TOWNSHIP OF EWING ORDINANCE NO. _________ AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE TOWNSHIP OF EWING, COUNTY OF MERCER, STATE OF NEW JERSEY, AMENDING CHAPTER 205, TOWING AND STORAGE, TO REVISE THE FEES ASSOCIATED WITH TOWING AND STORAGE SERVICES NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Ewing that CHAPTER 205, TOWING AND STORAGE, of the Code of the Township of Ewing, is hereby amended and supplemented as follows: Section 1. §205-19. Chapter 205, Towing and Storage, is hereby amended as follows: Service rates; written notice of fee.
For purposes of this section, storage charges “per twenty-four hour period” means the maximum allowable amount to be charged by a storage facility for a twenty-four hour period or fraction thereof, which period commences with the time of the initial tow and runs for consecutive twenty-four hour periods thereafter. A new twenty-four hour period shall begin at 12:01 a.m. Charges for the transportation, hauling, storage or service of disabled vehicles by a tower under this license shall not exceed the following rates Towing rates shall include the total distance traveled from the tow vehicle’s base of operations to the job site and return by way of the shortest route possible. Tow vehicles transporting multiple vehicles at one time shall charge the applicable fee for each vehicle transported. No person shall be liable to any tow operator who tows or stores an automobile for any fees in excess of the following: A. For any work done on disabled passenger automobiles and conveying said vehicle from any point in the Township to any other point in the Township if the vehicle was located within the public right-of-way: Basic Towing Service Fees (First hour, additional time pro-rated at ¼ hour intervals): (1) Between the hours of 6:00 a.m. and 8:00 p.m.: $50 Day (between 6:00 a.m. and 8:00 p.m.): (a) (b) (c) (2) Light Duty (DOT Class 1 & 2): $75.00 Medium Duty (DOT Class 3, 4, 5, & 6): $125.00 Heavy Duty (DOT Class 7 & 8): $225.00
Between the hours of 8:00 p.m. and 6:00 a.m.: $55 Night (between 8:00 p.m. and 6:00 a.m.): (a) (b) (c) Light Duty (DOT Class 1 & 2): $85.00 Medium Duty (DOT Class 3, 4, 5, & 6): $130.00 Heavy Duty (DOT Class 7 & 8): $230.00
For conveying a passenger car vehicle to other than the tower’s facility (e.g., owner’s home, another garage), an additional fee of $1 $2.00 per mile may be charged for all distances in excess of five miles for that portion of the distance in excess of five miles. All other vehicles, other than passenger vehicles, shall be at an additional fee to be negotiated between the tower and the owner for all distances in excess of five miles for that portion of the distance in excess of five miles. Where basic towing services are rendered for a passenger automobile registered in New Jersey which was damaged in a motor vehicle accident or recovered after
being stolen, the fees set forth on the schedule for towing services contained in N.J.A.C. 11:3-38.1 et seq., as amended from time to time, are the maximum charges that shall apply to such a private passenger automobile. There shall be no additional charges other than those provided therein, including but not limited to flatbedding, waiting time, winching, cleanup cost and additional labor when only basic towing services as defined are provided. (a) The towing rates shall be calculated based on the total distance traveled from the tow vehicle’s base of service to the job site and return, by way of the shortest available route. Fractions shall be rounded up to the nearest whole mile. Tow vehicles transporting multiple passenger cars at one time shall receive the applicable for each vehicle transported. When towing services are required at the scene of an automobile accident, the day rate shall apply when the time of the accident is between 8:00 a.m. and 4:30 p.m., Monday through Friday, except New Jersey state holidays. The night, weekend and holiday rate shall otherwise apply. When towing services, are otherwise required, the day rate shall apply when the vehicle is transported (pickup to delivery) entirely between the hours of 8:00 a.m. and 6:00 p.m., Monday through Friday except New Jersey state holiday. The night, weekend and holiday rate shall otherwise apply.
For conveying any disable truck or omnibus over 1 ½ tons from any point in the Township to any other point in the Township if the vehicle was located within the public right-of-way: Recovery and/or Winching Service Fees (First hour, additional time prorated at ¼ hour intervals): (1) (2) (3) 8:00 a.m. to 12:00 midnight: $60, plus $1 per mile towed. Light Duty (DOT Class 1 & 2): $85.00. 12:00 midnight to 8:00 a.m.: $70, plus $1 per mile towed. Medium Duty (DOT Class 3, 4, 5, & 6): $125.00. Heavy Duty (DOT Class 7 & 8): Price to be negotiated between owner and operator.

When basic towing services are rendered pursuant to this ordinance, there shall be no additional charges other than those provided for herein, including, but not limited to, flat bedding, winching, cleanup costs and additional labor. For any vehicle that is rolled over, any extra charge shall be negotiated between the driver of the vehicle and the licensee. This is in addition to the prescribed rates for the actual towing of the vehicle. Straight body truck: Vehicle Yard Removal Fee: $25.00. (1) (2) 6:00 a.m. to 8:00 p.m.: $65, plus $1 per mile towed. 8:00 p.m. to 6:00 a.m.: $75, plus $1 per mile towed.
Tractor trailer or any vehicle over two axles: at all times, $95, plus $1 per mile towed. Administrative Fee (includes all correspondence or contact with insurance companies, owners, salvage companies, etc.): $5.00 per contact not to exceed $25.00 total. Clean-up Fee (includes sweeping the road and removal of vehicle parts from motor vehicle accident scenes): $25.00. For any rolled over or severely damaged tractor trailer, or one which is in a condition where additional services are required in order to render the vehicle towable, a fee may be negotiated between the owner or driver and the tower. Clean-up Materials/Speedy-Dry Fee: $10.00 per bag. For conveying vehicles from a point within the Township to a point outside the Township, or vice versa, the rate is to be predetermined by mutual agreement. Storage: (1) (2) For dead storage of passenger automobiles: $15 per twenty-four hour period. Where storage services for private passenger automobiles are rendered for a passenger automobile registered in New Jersey which was damaged in a motor vehicle accident or recovered after being stolen the fees set forth on the schedule of storage services contained in N.J.A.C. 11:3-38.1 et seq., as amended from time to time, are the maximum storage charges per twenty-four-hour period that shall apply to a private passenger automobile that is stored by a person as a result of accident or theft recovery. No release fees shall be charged for releasing vehicles after normal business hours.

For dead storage of trucks and omnibuses over 1 ½ tons: $15 per hour. Waiting time: (1) (2) (3) Light-duty wrecker (includes flatbed truck): $15 per hour. Heavy-duty wrecker: $20 per hour. Waiting charges shall not begin until ½ hour after the arrival of the wrecker at the scene and shall be prorated into quarter hours and must be acknowledged in writing by the police officer at the scene.
Except as provided in § 205-19A(4), charges for removal of vehicle debris or materials in the area surrounding the vehicle shall be charged at the rate of $15 per ½ hour and must be listed on the notice of charge form. Response time; missed calls.
Licensees shall respond to a vehicle within 15 minutes after being notified of a necessary service call unless a longer response time is approved by the Police Department. If the tower on call is dispatched for towing service and arrives on the scene of the accident within the specified response time, that tower shall be given the tow or paid the towing fee by the citizen, regardless of whether or not the citizen has subsequently requested requests that another tower be dispatched. This Ordinance shall take effect immediately upon passage and publication according to law. STATEMENT
This Ordinance amends the Revised General Municipal Ordinances of the Township of Ewing, Chapter 205, Towing and Storage, to revise the fees associated with towing and storage services.
