in
the
Ninth
Circuit.
The
federal
caseseeks
to
enjoin
this
actionas
collaterally
estopped
by
a
prior
judgment
of
a
federalcourt.If
the
United
States
Court
ofAppeals
for
the
Ninth
Circuitreverses
the
federalDistrict
Court sorder
of
dismissal,
then
this
action
will
notproceed.Accordingly,
this
Courtshould
not
proceed
to
trial
in
the
matter
when
there
is
a
real
possibilitythat
trial
will
be
unnecessary
or,
worse,
that
trial
wouldgo
forward
in
a
case
later
enjoined
by
the
federalcourts,
thus
wasting
both
the
parties
and
the
Court s
resources.
In
granting
the
Motion
to
Dismiss,
the
federalDistrict
Court
acknowledged
the
importance
and
legitimacy
of
the
collateral
estoppel
issue.
The
federalDistrict
Court,
however,
failed
to
consider
significant
points
of
law—most
notably,the
fact
thatfederal,
not
California,
law
has
always
controlledresolution
of
the
collateral
estoppel
issue
in
this
case.
On
appealbefore
the
Ninth
Circuit,
CSI
will
address
these
issues,
and
CSI
expects
the
Ninth
Circuit
to
resolvetheappeal
in
its
favor.
This
Motion
is
based
on
this
Notice
of
Motion,
the
attached
Memorandum
of
Points
and
Authorities,the
Declaration
of
BertH.Deixler
filed
concurrentlyherewith,
all
of
thepleadings,
files
and
records
inthis
proceeding,
all
othermatters
