSL. The Lessee shall handover the originals of electricity, telephone and water bills to the Lessor or to her representatives designated in writing after the same is duly paid by the Lessee retaining for themselves photocopies thereof. The Lessee shall pay to the Lessor an advance payment of Rupees .(Rs. /=) being a refundable deposit at the signing of this Agreement. The said deposit shall be returned by the Lessor to the Lessee at the termination of the Lease period after deductions if any made to set off any outstandings on account of electricity, water and telephone bills remaining unpaid and owing by the Lessee at the time of the termination of the Lease and any damages generally permissible wear and tear excepted The Lessee shall use Demised Premises strictly as his residence and of his children. He shall not induct any other party or persons to use it or any portion thereof for any other purpose whatsoever. More specifically he shall strictly refrain from using it for commercial, any illegal, immoral or improper purpose. The Lessee shall not bring in and or store in the said Demised Premises any hazardous articles or any dangerous items and things that may imperil the safety of the said house building and or safety of the occupants and neighbours and or do anything overtly or covertly and or provide accommodation for any person amounting to a violation of defence and security laws of Sri Lanka.

The Lessee shall not cause damage to any walls, flooring and ceiling of the said Demised Premises and shall use the said Demised Premises with due care and shall during the period of this Agreement and maintain the said Demised Premises in good order and proper condition. Any minor repairs not exceeding Rupees.(Rs/-) will have to be borne by the Lessee.

(viii) The Lessee shall not assign or sub-let or create any third party rights or transfer the benefits of this Agreement to any other person or part with the possession of the Demised Premises or any portion thereof. (ix) The Demised Premises shall have normal electricity, fittings and fixtures. The Lessee shall not put any additional fittings and fixtures in the said Demised Premises without prior written permission of the Lessor.

No changes by way of additions or alterations of structural or otherwise shall be made to the Demised Premises or carry out any work of repairs, additions or alterations to the said Demised Premises without prior written permission of the Lessor except for minor repairs aforementioned. In case any damage is caused due to negligence of the Lessees and or its servants to the said Demised Premises and/or any fittings or fixtures provided by the Lessors, Lessees shall make good such damage that may have been so caused without delay after duly notifying the Lessors. The Lessee shall not do or cause to be done anything in the Demised Premises which is likely to be or cause a nuisance or annoyance to the occupants of the neighbouring premises and/or which may cause prejudice to the right of the Lessor in any manner whatsoever. The Lessee shall always observe, comply with and perform all the laws, rules, regulations and bye-laws of the Municipal and other concerned authorities and shall not by its acts or omission commit any breach thereof.

Lessors Covenants: The Lessor to the intent that the obligations hereby created shall continue throughout the said term agrees and covenants with the Lessee as follows; The Lessor doth hereby for themselves and their aforewritten covenant with the Lessee that the Lessee hereby observing and performing the several covenants and conditions herein contain on their part to be observed and performed shall and may peaceably and quietly possess and enjoy the said premises hereby demised during the said term hereby granted without any unlawful interruption from or by the Lessor or any person lawfully claiming from or under him.
(i)

The Lessor shall pay all rates and taxes levied by the relevant Local Authority in respect of the Demised Premises.
(ii)

The Lessor hereby covenants that they shall warrant and defend the title to the Demised Premises at her own cost should there be any questions arising and affecting the use of the Demised Premises by the Lessee during the said term.
(iii)

(c)

Mutual Covenants
(i)

The Lessee shall permit the Lessor or her servants and duly authorised representatives to enter the said Demised Premises at any reasonable time for inspection or repairs of the same by giving prior notice to the Lessee and the Lessee shall not raise any objection thereof. Nothing herein contained shall be construed as creating any right, title or interest of tenancy or sub-tenancy or otherwise in favour of the Lessee in respect of the said Demised Premises, it being the express intention of the parties that this is a pure lease granted to the Lessee in terms of this Agreement. The Lessor shall always be in juridical possession and full charge and control of the said premises and the keys to the Demised Premises shall be handed over to the Lessee for the sake of convenience to facilitate ingress and egress. It is the express intention of the parties hereto that this agreement shall be a mere license in the form of a Lease, the use and occupation by the Lessee being

restricted for the purpose of using the said premises on the terms and conditions contained in the Agreement and that no tenancy or sub-tenancy of any type shall be deemed to be created by the Lessee except and otherwise for the rights created by this Agreement.
(iv)

All expenses relating to legal fees, stamp duty, registration and out of pocket expenses shall be shared equally by the Lessor and Lessee.

(d)

Termination
(i)

Notwithstanding anything contained hereinafter both the Lessor and the Lessee shall have the option to terminate the Lease granted hereunder for any reason whatsoever on giving Three (3) months prior notice in writing. On expiry of the period of this Lease either by efflux of time or sooner determination thereof, the Lessee, her servants and agents shall remove themselves, as also their article and things from the said premises, handover the keys of the said Demised Premises to the Lessor or her duly authorised representative and shall handover the charge of the said premises to the Lessor. Moreover on the termination of the Lease, the Lessee and other persons using the Demised Premises shall be considered as illegal occupants and on their failure to vacate the said premises, the Lessors shall be entitled to remove them and also prevent them from entering into the said Demised Premises, and also remove the articles and things of the Lessee that may be lying in the said premises. In case the Lessee committing a breach of any of the terms and conditions of this Agreement or fails to pay the rental payable for a particular month as provided for herein, the Lessor shall be entitled to terminate this Agreement by giving one month notice to the Lessee and after expiry of the period of such notice, the Lessor shall be entitled to prevent the Lessee from entering into the said Demised Premises without taking any legal recourse to which the Lessees hereby agrees. If the Lessee or his family allows any other person to occupy the said Demised Premises or any other portion thereof, this Agreement shall stand cancelled and the

Lessor shall have the right to prevent the Lessee or his family from using the said Demised Premises or portion thereof and in such event, the Lessee and his family hereby allows the Lessor to prevent the Lessee from using the said Demised Premises. (e) Other Terms and Conditions and Acknowledgements
(i) The renewal and the extension of the Lease period

beyond the period contemplated under this Agreement shall be at the exclusive discretion of the Lessor
(ii) Upon expiry and or non-renewal of this Agreement

and even after the receipt of the refundable deposit if the Lessee fails or refuses to handover the vacant and peaceful possession of the said Demised Premises to the Lessor for any reason what so ever, the Lessee jointly and severally shall be bound to pay Rupees ..(Rs../-) per day during such wrongful occupation.
(iii)The parties hereto hereby state that the contents of

this Agreement have been explained to them and they have properly understood all the contents of the same and thereafter they have signed it at their own free will without any force, coercion, compulsion and undue influence and in their proper state of mind. (iv) All notices to be given under this Agreement must be sent to the addresses of the Parties herein mentioned and be sent under registered cover.
