duly
sworn, state
as
follows:

I
am
a
Special
Agent
with
the
Federal Bureau
of
Investigation
(FBI)
and have been
employed
with
the
FBI
since
August
2009.
As
part
of
my
duties
as
an
FBI
agent,
I
investigate criminal
violations
to
include federal crimes
relating
to
child
exploitation
and
child pornography.
2.
This
affidavit
is
submitted
in
support
of
a
criminal complaint
alleging
that
JASON
VILLASANA
violated Title
18,
United
States Code, Section
2252A(a)(2)(B)(Receipt
of
Child
Pornography),
Title
18,
United
States
Code,
Section 2252A(a)(2)(B)
(Distribution
of
Child
Pornography),
and
Title
18,
United
States Code, Section 2251(a) and
(b)
(Production
of
Child
Pornography).
The
information
contained
in
this
affidavit
is
not
an
exhaustive account
of
everything
I
know
about this
case.
Rather,
it
contains
only the
facts
that
I
believe
are necessary
to
establish
probable
cause
in
support
of
the
offenses alleged
in
this
complaint.

I
am
familiar with the information
contained
in
this
affidavit
based
on my personal
knowledge,
information
provided
to
me by
other
law
enforcement officers
involved
in
the investigation,
a
review
of
records
obtained from
an
internet
service
provider
and
other
entities,
and
information
provided
by
Jason VILLASANA in
a
post-arrest statement.
FACTS
SUPPORTING PROBABLE
CAUSE
A.
National Center
for
Missing
and
Exploited Children Cypertips
4. On
August
07, 2012, Sergeant Blane
Rodgers,
a
peace
officer
certified
by The State
of
Texas,
currently
employed
as
a
Sergeant
with
the
Texas
Attorney
General
Law
Enforcement
Division, received Cybertips
from the
National Center
for
Missing and Exploited Children,
hereinafter
referred
to
as
NCMEC.
The
NCMEC
is
a
non-profit
organization which
provides

resources
to
law
enforcement,
parents,
and
children.
A
Cybertip
is a
reported incident from the Cybertip
Line
operated
by
NCMEC
which allows individuals
and businesses
to report
incidents
of
child
exploitation,
possession, and
promotion
of
child
pornography
and
other
sexual
crimes against children.
5.
Cybertips provided
by
NCMEC
indicated
that
29
images
of
child
pornography which
had
been
located
in
association
with
email
accountjbhclvrl@hotmail.com with
username
jane
smith .
The
Cybertip
report
also
indicated
the
user
accessed
the online
account utilizing
Internet
Protocol
(IP)
address 99.47.53.236 on July
31,
2012 18:19
hours
and
August
01,
2012 12:42:43
A.M.-
1:12:45 A.M.
An
IP
address
identifies
a
certain
computer or
device on
a
network
or
the internet.
Upon
reviewing
the
images,
Sergeant
Rodgers
determined
that
all 29
of
the
images
constituted
child pornography.

After
reviewing
the
images,
Sergeant
B.
Rodgers
determined
that
multiple
images
were actually
minor
children
engaged
in
sexually
explicit conduct.
Sergeant
Rodgers
has
extensive
training
and
experience
in
the detection
and
investigation
of
child
exploitation
and
crimes involving child pornography.
7. On
August
07, 2012, Sergeant Rodgers received
an
additional
NCMEC
Cybertip which contained
approximately
180 images
of
child
pornography,
adult
pornography,
and
child
erotica
images
which were located
in
association
with jbhclvrl@hotmail.com,
username
jane
smith ,
and
IP
address
99.47.53.236.
After
reviewing
the
images, Sergeant Rodgers
determined
that
over
80
of
the
images
constituted
child
pornography.
The images
were uploaded
via
IP
address
99.47.53.236
on July
31,
2012
at
17:19
EDT.

Subpoenas
8.
Sergeant
Rodgers
determined
that
IP
address
99.47.53.236 resolved
to
AT&T. Sergeant Rodgers
submitted
an
Administrative
Subpoena
to
AT&T
for
account
information
for
IP
