AN ORDINANCE AMENDING THE REVISED GENERAL ORDINANCES OF THE


TOWNSHIP OF EWING, COUNTY OF MERCER, STATE OF NEW JERSEY, REZONING
THE ROBBINS PHARMACY PROPERTY, BLOCK 223, LOTS 211 AND 25, LOCATED AT
2108 PENNINGTON ROAD, FROM PROFESSIONAL (PRO) TO BUSINESS
NEIGHBORHOOD (B-N)

WHEREAS, on November 14, 2005, Richard Robbins provided written request to the
Planning Board for a zoning change of his property, known as the Robbins Pharmacy at 2108
Pennington Road, Block 223, Lots 211 and 25 from Professional (PRO) to Business
Neighborhood (B-N); and,

WHEREAS, the request was referred to the Planning Board for its review whereupon the
Planning Board provided the Township Council with a report of its findings, which is attaché
hereto and made part hereof, pursuant to N.J.S.A. 40:55D-64 and 55D-26a; and,

WHEREAS, the subject property is also known as Block 223, Lots 211 and 25 (the
“property”) on the Ewing Township Tax Map is located at 2108 Pennington Road; and,

WHEREAS, since 1960, the property has been the location of the Robbins Pharmacy;
and,

WHEREAS, on February 2, 2006, a public hearing took place before the Planning Board
and likewise, on May 9, 2006, a public hearing will take place before the Township Council;
and,

WHEREAS, on February 2, 2006, the Planning Board recommended approval of the


proposed rezoning ordinance; and,

WHEREAS, for the reasons set forth in Ewing Township Planning Board Resolution of
Memorialization 2006-05, adopted March 2, 2006, attached hereto and made a part hereof, the
Planning Board recommended Township Council approve the rezoning of Block 223, Lots 211
and 25 from Professional (PRO) to Business Neighborhood (B-N); and,

WHEREAS, the Planning Board found that the proposed rezoning would be substantially
consistent with the Township land use planning principles described in its Master Plan; would
have substantial positive tax benefits to the community; and would not adversely impact the zone
plan; and,

WHEREAS, Planning Board Resolution 2006-05 represents the Planning Board’s report
as required by N.J.S.A. 40:55D-26a; and

WHEREAS, the Township Council accepts the Planning Board’s recommendations and
approves the rezoning of Block 223, Lots 211 and 25; and,

NOW, THEREFORE, based upon the recommendations of the Planning Board of the
Township of Ewing, BE IT ORDAINED by the Township Council of the Township of Ewing
that Chapter 15, LAND DEVELOPMENT, of the Code of the Township of Ewing, and the
Official Zoning Map of the Township of Ewing are hereby amended and supplemented as
follows:

Section 1. The following Block and Lots shall be rezoned from the current Professional
(PRO) to Business Neighborhood (B-N) designation:

Section 2. This Ordinance shall take effect after final publication according to law.

STATEMENT

This Ordinance amends the Revised General Municipal Ordinances of the Township of Ewing to
rezone Block 223, Lots 211 and 25 from Professional (PRO) to Business Neighborhood (B-N)
and amends the Zoning Map to reflect the same.
