CREW V. Federal Election Commission (Westar)

30 Sep 2004 // Citizens for Responsibility and Ethics in Washington (CREW) sued the Federal Election Commission (FEC) for failing to produce records in response to a CREW Freedom of Information Act (FOIA) request for a report detailing potential campaign finance violations by Westar Energy Company. Westar Energy Company submitted a report to the FEC detailing an investigation into a Westar plan for company executives to make political donations in order to influence pending legislation in Congress. Upon receipt of this report the FEC neither opened an investigation nor requested more information from Westar. The FEC failed to provide the report detailing Westar’s potential campaign finance law violations and related material in response to the FOIA request made by CREW. CREW sued the FEC to force FOIA compliance and production of the report detailing Westar’s activities.
