On May 7, 2020, the United States Department of Justice (“DOJ”) moved to dismiss the criminal information that had been filed on November 30, 2017, against Plaintiff Lt. Gen. Michael T. Flynn, U.S. Army, Retired (“General Flynn”), charging him with one count of willfully and knowingly making false, fictitious, and fraudulent statements in a matter within the jurisdiction of the executive branch of the government of the United States. In this motion, the DOJ admitted, through Timothy Shea, then United States Attorney for the District of Columbia, that: The Government is not persuaded that the January 24, 2017 interview was conducted with a legitimate investigative basis and therefore does not believe Mr. Flynn’s statements were material even if untrue.
