SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Second Amendment

Protection Act’’.

.—Sec-

tion 922 of title 18, United States Code, is amended—
5
(1) in subsection (d)(3), by inserting before the
6
semicolon the following: ‘‘(except that an individual
7
shall not be treated as an unlawful user of or ad-
8
dicted to any controlled substance based on the indi-
9
vidual using marihuana for a medical purpose in ac-
10
cordance with State law)’’; and
11
(2) in subsection (g)(3), by inserting before the
12
semicolon the following: ‘‘(except that an individual
13
shall not be treated as an unlawful user of or ad-
14
dicted to any controlled substance based on the indi-
15
vidual using marihuana for a medical purpose in ac-
16
cordance with State law)’’.

ATE
.—The amendments made by
18
this section shall take effect 90 days after the date of en-
19
actment of this Act.
