immigrant
students
in
federaldetention
in
grades
pre-kindergartenthrough
twelve.
The
voluntary
amendment
of
an
existing
contract
for
charter
is
not
a
matter
of
right
or
entitlement,
but
thecommissioner
is
required
to
considerthe
factors
set
forth
in
Title
19,
Texas
Administrative
Code
TAC),
§100.1033 b .Amendment
considerations
include
the
performance
of
thecharter
holder
in
carrying
out
its
current
public-schoolobligations,
including,butnot
limited
to,
student
performanceand
the
financialposition
of
the
charter.The
commissionerapproves
a
substantiveamendment
only
if
the
charter
holder
meets
all
applicable
requirements
and
only
if
theamendment
is
in
thebest
interest
of
the
students
enrolled
in
the
charter
school.

educational
agencies
that
wish
to
provide
services
to
unaccompanied
alien
children
in
federal
custody
may
do
so
on
a
contractual
or
tuition
feebasis
butmaynotdo
so
with
state
education
funding.
The
legalobligation
to
provide
educational
services
to
children
in
federaldetention
lies
with
thefederalgovernment.
