civil
unrest
.
On
August
25th
at
approximately
11:45
pm
a
shootingoccurred
at
Car
Source
which
is
located
at
thenorthwestcorner
of
63rd
St
and
Sheridan
Road
in
theCity
and
County
of
Kenosha
,
State
of
Wisconsin
.
The
man
who
was
shot
at
this
location
was
identified
as
Joseph
Rosenbaum
.
Rosenbaum
was
transported
to
a
local
hospital
where
a
doctor
declared
himto
bedeceased
on
August
26
,
2020at
12:47
am
.
Inthecourse
of
investigatingthis
incident
,
lawenforcementreviewed
and
shared
with
yourcomplainantmultiplevideos
that
appeared
to
be
recordedon
cell
phones
.
Inthe
first
video
,a
male
who
was
later
identified
to
beKyleH Rittenhouse
,
DOB
:
01 03 03
hereinafter
“
the
defendant
,
is
running
southwest
acrosstheeasternportion
of
the
Car
Sourceparking
lot
.
Thedefendant
is
a
resident
of
Antioch
,
IL
.
Thedefendantcanclearly
be
seen
holding
a
long
gun
,
whichwas
laterrecovered
by
lawenforcement
and
identified
as
a
Smith
Wesson
AR
-
15
style 223
rifle
.
Therecoveredmagazine
for
thisrifle
holds
30
rounds
of
ammunition
.
Followingthedefendant
is
Rosenbaum
and
trailing
behind
thedefendant
and
Rosenbaum
is
a
male
who
was
later
identified
as
Richard
McGinnis
,a
reporter
.
Thevideoshows
that
as
they
cross
theparking
lot
,
Rosenbaumappears
to
throw
an
objectat
the
defendant
.
The
object
does
nothit
the
defendant
and
a
second
videoshows
,
basedon
wherethe
objectlanded
,
that
itwas
a
plastic
bag
.
Rosenbaum
appears
to
beunarmed
for
the
duration
of
thisvideo
.A
review
of
the
second
video
shows
that
thedefendant
and
Rosenbaum
continue
tomove
across
the
parking
lot
and
approach
the
front
of
a
blackcar
parked
in
the
lot
.A
loud
bang
is
heard
on
the
video
,
then
a
maleshouts
,
“
Fuck
you
,
then
Rosenbaum
appears
to
continue
to
approach
thedefendant
and
gets
in
nearproximity
to
the
defendant
when

moreloud
bangs
are
heard
.
Rosenbaumthen
falls
to
the
ground
.
The
defendant
then
circles
behindtheblackcar
and
approachesRosenbaum
.
Rosenbaum
remains
onthe
ground
.
McGinnisalso
approaches
,
removeshisshirt
,
and
attempts
to
render
aidto
Rosenbaum
.
The
defendant
appears
to
getonhis
cell
phone
and
place
a
call
.
Another
male
approaches
,
and
the
defendantturns
and
begins
torun
awayfrom
the
scene
.
As
the
defendant
is
running
away
,
he
can
beheardsayingonthephone
,
“
I
just
killed
somebody
.
DetectiveCepress
interviewed
McGinnis
and
indicatesthe
following
:
Before
theshooting
,
McGinnis
was
interviewingthe
defendant
.
Thedefendant
told
McGinnis
that
he
was
a
trained
medic
.
McGinnisstated
that
he
McGinnis
)
hashandled
many
ARs
andthat
thedefendant
wasnot
handlingthe
weaponverywell
.
McGinnis
saidthat
as
they
werewalkingsouthanother
armed
male
who
appeared
to
be
in
his
30s
joinedthem
and
saidhewas
thereto
protect
the
defendant
.
McGinnisstated
that
before
the
defendant
reached
the
parking
lot
and
ran
across
it
,
thedefendant
had
movedfrom
the
middle
of
SheridanRoad
to
the
sidewalk
andthat
is
whenMcGinnis
saw
a
male
Rosenbaum
initially
try
to
engagethe
defendant
.
McGinnisstated
that
as
thedefendant
was
walkingRosenbaum
was
trying
to
getcloser
to
the
defendant
.
WhenRosenbaumadvanced
,
thedefendant
did
a“
jukemoveand
startedrunning
.
McGinnisstated
thatthere
were
otherpeople
that
weremoving
veryquickly
.
McGinnisstated
that
they
weremovingtowardsthe
defendant
.
McGinnissaid
that
according
to
whathe
saw
thedefendantwastrying
to
evade
these
individuals
.
McGinnis
described
the
point
where
the
defendant
had
reachedthecar
.
McGinnisdescribed
that
the
defendant
had
the
gun
in
a
lowreadyposition
.
Meaning
that
he
had
the
gun
raised
but
pointeddownward
.
The
buttof
the
gun
would
have
beenat
an
angle
downwardsfromthe
shoulder
.
McGinnis
statedthat
thedefendantbroughtthe
gun
up
.
McGinnisstated
that
he
stepped
backand
