Iota Alpha Chapter of Sigma Chi Fraternity Appeal -
Hazing
I write as a follow up to the appeal letter received by my office on July 19, 2016 requesting
that California State University, San Bernardino (CSUSB) rescind the seven-year suspension
of the Iota Alpha Chapter of Sigma Fraternity. Please be reminded that that an external
investigation found the Iota Alpha chapter of Sigma Chi Fraternity to be in violation of
California State University's Executive Order 1068, CSUSB's Student Code of Conduct asdefined in the Education Code (sections 32050 and 32051), the CSUSB student club andorganization handbook and the 2015-2016 CSUSB Fraternity and Sorority charter packet inwhich the University's zero-tolerance stance towards hazing was outlined. As reported to
CSUSB officials on behalf of the Sigma Chi headquarfers following its own investigation, the
Iota Alpha Chapter of Sigma Chi Fraternity has been engaged in hazing of its new members
for three years. Given these facts, CSUSB is not inclined to accept the proposal of a four-
phase plan as it is currently presented. However, CSUSB proposes the following:1) Three-year suspension from CSUSB effective March 8, 2016 that concludes March 8,
2019
2) Two-year probation and implementation of the proposed revitalization plan that begins
March 9, 2019 and concludes March 9, 2021
3) Reconstitution of Iota Alpha Chapter Alumni Advisory Board effective March 9, 2019

Subject: Outcome Letter
Dear President of Delta Chi:
Thank you for meeting with the Office of Student Engagement and Student Conduct and Ethical
Development to discuss your organization's involvement in an incident of concern. During our meetings
with members of the organization, it was communicated that active members gathered new membersat Delta Chi's off campus house for a big brother/little brother event. At this event new members were
led to a dark room, quizzed on knowledge of the fraternity and verbally and mentally intimidated by
active members. This event was led and supported by executive board members. Based on the
information gathered, the organization played a role in facilitating an unsafe environment for potential
members. Furthermore,I have determined that the organizations conduct in regards to their new
member education activities violated the following policy(ies) of the Standards for Student Conduct
(Title 5, 41301):
(8) Hazing, or conspiracy to haze, Hazing is defined as any method or initiation or pre-initiation into a
student organization or student body, whether or not the organization or body is officially recognized byan educational institution, which is likely to cause serious bodily injury to any former, current, or
prospective student of any school, community college, college, university, or other educational
institution in the state (Penal Code 245.6), and in addition, any act likely to cause physical harm,
personal degradation or disgrace resulting in physical or mental harm, to any former, current, orprospective student of any school, community college, university or other educational institution. Theterm ``hazing" does not include customary athletic events or school sanctioned events. Neither the
express or implied consent of a victim of hazing, nor the lack of active participation in a particular hazing
incident is a defense. Apathy or acquiescence in the presence of hazing is not a neutral act, and is also a
violation of this section.
As a result of the national organization's decision to close the colony the Office of Student Engagement
withholds sanctions. OSE supports and will uphold the closure of Delta Chi's colony at California StateUniversity, San Bernardino. We will work with Delta Chi International Headquarters to determine if and

when it would be appropriate for Delta Chi to return to CSUSB.
Please continue to reach out to Jackie Varela if there are support services needed for students involved
in the Delta Chi Colony.
