Purpose/Background.
1.1U.S.Immigrationand
Customs
Enforcement(ICE)EnforcementandRemovalOperations(ERO)mustconsiderandaddresstheparticularneedsandvulnerabilities
of
pregnantwomendetainedinitscustody.AsdirectedinSecretaryJohnson smemorandum,entitled
Policiesforthe pprehension DetentionandRemoval
 
UndocumentedImmigrants
(Nov.20,2014),absentextraordinarycircumstancesorthe
requirement
of
mandatorydetention,pregnantwomenwillgenerallynotbedetainedbyICE.WhiledetainedinICEcustody,pregnantwomenwillbere-evaluatedregularlyto
determineifcontinueddetentioniswarranted,receiveappropriateprenatalcare,andbe
appropriatelymonitoredbyICEforgeneralhealthandwell-being.
1.2Thismemorandumsetsforthprocedurestoensurethatpregnantindividualsdetainedin
ICEcustodyareidentified,monitored,andhousedinthemostappropriatefacilityto
managetheircare.Thememorandumoutlinestherelevantresponsibilities
of
offices
within
ERO
to
identify
and
track
pregnant
detainees
ensure
that
they
are
receivingappropriateprenatal
care
and
re evaluatetheircontinueddetention
onan
ongoing
basis.
1.3
ThismemorandumcodifiesexistingICEpolicyandproceduresthataddressthe
identificationandmonitoringofpregnant
women
detainedinICEcustody,and
complementsICE snationaldetentionstandardsandICEHealthServiceCorps(IIISC)
policies,includingthosereferencedbelow.
