LETTER OF ASSENT BETWEEN UTILITY AND LOCAL 1049, IBEW REGARDING NORTHEASTERN LINE CONSTRUCTORS CHAPTER, NECA UTILITY AGREEMENT
This letter of Assent regarding Collective Bargaining Agreement Between Local Union No. 1049, IBEW and the
UTILITY
Chapter, NECA (“Utility Agreement”) is made and entered into as of the 29
th
day of October, 2012 by and between UTILITY and IBEW Local Union No. 1049. Pursuant to this Letter of Assent and notwithstanding anything to the contrary contained in the Utility Agreement, UTILITY and IBEW Local Union No. 1049 agree as follows with regard to
UTILITY
employees currently working with regard to National Grid work assignments (hereinafter referred to as “employee(s)”): 1.
That for a period of time October 29, 2012 through November 29, 2012,
UTILITY
agrees to normal working hours and overtime provided for in Article VIII of the Utility Agreement; 2.
That for the period of time October 29, 2012 through November 29, 2012,
UTILITY
agrees to pay its employees the wages provided for in Article IX of the Utility Agreement; 3.
That for the period of time October 29, 2012 through November 29, 2012,
UTILITY
shall contribute $9.75 per work hour to the Union Health and Welfare Fund so that each employee shall be eligible to receive additional medical, dental and vision insurance as outlined in the Utility Agreement, Article XIX. 4.
That for the period of time October 29, 2012 through November 29, 2012,
UTILITY
shall contribute 22 ½ % of each employee’s gross salary into the “I.B.E.W. Local 1049 Craft Annuity Fund” as provided in Section 19.20 of the Utility Agreement. 5.
That for the period of time October 29, 2012 through November 29, 2012,
UTILITY
shall contribute 3% of each employee’s gross salary into the “I.B.E.W. Local 1049 Craft Division Skill Improvement Fund” as provided in Section 19.03 of the Utility Agreement. 6.
That for the period of time October 29, 2012 through November 29, 2012,
UTILITY
shall contribute 3% of each employee’s gross salary to the local collection agent for the “National Electrical Benefit Fund” as provided in Section 19.05 of the Utility Agreement. 7.
That for the period of time October 29, 2012 through November 29, 2012,
UTILITY
shall contribute 0.75% of the rate of pay per hour for each hour worked to the “Electricity Industry Administrative Maintenance Trust of Northeastern Line Constructors Chapter, NECA fund” as provided in Section 19.06 of the Utility Agreement. 8.
That for the period of time October 29, 2012 through November 29, 2012,
UTILITY
shall contribute $0.01 per hour for each hour worked to the “National Labor Management Cooperation Committee” as provided in Section 19.07 of the Utility Agreement. 9.
That for the period of time October 29, 2012 through November 29, 2012,
UTILITY
shall contribute 0.5% of each employee’s gross salary to the “National Electrical Industry Fund.”
10.
That for the pay period of time October 29, 2012 through November 29, 2012,
UTILITY
shall contribute 1% of each employee’s gross salary to the “Northeastern Joint Apprenticeship and Training Trust.” 11.
That
UTILITY
shall deduct 1% of gross payroll for employees for the period of time October 29, 2012 through November 29, 2012 and shall remit the same to the IBEW Local 1049 as union dues to the extent of appropriate under Section 3.02 of the Utility Agreement. 12.
This Letter of Assent and any obligations under the Utility Agreement shall only apply to performed by
UTILITY
for National Grid from October 29, 2012 through November 29, 2012; and 13.
All of Electricity’s of
STATE’S
obligations under the above referenced Utility Agreement automatically terminate on October 29, 2012 upon
UTILITY’s
completion of work currently being performed for National Grid.
