JUDICIAL CIRCUIT, COUNTY OF ST. LOUIS STATE OF MISSOURI, FAMILY COURT In Re the matter of: Caroline Van Den Bergh n/k/a Less Petitioner, Vs Melchior Van Den Bergh Respondent. Cause No. 15SL-DR05021-01 Division 13 FINDINGS OF FACT, CONCLUSIONS OF LAW AND JUDGEMENT
Petitioner has filed a Motion for Change of Judge for Cause on January 5, 2021, after seeking leave of Court for additional time to file her Proposed Findings of Fact and Conclusions of Law in opposition to Petitioner’s Petition for Preliminary and Permanent Injunction, which is hereby stayed due to this filing. Counsel for Petitioner has made several allegations against this Court and the former Court appointed Guardian Ad Litem Elaine Pudlowski without any attempt to verify the allegations during these proceedings. The threshold issue is whether or not this Court can continue to be fair and impartial. This Court finds that Ms. Pudlowski has tirelessly served the Family Court of St. Louis County as a Court Appointed Guardian Ad Litem for over two decades with the utmost integrity, professionalism and in numerous instances without compensation. This Court finds that it is in the best interests of the minor child Saskia who has been entrenched in litigation for over 50% of her life that the Court recuse itself pursuant to Rule 2-2.9(B) and Rule 2-2.11.
