Moore,DurandCrosbyand/orEllenBuettner,actingineithertheirindividualcapacityand/orintheircapacityasemployeesanddirectors
of
theODMHSAS,occurredeitherwhiletheDefendantswereactingunderthecolor
of
Oklahomaand/orFederallaw,and/orwhileactingundercolor
of
stateorfederallawinwhichtheyexceededtheirauthoritybutappearedtobeotherwiseactingundercolor
of
stateorfederallaw.
12.OnoraboutAugust23,2013,thePlaintiffwasterminatedasanInvestigatorwiththe
Department
of
MentalHealthandSubstanceAbuseServices.
13.Onorabout1/28/2014,thePlaintifftimelysubmittedanIntakeQuestionnaireandfileda
Charge
of
DiscriminationagainsttheDefendantthroughtheEqualEmployment
OpportunityCommission( EEOC ).
