CREW v. IRS: Regarding 501(c)(3) Activities

On October 19, 2006, Citizens for Responsibility and Ethics in Washington (CREW) sued the Internal Revenue Service (IRS) for failing to fulfill a CREW Freedom of Information Act (FOIA) request for documents relating to IRS practice and procedure in investigating organizations recognized as exempt pursuant to section 501(c)(3) of the Internal Revenue Code. From 2004 to 2006 the IRS initiated several investigations into tax exempt organizations based in part on complaints received from outside sources. The nature of the IRS investigations called into question the evenhanded enforcement of the law and whether politics played a role in audits. The IRS failed to comply with the FOIA and fulfill the request for documents relating to IRS investigations of exempt organizations and communications between the IRS and Congress relating to these investigations. CREW sued for IRS compliance with the FOIA and release of the requested documents.
