.—Subchapter II of chapter 45

of title 5, United States Code, is amended by insert-
5
ing after section 4512 the following:

‘‘§4512A. Department of Homeland Security awards
7
for cost savings disclosures
8
‘‘(a) In this section, the term ‘surplus operations and
9
support funds’ means amounts made available for the op-
10
erations and support account, or equivalent account, of the
11

Department of Homeland Security, or a component there-

of—
2
‘‘(1) that are identified by an employee of the
3
Department of Homeland Security under subsection
4
(b) as unnecessary;
5
‘‘(2) that the Inspector General of the Depart-
6
ment of Homeland Security determines are not re-
7
quired for the purpose for which the amounts were
8
made available;
9
‘‘(3) that the Chief Financial Officer of the De-
10
partment of Homeland Security determines are not
11
required for the purpose for which the amounts were
12
made available; and
13
‘‘(4) the rescission of which would not be detri-
14
mental to the full execution of the purposes for
15
 which the amounts were made available.
16
‘‘(b) The Inspector General of the Department of
17
Homeland Security may pay a cash award to any employee
18
of the Department of Homeland Security whose disclosure
19
of fraud, waste, or mismanagement or identification of
20
surplus operations and support funds to the Inspector
21
General of the Department of Homeland Security has re-
22
sulted in cost savings for the Department of Homeland
23
Security. The amount of an award under this section may
24
not exceed the lesser of—

‘‘(1) $10,000; or
1
‘‘(2) an amount equal to 1 percent of the De-
2
partment of Homeland Security’s cost savings which
3
the Inspector General determines to be the total sav-
4
ings attributable to the employee’s disclosure or
5
identification.

For purposes of paragraph (2), the Inspector General may
7
take into account Department of Homeland Security cost
8
savings projected for subsequent fiscal years which will be
9
attributable to such disclosure or identification.

‘‘(c)(1) The Inspector General of the Department of
11
Homeland Security shall refer to the Chief Financial Offi-
12
cer of the Department of Homeland Security any potential
13
surplus operations and support funds identified by an em-
14
ployee that the Inspector General determines meets the
15
requirements under paragraphs (2) and (4) of subsection
16
(a), along with any recommendations of the Inspector
17
General.

‘‘(2)(A) If the Chief Financial Officer of the Depart-
19
ment of Homeland Security determines that potential sur-
20
plus operations and support funds referred under para-
21
graph (1) meet the requirements under subsection (a), ex-
22
cept as provided in subsection (d), the Secretary of Home-
23
land Security shall transfer the amount of the surplus op-
