The Honorable Rod Rosenstein Deputy Attorney General United States Department of Justice 950 Pennsylvania Ave, NW Washington, D.C 20530 Dear Deputy Attorney General Rosenstein: The House Permanent Select Committee on Intelligence (the "Committee) issued a subpoena to the Department of Justice (DOJ) on April 30 2018 requesting specic documents related to the Committee's ongoing investigation into the alleged misuse of FISA authorities by DOJ and the Federal Bureau of Investigation DOJ has iled to comply with this subpoena and is willlly disregarding a lawl demand om Congress to review documents pertinent and relevant to its constitutional oversight of the Executive Branch Rather than simply providing the Committees Members and designated sta the opporunity to review the subpoenaed documents, DOJ continues to obscate and delay its production using an array of tactics, such as incorrectly categorizing the requested documents as Gang-oEightlevel material in order to limit access Such conduct by DOJ is unacceptable because the GangoEight is a legal iction that has no basis outside of the connes of Presidential approval and reporting of cover actions Your continued resal to permit Members of Congress and designated sta o review the requested documents is obstruction of a lawl Congressional investigation I will not relent in my duties on behalf of the American public to discover all the cts in this matter Accordingly, I request that DOJ provide all Committee Members and designated sta ll, unredacted access to all the documents requested in the April 30 2018, subpoena by Tuesday, June 12, 2018 Any response lling shot of this request will be considered an eot to conceal material nrmation om Congressa dangerous precedent that threatens the core of our democracy
