Under Education Code section 44939, subdivision (c)(1), review of a motion filed pursuantto this section is limited to a determination as to whether the facts as alleged in the Notice of Intent to Dismiss, if true, would be sufficient to constitute a basis for immediate suspension.10.On July11, 2017, Administrative Law JudgeAdam L. Berg granted Mr. Baugh’s motion. Mr. Baugh was taken off unpaid administrative leave and placed on paid administrative leave pending the outcome of the hearing.
The Protest Event
11.On February16, 2017, a protest event called “A DayWithout Immigrants” was held throughout the country. The protest event was meant for persons who were immigrants, or who supported immigrants, to stayhome in order to show what impact immigrants have, economically, on society. It was a nationwide protest event and was not limited to any particular profession.12.RHS has approximately1,600 students. Approximately90 percent of the students are Hispanic. According to the principal of RHS, Jose Araux, a “robocall” was made to parents prior to the protest event urging them to have their students attendschool.Tamara Elzig, the DeputySuperintendent, also testifiedthat a posting was placed on the district’s website informing parents about the importance of having their students attend school on February16, 2017. Nonetheless, about 355 students, or 22 percent of the student body, were absent on the dayof the protest event. Dr. Araux conceded that there was no wayof knowing preciselywhat the reason was for each absence, but presumably, manywereattributable to the protest event.

13.On February16, 2017, several teachers at RHS –GeoffreyGreer, Robin Riggle, Charles Baugh, Patricia Crawford,and AllenUmbarger, posted comments on a Facebook thread started by Mr. Greer on his public Facebook page. The original post by Mr. Greer read as follows:Well. A day without immigrants. Perhapsall the missing workers in all the various industries out there had the intended impact and sent the desired message. I don’t know.
