The foreign Trade Policy prohibits the export or import by any person without an Importer-Exporter Code (IEC) number unless specifically exempted. The IEC number is granted on application by the competent authority in accordance with the specified procedure.

IEC No: Exempted Categories

The following categories of importers or exporters have been exempted from obtaining IEC number:

(i) Importers covered by clause 3(1) [except sub-clauses (e) and (I)] and exporters covered by clause 3(2) [except sub-clauses (i) and (k)] of the Foreign Trade (Exemption from application of Rules in certain cases) Order, 1993. (ii) Ministries/Departments of the Central or State Government. (iii)Persons importing or exporting goods for personal use not connected with trade or manufacture or agriculture. (iv)Persons importing/exporting goods from/to Nepal provided the CIF value of a single consignment does not exceed Indian Rs. 25000. (v) Persons importing/exporting goods from/to Myanmar through Indo-Myanmar border areas provided the CIF value of a single consignment does not exceed Indian Rs.25000. However, the exemption from obtaining Importer-Exporter Code (IEC) is not applicable for the export Special Chemicals. Organisms, Materials, Equipments and Technologies (SCOMET) except in the case of exports by Ministries/Departments of the Central/State Government.

(vi)The FTP allows the following permanent IEC Numbers to be used by the categories of importers/exporters mentioned against them for import/export purposes. Note: Commercial Public Sector Undertaking (PSU) who have obtained PAN are however required to obtain Importer Exporter Code number. The permanent IEC number as mentioned above, should be used by non-commercial PSUs.

Application for Grant of IEC Number An application for grant of IEC number is required to be made in the prescribed form alongwith specified documents, by the Registered/Head office of the applicant to the Regional authority under whose jurisdiction, the Registered office in case of company and Head office in case of others, falls. In case of STP/EHTP/BTP units, the Regional Offices of the DGFT having jurisdiction over the district in which the Registered/ Head Office of the STP unit is located has been empowered to issue or amend the IECs. An IEC number allotted to an applicant remains valid for all the branches/divisions/units/factories as indicated in the format of IEC. Duplicate Copy of IEC No. In case the IEC Number is lost or misplaced, the issuing authority may consider requests for grant of a duplicate copy of IEC number, if accompanied by an affidavit. Surrender of IEC No. If an IEC holder does not with to operate the allotted IEC number, the same may be surrendered by informing the issuing authority. On receipt of such intimation, the issuing authority immediately cancel the same and electronically transmit it to DGFT for onward transmission to the customs and Regional Authorities. STAR EXPORT HOUSE The Foreign Trade Policy provides that Merchant as well as Manufacturer Exporters, Service Providers, Export Oriented Units (EOUs) and Units located in Special Economic Zones (SEZs), Agri Export Zone (AEZ’s), Electronic Hardware Technology Parks (EHTPs),

Software Technology Parks (STPs) and Bio Technology Parks (BTPs) shall be eligible for applying for status as Star Export Houses. Privileges to Status Holders A Star Export Hose in eligible for the following facilities: (i) License/certificate/permissions etc. and both imports and exports on self-declaration basis. (ii) Fixation of Input-Output norms on priority with 60 days. (iii)Exemption from compulsory negotiation of documents through banks. The remittance, however, would continue to be received through banking channels; (iv)100% retention of foreign exchange in EEFC account. (v) Enhancement in normal repatriation period from 180 days to 360 days. (vi)Exemption from furnishing of Bank Guarantee in Schemes under the Policy. The application for grant of any status, is required to be filed in the prescribed format before 31st March. An existing status holder has been automatically given an equivalent star export house as per the following Table:

Importer Exporter Code Number Definition of IEC Code IEC Code is unique 10 digit code issued by DGFT – Director General of Foreign Trade , Ministry of Commerce, Government of India to Indian Companies. Full form of IEC Code Full From of IEC Code is : “Importer Exporter Code ”. To import or export in India, IEC Code is mandatory. Territorial Jurisdiction of Regional Authorities Every application, unless otherwise specified, shall be submitted to the Regional Authority of Directorate General Foreign Trade, as per the territorial jurisdiction of the Regional authorities indicated in Policy and Handbook of Procedure Volume-I. Every application for an Import/Export licence/ certificate/ Authorisation/ permission or any other purpose should be complete in all respects as required under the relevant provisions of the Policy/Procedures and shall be signed by the applicant as defined in paragraph 9.9 of the Policy. An incomplete application is liable to be

rejected giving specific reason for rejection. However in case of manual applications, the applicant would furnish a soft copy of the application in MS word format. Profile of Importer/ Exporter Each Importer/Exporter shall be required to file importer/ exporter profile once with the Regional Authority in Part 1 of ‘Aayaat Niryaat Form - ANF2A’. Regional Authority shall enter the information furnished in Part 1 of ‘Aayaat Niryaat Form ANF-2A’ in their database so as to dispense with the need for asking the repetitive information. In case of any change in the information given in Part 1 of ‘Aayaat Niryaat Form ANF-2A’, importer/exporter shall intimate the same to the Regional Authority. The major functions of the EPCs are:

(i) To Provide commercially useful information and assistance to members in developing and increasing export; (ii) To offer professional advice to member in areas such as technology upgradation, quality and design improvement, standards and specifications, product development, innovation etc. (iii)To organize visits of delegations of its members abroad to explore overseas market opportunities; (iv)To organize participation in trade fairs, exhibitions and buyer-seller meets in India and abroad; (v) To Promote interaction between the exporting community and the Government both at the central and state levels; and (vi)To build a database on the exports and imports of the members.
