Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Protect the Flag Act’’.

SEC. 2. INELIGIBILITY FOR FEDERAL FUNDS.

(a) I
N
G
ENERAL
.—Federal funds may not be made
6
available to an institution of higher education (as defined
7
in section 102(a) of the Higher Education Act of 1965
8
(20 U.S.C. 1002(a))) that, pursuant to an official policy
9
of the institution to prohibit the display of the flag of the
10
United States by the institution, removes, censors, takes
11
down, prohibits, or otherwise halts display of a flag of the
12
United States.

(b) R
EINSTATEMENT OF
E
LIGIBILITY
.—The prohibi-
14
tion described in subsection (a) shall cease to apply with
15
respect to an institution described in such subsection upon
16
complete and proper reinstatement, by the institution in
17
its official capacity, of the flag of the United States at
18
any and all locations on campus property (including across
19
multiple campuses, if applicable) from which a previously
20
displayed flag of the United States was removed, censored,
21
taken down, prohibited, or otherwise halted from display
22
pursuant to an official policy of the institution to prohibit
